1. Motion to adopt a Resolution Approving a Minor Amendment to the Rosemount
Crossing Planned Unit Development Agreement to construct a 1,998 square foot
addition to the ALDI building.
2. Motion to Approve the Amended Rosemount Crossing Planned Unit Development
Agreement and Authorize the Mayor and City Clerk to enter into the Agreement.

ALDI is currently located in the Rosemount Crossing Planned Unit Development that was approved in
2004. The building is 16,871 square feet, and the applicant is proposing a 1,998 square foot addition that
will bring the total building area to 18,869 square feet. By ordinance, City staff can approve minor
amendments, however, because the PUD agreement is a contract between the developer and the City,
Council approval is required. This item has been reviewed by staff and recommended for approval, but
has not been reviewed by the Planning Commission, consistent with the process outlined in the ordinance.
ISSUE ANALYSIS
Legal Authority
A Minor Amendment to the Planned Unit Master Development Plan is a quasi-judicial decision because
no City Code deviations are requested. Quasi-judicial decisions mean that the City Council is acting as a
judge to determine if the regulations within the Comprehensive Plan, Zoning Ordinance and Subdivision
Ordinance are being followed.

PROPOSAL
The applicant is requesting approval of an approximately 2,000 square foot expansion to the ALDI’s
building. The expansion will be located on the north side of the building, internal to the site. The location
is generally within existing green space and will not affect the parking or circulation on the site. The
expansion will allow additional sales space in the building.
Landscaping
Four trees will be relocated from the northern side of the building to the southern frontage to
accommodate the addition. No other changes to the landscaping on the site are proposed by the
applicant.
Parking
Plans provided by the applicant indicate restriping of the parking lot to provide the additional parking
required due to the increase in square footage. Currently the site contains 90 parking stalls, two of which
are handicapped. The proposed restriping will result in 94 parking stalls, or one per 200 square feet as
required by City Code. Four of the parking stalls will be allocated for handicapped parking. The
additional stalls will be created by reducing a number of the parking stalls from 9 feet to 8.5 feet. The
proposed restriping meets the dimensional standards for off street parking. No changes to the flow of
traffic within the site will be made.
The original 2004 PUD agreement limited the square footage of ALDI to 15,000 square feet due to
potential site parking concerns. The proposed addition will bring the total building area to 18,869 square
feet, above the approved limit. However, the condition noted a traffic study should be done if additional
square footage is added to the site. Given the small increase in square footage and the ability to restripe the
site to meet ordinance parking standards, staff does not believe a parking study is warranted.
Building Materials and Massing
The exterior surfaces on all three sides of the addition will match the existing brick façade, and the exterior
will feature vertical elements to break up the façade as required by City Code. A site plan and building
elevations have been provided by the applicant and are included in the attachments.
CONCLUSION
Staff is recommending approval of a minor amendment to the Rosemount Crossing PUD agreement for
construction of a building addition to the ALDI grocery store.

A RESOLUTION APPROVING A MINOR AMENDMENT TO THE ROSEMOUNT
CROSSING PLANNED UNIT DEVELOPMENT (PUD) AGREEMENT TO ALLOW
CONSTRUCTION OF AN ADDITION
WHEREAS, the Community Development Department of the City of Rosemount received a
request from ALDI, Inc., to amend the Rosemount Crossing Planned Unit Development
Agreement to construct an addition; and
WHEREAS, staff has prepared and recommends approval of a Minor PUD Amendment to construct
an addition, and
WHEREAS, on June 6, 2017, the City Council of the City of Rosemount reviewed the application
and staff recommendation.
NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of Rosemount hereby
approves the Minor Amendment to the Rosemount Crossing Planned Unit Development
Agreement to allow construction of an addition to reflect this change.
ADOPTED this 6th day of June, 2017, by the City Council of the City of Rosemount.

A MINOR AMENDMENT TO THE ROSEMOUNT CROSSING PLANNED UNIT
DEVELOPMENT (PUD) AGREEMENT ALLOWING AN ADDITION TO THE ALDI
GROCERY STORE BUILDING.
THIS DECLARATION made this ______ day of _______, 2017, by and between
Rosemount Crossing, LLC., (hereinafter referred to as the “Declarant”), and the CITY OF
ROSEMOUNT, a Minnesota municipal corporation (hereinafter referred to as the “City”);
WHEREAS, Declarant is the owner of the real property described on Attachment One,
attached hereto and hereby made a part hereof (hereinafter referred to as the “Subject Property”);
and
WHEREAS, the Subject Property is subject to a Planned Unit Development Agreement,
“Rosemount Crossing Planned Unit Development Agreement”, dated November 10, 2004 and
recorded with the Dakota County Recorder as document number 555080 on December 23, 2004,
(hereinafter referred to as the “Planned Unit Development Agreement”); and
WHEREAS, Declarant wishes to amend the Planned Unit Development Agreement to
construct an addition to the ALDI building which amendment has been approved and consented
to by the City of Rosemount, acting through its City Council, as evidenced by the duly
authorized signatures of its officers affixed hereto.
NOW, THEREFORE, the Declarant declares that the Subject Property is, and shall be,
held, transferred, sold, conveyed and occupied subject to the covenants, conditions, and
restrictions, hereinafter set forth.
1. The use and development of the Subject Property shall conform to the documents, plan
and drawings listed in Paragraph 1 of the Planned Unit Development Agreement and, in
addition, to the following:
a. City Resolution No. 2017-___; Attachment Two
b. Site Plan; Attachment Three
c. Elevations; Attachment Four
All of which attachments are copies of original documents on file with the City and are made
part hereof.
2. The use and development of the Subject Property shall conform to the Rosemount
Crossing Planned Unit Development Agreement except as modified herein.
3. Except as modified by paragraphs 1 and 2 of this Amendment, the Planned Unit
Development Agreement shall remain in full force and effect.
4. The obligations and restrictions of this Amendment run with the land of the Subject
Property and shall be enforceable against the Declarant, its successors and assigns, by the

City of Rosemount acting through its City Council. This Amendment may be amended
from time to time by a written amendment executed by the City and the owner or owners
of the lot or lots to be affected by said amendment.
