Regular Meeting Call to Order: Pursuant to due call and notice thereof, the Regular Meeting of the Planning Commission was held on Tuesday, September 26, 2017. Chair Kenninger called the meeting to order at 6:30 p.m. with Commissioners VanderWiel, Clements, and Freeman. Commissioner Mele was absent. Also in attendance were Community Development Director Lindquist, Senior Planner Klatt, Planner Nemcek, Engineer Hatcher and Recording Secretary Bodsberg. The Pledge of Allegiance was said. Additions to Agenda: None. Audience Input: None. Consent Agenda: a. Approval of the July 25, 2017 Regular Meeting Minutes. MOTION by Clements. Second by VanderWeil. Ayes: 4. Nays: 0. b. Approval of the September 12, 2017 Work Session Meeting Minutes. MOTION by Freeman. Second by Clements. Ayes: 4. Nays: 0. Public Hearing: 5.a. Request by Rosemount-Apple Valley-Eagan Public Schools Independent School District #196 for a Site Plan and Conditional Use Permit approval to allow parking, access and entrance improvements to the Rosemount High School, Middle School, and Elementary School campus. (17-35-SP & 17-36-CUP) Senior Planner Klatt gave a brief summary of the staff report for the Planning Commission. The public hearing opened at 7:01 pm. Public Comments: Scott McQueen, representing Independent School District #196, St. Paul, MN, stated that there are three key factors that went into their plan; safety and security, additional spaces for learning, and technology for learning. Mr. McQueen stated that the current site situations can get chaotic. The proposed changes can create dedicated locations for parents and busses to safely drop-off and pick-up students. All of the intersection traffic has been intensely studied. Commissioner Clements questioned where all of the reserved parking will be moved to. Mr. McQueen stated that they will be moved to the large parking lot out of the three parking lots created. They will be the closest parking to the buildings. Clements stated that the parking will be essentially pulled away from the front of the building. Mr. McQueen confirmed that is correct. Commissioner Clements questioned how the future housing will impact the schools. Mr. McQueen stated that most of the impacts are at the elementary level. The school district will be evaluating and they are seeing that less high school students are driving. Commissioner Clements questioned if the project will increase the amount of impervious surfaces within the project area. Mr. McQueen stated that the existing impervious coverage for the overall site is very close to the proposed coverage. Mr. McQueen stated that he doesn’t believe there will be a loss of parking. What parking spaces are lost in the lot they will be picked up on the street. Commissioner Freeman inquired if the updates at the high school will increase the security. Mr. McQueen stated that both entrances will be secured and all visitors will be routed to the office to get screened before they can move forward into the building. Freeman noted that Colorado Spruce trees are no longer recommended for the Minnesota climate. Commissioner Clements questioned if a roundabout is recommended Dave Lakey, 14701 Denmark Ct, Lakeville, stated that he is a representative from the Lighthouse Christian Church. Mr. Lakey stated that the church is in support of the new bus loop and MOTION by Clements to close the public hearing. Second by Freeman. Ayes: 4. Nays: 0. Motion Passes. The public hearing was closed at 7:29 pm. Additional Comments: Chair Kenninger stated that this is a great update to the schools and MOTION by VanderWeil to approve the site plan and building design review for Independent School District #196 to allow the reconfiguration and reconstruction of the parking and drop-off areas around the Rosemount High School, Middle School, and Elementary School campus and additions to the High School and Middle School buildings, subject to the following conditions: 1. Submission of a landscape security equal to one hundred and ten percent (110%) of the total cost of the plantings. 2. Installation of additional landscaping of sufficient quantity to provide a ninety percent (90%) opacity screen to a height of at least six feet (6’) from the residential properties west of the elementary and middle school bus loading area. 3. Inclusion of at least eight trees adjacent to or within the elementary and middle school bus loading area. 4. Reconfiguration of the intersection adjacent to the high school parent drop off area to reduce turning and pedestrian conflict points subject to review and approval of the City. Consider relocation of the nd driveway providing access to the east side of the high school away from 142 Street. 5. Submission of an agreement between the school district and the Lighthouse Christian Church concerning ownership and maintenance responsibility for the private road providing access to the elementary and middle school bus loading area prior to installation of the loading area. 6. Conformance with all conditions as outlined in the review memorandum from the City Engineer dated September 26, 2017. 7. Conformance with all conditions as outlined in the review memorandum from the Fire Marshall dated September 7, 2017. 8. Light fixtures within 100 feet of a residential property line shall be no higher than 20 feet. 9. Payment of any required sewer and connection charges due at the building additions as determined by the Metropolitan Council. 