RECOMMENDED ACTION: Motion to adopt a Resolution Approving the Vacation of the
Drainage and Utility Easement over Outlot A, Prestwick Place 13th Addition.
SUMMARY
With the approval of the Final Plat for Prestwick Place 13th Addition, a drainage and utility easement was
recorded over Outlot A within the subdivision. This outlot reserved land for future development within the
broader preliminary plat area of the Prestwick Place 13th Addition. To accommodate the development of
Prestwick Place 14th Addition, a vacation of the drainage and utility easements over Outlot A, Prestwick
Place 13th Addition is necessary. This action is typical when there are multi-phased developments in a larger
preliminary plat. Appropriate new drainage and utility easements will be recorded with the Prestwick Place
14th Addition final plat.
RECOMMENDATION
Staff recommends approval of resolution vacating the drainage and utility easement.

RESOLUTION 2017 -
A RESOLUTION APPROVING THE VACATION OF THE DRAINAGE AND UTILITY
EASEMENTS OVER OUTLOT A, PRESTWICK PLACE 13TH ADDITION
WHEREAS, the City of Rosemount received an application from Prestwick, LLC, 350 Highway 7, Suite
125, Excelsior, MN (Applicant) for the Final Plat of Prestwick Place 14th Addition;
WHEREAS, on July 18, 2017, the City of Rosemount City Council reviewed and approved the Final Plat
for Prestwick Place 14th Addition; and
WHEREAS, the vacation of the existing drainage and utility easements legally described below is required
before the Final Plat can be recorded for Prestwick Place 14th Addition; and
WHEREAS, the City Council reviewed this request and conducted a public hearing on July 18, 2017.
NOW, THEREFORE, BE IT RESOLVED, the Council of the City of Rosemount hereby approves the
Vacation of the Drainage and Utility Easements, legally described as:
All drainage and utility easements lying over, under, and across OUTLOT A, PRESTWICK PLACE
13TH ADDITION, according to the recorded plat thereof, Dakota County, Minnesota.
subject to the recording of the Final Plat of Prestwick Place 14th Addition.
ADOPTED this 18th day of July 2017, by the City Council of the City of Rosemount.
