Minutes of the August 7, 2017, Special Meeting ProceedingsROSEMOUNT CITY COUNCIL REGULAR MEETING PROCEEDINGS AUGUST 7, 2017 CALL TO ORDER Pursuant to due call and notice thereof a regular meeting of the Rosemount City Council was held on Monday, August 7, 2017, at 6:00 p.m. in the Council Chambers at City Hall, 2875 145th Street West, Rosemount. Mayor Droste called the meeting to order with Council Members DeBettignies, Weisensel, and Freske attending. Council member Nelson was absent. Staff present included the following; o City Administrator Martin o City Clerk Hadler o City Attorney Tietjen o Chief of Police Scott The Pledge of Allegiance was said. ADDITIONS OR CORRECTIONS TO AGENDA City Administrator Martin stated there were no proposed changes to the agenda. Motion by Droste. Second by Weisensel. Motion to Adopt the Agenda. Ayes: 4 Nays: 0. Motion carried. NEW BUSINESS 3.a. Liquor Violation – Marko Chouliaris DBA Tops Pizza & Hoagies City Clerk Hadler gave an overview of the liquor violation at Tops Pizza & Hoagies on May 30, 2017. The owner has requested a hearing to discuss the amount of the civil penalty. She reviewed the city code requirements for the minimum civil penalty, which for the second violation is $1000. She noted that the licensee, Markos Chouliaris, was questioning whether the first violation of December 2014, was appropriate, and therefore this should be his first violation. City Attorney Tietjen noted that Mr. Chouliaris had waived his right to due process after the violation in 2014, so the point was now moot. Mayor Droste invited Mr. Chouliaris to speak. Mr. Chouliaris described his understanding of the events of 2014, and stated he was not aware of his rights, that the liquor in question was “stolen” from a private party, and that he was not given answers when he asked about it after the fact. Mayor Droste invited Chief of Police Scott to discuss the event in question. Chief Scott outlined his understanding of the events of December 2014. He reviewed the requirements of the city to do liquor compliance checks. 6.b. ROSEMOUNT CITY COUNCIL REGULAR MEETING PROCEEDINGS AUGUST 7, 2017 Council member Weisensel asked if wristbands have been implemented for private parties. Mr. Chouliaris stated they were not. The restaurant places a “private party” sign at the doorway of the party. City Clerk Hadler noted that it is still the responsibility of the licensee even if it’s a private party. City Attorney Tietjen concurred. Council member Weisensel inquired about postponing the second violation and making it dependent on the occurrence of a third. Ms. Tietjen stated she did not recommend this. Motion by DeBettignies. Second by Freske. Motion to approve a resolution imposing civil penalty in the amount of $1000 on Markos Chouliaris DBA Tops Pizza & Hoagies for a violation of the City’s liquor license regulation. Ayes: DeBettignies, Droste, Weisensel, Freske Nays: 0. Motion carried.