10. Upon completion of all improvements, the school district shall perform a follow-up traffic and intersection analysis in late 2018 or early 2019. The study should also include a safety analysis examining the crash rate and severity rate of accidents at intersections to determine if additional improvements are necessary. The School District will share in financial participation for modifications needed to address neighborhood and roadway impacts associated with the proposed 2017 site plan changes. 11. The School District will work with the City regarding future upgrades to Highway 3 relating to school entrance geometrics and safety. Second by Clements. Ayes: 4. Nays: 0. Motion Passes. PLANNING COMMISSION REGULAR MEETING MINUTES SEPTEMBER 26, 2017 PAGE 3 MOTION by Clements to approve a Conditional Use Permit to allow a small addition to the Rosemount Middle School facility, a reconfiguration of the parking area in front of the Middle School, and the construction of a new bus drop-off area west of the Rosemount Elementary School on property that is zoned R1A – Low Density Residential, subject to all conditions approved as part of the City’s site plan and building design review for the project. Second by Freeman. Ayes: 4. Nays: 0. Motion Passes. 5.b. Request by John Green Partnership, LLC. for a Site Plan Review and Conditional Use Permit for the Drive-Through to redevelop the existing Hong Kong Bistro site. (17-33-SP & 17-34-CUP) Planner Nemcek gave a brief summary of the staff report for the Planning Commission. Commissioner Clements inquired as to the amount of traffic to the parking lot. Clements questioned if the traffic has been looked into. Planner Nemcek stated that the use is not much different since the site has previously been a restaurant. Engineer Hatcher stated that they can look into it but that he doesn’t see it being an issue. Chair Kenninger questioned if Canada Ave will be changed to just turning right only onto County Road 42. Community Development Director stated that isn’t accurate. It’s something that can be looked into closer. Clements stated that it might not be an issue with parking but that the volume of vehicles moving through the parking lot. Commissioner Freeman questioned if there is outdoor space for the restaurant. Nemcek stated that is not currently the case. Chair Kenninger inquired if the brick can be changed and adding architectural stone to the building. Nemcek stated that is something The public hearing opened at 7:49 pm. Public Comments: Dennis Blau, 604 Wilson Ave, Menomonie, WI, stated that Mr. Nemcek covered all of the main points and that they have nothing further to add. th Roxanne Erhardt, 3270 Lower 150 St. W., stated that the additional restaurant building will add a lot of light to the area. Ms. Erhardt indicated that she can hear the ordering system at McDonald’s. Additionally, a light from the Arby’s/Chipotle shines in her backyard. MOTION by Clements to close the public hearing. Second by Freeman. Ayes: 4. Nays: 0. Motion Passes. The public hearing was closed at 7:52 pm. Additional Comments: Chair Kenninger questioned if the drive-through could be redesigned so that the noise would not have an impact on the neighborhood. Planner Nemcek stated that there will be three tenants in the building and that redesigning the layout would be difficult for getting the other tenants in and out of the site. Commissioner Clements questioned if there are any restrictions on the Chipotle sign. Planner Nemcek stated that that sign was approved before his time but that he can look into it. Community Development Director Lindquist confirmed that they will look into the positioning of the light and speaker. PLANNING COMMISSION REGULAR MEETING MINUTES SEPTEMBER 26, 2017 PAGE 4 MOTION by VanderWeil to approve the Site Plan for John Green Partnership, LLC., subject to the following conditions: 1. Selection and placement of the rooftop mechanical equipment so that the parapet wall shields the equipment from public view. 2. Site photometrics shall be provided prior to building permit approval to ensure compliance with Code requirements. 3. Lighting fixture cut sheets shall be provided to ensure that are a cut-off style of lighting. 4. Non-essential lighting shall be turned off after business hours. 5. Additional architectural elements should be added to the north-facing façade to increase visual interest along County Road 42. Modifying condition 5 to add western-facing façade to increase visual interest along County Road 42. Second by Clements. Ayes: 4. Nays: 0. Motion Passes. MOTION by VanderWeil to recommend that the City Council approve the Conditional Use Permit for the Drive-Through Facility for John Green Partnership, LLC., subject to the following conditions: 1. Public address systems and ordering speakers shall not be audible at the property lines. 2. The text on the menu board shall not be so large as to be visible from the public right-of-way or as to serve as off-site advertising. 3. Size and design of menu boards shall conform with condition seven (7) of the drive through facility conditional use permit standards. Second by Clements. Ayes: 4. Nays: 0. Motion Passes. New Business: Community Development Director Lindquist stated that the Comp plan will be going to the Council at their Work Session on October 9, 2017 at 6:30 p.m. at the Steeple Center. Reports: Senior Planner Klatt stated that himself and Anthony will be attending the State Planner’s Conference in Mankato this week. Discussion: None.
