ATTACHMENTS: Draft Resolution APPROVED BY: LJM RECOMMENDED ACTION: Motion to approve Resolution Authorizing American Legion Post 65 to Host Outdoor Music & Approving Temporary Liquor License. SUMMARY The American Legion Post 65 has requested the ability to host a band outside on their patio on the evening of Saturday, September 23, 2017, in conjunction with the Rosemount High School Centennial Celebration events. Because City Code 7-1-6 forbids the use of electronic sound systems / audio equipment “in a manner in which it is plainly audible at a distance of fifty feet or more from the property line”, the Council would need to issue a permit for this event to be legal. City code does allow for exceptions, one of which is “when the sound is in connection with activities for which a permit has been granted by the city.” In addition, they have requested a 1 Day Temporary Liquor License to expand their licensed liquor premises to the parking lot for this event. Staff is suggesting the following conditions on the permit; 1. Permit is valid only for the date of Saturday, September 23, 2017; and 2. Music shall stop at 11:00 p.m.; and 3. Event and associated liquor consumption shall remain within the fenced areas. The event will be host to alumni of Rosemount High School classes 1980 through 1989. The band that will be performing will be Radio Active. The event is expected to draw around 500 – 600 people. RECOMMENDATION Staff recommends approval of the above-stated motion. CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2017 - _____ A RESOLUTION AUTHORIZING AMERICAN LEGION TO HOST OUTDOOR MUSIC EVENT & APPROVING TEMPORARY LIQUOR LICENSE WHEREAS, Rosemount American Legion Post 65 submitted a request to host a band outside during the Rosemount High School Centennial celebration weekend, specifically on September 23rd; and WHEREAS, Rosemount American Legion has submitted an application for a Temporary On-Sale Liquor License that will expand their licensed premises to their parking lot; and WHEREAS, City Code 7-1-6 forbids the use of electronic sound systems / audio equipment in a manner in which it is plainly audible at a distance of fifty feet or more from the property line; and WHEREAS, City Code 7-1-6-D-1-a allows an exception when the sound is in connection with activities for which a permit has been granted by the city, subject to the terms of the permit. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Rosemount does hereby approve a 1 Day Temporary On-Sale Liquor License and authorize and permit Rosemount American Legion Post 65 to host outdoor music at their location at 14590 Burma Avenue, Rosemount, subject to the following conditions; 1) Permit is valid only for the date of Saturday, September 23, 2017; and 2) Music shall stop at 11:00 p.m.; and 3) Event and associated liquor consumption shall remain within the fenced areas.
