ATTACHMENTS: Resolution, Site Location, Easement Vacation Sketch, Dunmore Final Plat APPROVED BY: LJM RECOMMENDED ACTION: Motion to approve a Resolution Vacating the Easement over Dodd Boulevard within the Dunmore Development. SUMMARY Dodd Boulevard will be relocated and renamed with the development of the Dunmore subdivision. The Final Plat for the first phase of development was approved by the Council at the June 20, 2017, City Council meeting. In order for the plat to be recorded with the County, the existing easement covering the portion of Dodd Boulevard located within Dunmore must be vacated. Dodd Boulevard will be shifted slightly to the east and renamed Caffrey Avenue. The new street will be recorded with the final plat of the first phase of Dunmore. RECOMMENDATION Staff recommends approval of the easement vacation with the conditions included in the provided resolution. CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2017 - A RESOLUTION APPROVING THE VACATION OF THE EASEMENTS OVER DODD BOULEVARD WITHIN DUNMORE WHEREAS, the City of Rosemount received an application from Copper Creek Development, LLC., for the Vacation of Easements over Dodd Boulevard within Dunmore; WHEREAS, on June 20, 2017, the City of Rosemount City Council reviewed and approved the Final Plat for Dunmore; and WHEREAS, the vacation of the existing easements legally described below is required before the Final Plat can be recorded for the Dunmore subdivision; and WHEREAS, the City Council reviewed this request and conducted a public hearing on July 31st, 2017. NOW, THEREFORE, BE IT RESOLVED, the Council of the City of Rosemount hereby approves the Vacation of the Easements, legally described as: That part of Dodd Boulevard which lies within the Southwest Quarter of the Northeast Quarter of Section 20, Township 115, Range 19, Dakota County, Minnesota and that part of Dodd Boulevard which lies within that part of the North Half of the Southeast Quarter of said Section 20 lying northerly of ROSEMOUNT FAMILY HOUSING, according to the recorded plat thereof, said Dakota County. Together with a non-exclusive easement in favor of the City of Rosemount for street, utility and drainage purposes dated November 10, 2006, recorded December 8, 2006 as Document No. 2480645. Together with a non-exclusive easement in favor of the City of Rosemount for street, utility and drainage purposes dated October 11, 2006, recorded October 25, 2006 as Document No. 2470785. Together with a non-exclusive easement in favor of the City of Rosemount for street, utility and drainage purposes dated October 11, 2006, recorded August 20, 2007 as Document No. 2538553. subject to the recording of the Final Plat of Dunmore.
