Regular Meeting Call to Order: Pursuant to due call and notice thereof, the Regular Meeting of the Planning Commission was held on Monday, May 23, 2017. Chair Kenninger called the meeting to order at 6:30 p.m. with Commissioners Freeman, VanderWiel, and Mele. Commissioner Clements and Henrie were absent. Also in attendance were Senior Planner Klatt, Planner Nemcek, Park and Recreation Director Schultz, and Recording Secretary Bodsberg. The Pledge of Allegiance was said. th Additions to Agenda: Senior Planner Klatt added item SKB Environmental, Inc., a continued item from April 25, 2017. Audience Input: None Consent Agenda: a. Approval of the April 11, 2017 Work Session Meeting Minutes. b. Approval of the April 25, 2017 Regular Meeting Minutes. MOTION by VanderWiel. Second by Mele. Ayes: 4. Nays: 0. RECESS REGULAR PLANNING COMMISSION MEETING AND OPEN BOARD OF APPEALS AND ADJUSTMENTS MEETING Public Hearing: 5.a. Request by James Madsen to Construct a Porch Addition within the Required Setback from a Wetland. (17-23-V) – Board of Appeals Planner Nemcek gave a brief summary of the staff report for the Planning Commission. Commissioner VanderWiel inquired if they would be able to provide the commission with reassurance that any future owner of this property would not be able to encroach further into the Wetland. Planner Nemcek stated that is a valid concern for any property owner that has a wetland on their property but that it would be a matter of trust. Chair Kenninger questioned if the variance could be specifically for the purpose of the porch so that no other part of the wetland could be encroached upon. Nemcek stated that there is a drainage and utility easement on most of the concerned area. Any future additions would need to come before the Planning Commission for a variance. The public hearing opened at 6:39 pm. Public Comments: James Madsen, James Barton Design Build, stated that the landscaping currently stops at the edge of a 10-foot drop. No homeowner would be able to encroach any further into the wetland. The current patio will be removed and the new porch will not be as big as the current patio. Madsen further explained the specifics of the project with colored photos from the property. Commissioner Freeman questioned if there will be enough room to walk around the outside of the screened porch. Mr. Madsen stated that there is about 2-3 feet to walk around the porch. The public hearing was closed at 6:51 pm. Additional Comments: None. MOTION by Mele the Board of Appeals and Adjustments to approve a variance from the Wetland Ordinance buffer and structure setback requirements from 45’ to 22’. Second by Freeman. Ayes: 4. Nays: 0. Motion Passes. MOTION by Mele to recess Board of Appeals and Adjustments meeting and reopen the Planning Commission meeting. Second by Freeman. Ayes: 4. Nays: 0. Motion Passes. RECESS BOARD OF APPEALS AND ADJUSTMENTS MEETING AND RE-CONVENE REGULAR PLANNING COMMISSION MEETING. 5.b. Request by KJ Walk, Inc. for Rosewood Crossing Final Plat, PUD Site Review and Building Plan to construct phase one of Rosewood Crossings. (17-20-FP) Senior Planner Klatt gave a brief summary of the staff report. Chair Kenninger inquired how high the privacy fence is going to be. Klatt stated that it is going to be 6 feet tall. th Kenninger questioned how far along the property line the fence will extend. Klatt stated that the fence will stop at 145 Street West. Kenninger questioned if the developer will be removing the door from the back side of the garages. Klatt stated that staff is recommending removal of the service doors. Commissioner Mele questioned if staff was comfortable delaying construction of the second access developed until the fourth phase of the development and asked why it would be constructed so late. Klatt stated that staff is comfortable th with the phasing. The first three phases are closer to 145 Street West compared to the second access. Commissioner Mele inquired if the Planning Commission would be asking the developer to remove the doors on the back of the garage. He also questioned what would happen during an extended power outage should residents need to access their garages. Klatt reviewed the staff concerns with the service doors, which included: a) the visual appearance of the doors from adjacent properties, b) the inability to install vegetation in front of the doors, c) safety issues associated with a second entrance into each building that is not visible from the rest of the development. Commissioner VanderWiel questioned why the staff recommendation includes a condition for the developer to pay a fee instead of replacing trees. Klatt stated that there is limited room for planting additional trees on the site and that the landscape plan moves most landscaping to the edge of the property in order to provide screening. Commissioner VanderWiel inquired where the money goes when the city receives money in lieu of planting the trees. Klatt stated that the money goes into a separate fund and used for planting trees throughout the City. Chair Kenninger inquired what kind of trees would be planted throughout the site. Klatt stated that there is a mixture of evergreens and other trees. Staff will be asking for the specific tree types as the different phases come forward. The public hearing opened at 7:18 pm. Public Comments: PLANNING COMMISSION REGULAR MEETING MINUTES MAY 23, 2017 PAGE 3 Warren Israelson, Owner of KJ Walk, Inc., stated that the developer has no problem removing the doors on the back of the garage. Commissioner Mele questioned if there would be access into the building during an extended power outage. Mr. Israelson stated that they will keep that in mind when they are selecting the specific garage doors. Chair Kenninger asked how high the fence would be. Mr. Israelson stated that he isn’t sure but that he will check on the specific height of the fence. MOTION by VanderWiel to close the public hearing. Second by Freeman. Ayes: 4. Nays: 0. Motion Passes. The public hearing closed at 7:23 pm. Additional Comments: Chair Kenninger questioned if the commission should include removal of the garage service doors in an approval motion. Senior Planner Klatt stated that the expectation from the staff recommendation is that the doors will be removed, but if the commission feels like they would like to address this as a specific condition of approval they are able to do so. Kenninger requested that the fence height be documented. Klatt stated that the fence height will be noted before the city council meeting. Commissioner Mele stated that he understands the service doors are a potential safety issue. Commissioner Freeman stated that she also understands having the doors are a safety issue but can also see how they would be helpful. MOTION by Mele to recommend approval of the final site and building plan for the Rosewood Crossing PUD subject to the following conditions: a. Execution of an amendment to the Rosewood Crossing PUD Agreement to incorporate the updated site and building plans. b. Payment in lieu of replacement trees of $11,700 prior to the issuance of a building permit for any structure. c. Incorporation of recommendations from the City Engineer in a review memorandum dated May 23, 2017 relative to drainage, grading, street design, easements, utilities and the adjacent sidewalks. d. Payment of a fee in lieu of park land dedication for each unit consistent with the City’s adopted fee schedule. Second by Freeman. Ayes: 4. Nays: 0. Motion Passes. MOTION by Mele to recommend approval of the Final Plat subject to the following conditions: a. Execution of a subdivision agreement. b. Provision of all easements as required by the City Engineer, and specifically, drainage and utility easements over Lot 6, Block 1 and Outlot B of the Final Plat. Second by Freeman. Ayes: 4. Nays: 0. Motion Passes Senior Planner Klatt stated that this item would go to City Council on June 20, 2017. PLANNING COMMISSION REGULAR MEETING MINUTES MAY 23, 2017 PAGE 4 5.d. SKB Environmental Master PUD Final Site, Building Plan and Simple Plat for a Metals Recycling Facility and Maintenance Shop continued from April 25, 2017 Planning Commission meeting. (17-08-PUD and 17-16- SMP) OUT OF ORDER Senior Planner Klatt stated that SKB Environmental has submitted additional information and updated plans to the City concerning its PUD and platting applications. After further review of the plans, staff discovered that the project exceeded the threshold for a mandatory Environmental Assessment Worksheet (EAW) and that an EAW would need to be prepared before the City’s formal application review could proceed. Klatt note that an EAW is required because the project is disturbing over 40 acres of land and excavating to a depth of 10 feet across the entire site. In a situation such as this, the City’s review process is placed on hold until the environmental review is complete. Staff is asking that the Planning Commission re-open the public hearing and close the hearing so that the application can be brought back before the Planning Commission once an EAW has been completed. Commissioner VanderWiel questioned what caused the mandatory EAW and whether or not it was the excavation piece or the size of the disturbance or a combination of both. Senior Planner Klatt stated that it is a combination of both the area and the depth of the disruption. The applicant has the option to go through with the EAW review or they can adjust their original plan to fall under the threshold for an environmental review. The public hearing continued at 7:32 pm. Public Comments: None. MOTION by Freeman to close the public hearing. Second by VanderWiel. Ayes: 4. Nays: 0. Motion Passes. The public hearing closed at 7:32 pm. Additional Comments: Chair Kenninger questioned if the public hearing will be re-noticed to residents when this item comes back before the Planning Commission. Senior Planner Klatt stated that notifications will be mailed to property owners at that time. He also noted that there is a 60-day review period under state law and that this review period has been suspended until the applicant either completes the EAW or adjusts their original plan. 5.c. Request by City of Rosemount for Text Amendment to Subdivision Ordinance Modifying Park Dedication Fees Calculation. (17-22-TA) Park and Recreation Director Schultz gave a brief summary of the staff report. Chair Kenninger asked why high-density developments would have to pay less for park dedication when they are probably going to use the park system more low-density developments. Schultz stated that the opposite occurs under the proposed ordinance that higher-density developments would typically end paying more on a per capita basis. The fee per unit is different for low, medium and high density. Senior Planner Klatt stated that a high-density project typically occurs on a smaller parcel of land. Commissioner Freeman inquired how the Park department views the potential reduction in revenue. Schultz stated that Park Commission reviewed the financial implications of the ordinance and noted that they performed a market analysis indicating that the land value for high-density residential developments are actually higher than low-density developments. A majority of the City’s residential areas are either low or medium density. The Park Commission does not anticipate a significant loss. Chair Kenninger stated that as the Comprehensive Plan is projecting an increase in medium and high density areas and asked if the Park Commission has studied the potential impacts of these changes. Schultz stated that the ordinance attempts to align the cash and land dedications with the needs of new residents. Commissioner Mele stated that the proposed amendments make us more competitive for potential future development. Schultz stated that it could spur more development and make it fair for all developers. PLANNING COMMISSION REGULAR MEETING MINUTES MAY 23, 2017 PAGE 5 The Commission discussed some comparisons with other communities, and noted that in general the proposed amendments are in line with the examples provided. Klatt stated that a low density residential development typically uses more land than a high density developments. If you compare the cost per unit, the high density development is contributing less but occupies less space. The single-family homes will pay more since there is potential to have more people using the parks and more land is used for the development. Schultz clarified that on a per acre basis, land values will be greater with higher densities, but high-density developments will still be using less land compared to a low-density development.
