RECOMMENDED ACTION: Motion to Adopt a Resolution accepting a Minnesota
Department of Health Grant and entering into an Agreement for Well 1 & 2 Sealing, City
Project 2018-04.
BACKGROUND
Staff has pursued previous grant applications in an effort to protect the existing aquifers that supply the
City of Rosemount with safe, clean water. On October 16, 2017 two Public Well Sealing Grant
applications (grant) were submitted to the Minnesota Department of Health (MDH) for sealing wells 1 and
2 located in the downtown area of Rosemount. On November 3, 2017 staff was notified that a grant had
been awarded in an amount not to exceed $50,000.
In order to receive this grant the City of Rosemount is required to enter into a contractual agreement with
the MDH. The agreement lays out the terms and conditions for reimbursement of the costs incurred in
completing this work. The City Attorney has reviewed this agreement and provided comments regarding
two areas of possible concern. Staff has discussed them with the MDH and recommends that the
agreement be accepted. The items in question were:
1. Paragraph 2.K. The City would be required to pay a contractor within 10 days of receiving
payment from the MDH. The invoices will be submitted to MDH after the City pays the
contractor, thus this paragraph will not apply.
2. Paragraph 12. The MDH owns all rights to items created by the City; however, the only items
anticipated are design materials for the well sealing contractors. Additionally, the indemnification
section is very broad regarding intellectual property rights. Again this is not anticipated to cause
any issues with the work being performed.
This work has been included in the 2018 Capital Improvement Plan with $150,000 to come from the
Water Utility Fund. The estimated cost for the actual sealing work is $119,975. An additional 20%
($23,995) is estimated for engineering and overhead, for a total estimated cost of $143,970.
SUMMARY
Staff recommends Council accept the Minnesota Department of Health Public Well Sealing Grant for
Wells 1 & 2 and authorize entering into the attached agreement for this work.

RESOLUTION 2017 –
A RESOLUTION ACCEPTING A MINNESOTA DEPARTMENT OF HEALTH GRANT
AND AUTHORIZING ENTERING INTO AN AGREEMENT FOR WELL 1 AND 2
SEALING CITY PROJECT 2018-04
WHEREAS, the City of Rosemount desires to protect the existing ground water aquifers; and,
WHEREAS, the City of Rosemount submitted a Public Well Sealing Grant application (grant) to
the Minnesota Department of Health for sealing Well 1 and Well 2; and,
WHEREAS, the Minnesota Department of Health accepted the grant and awarded an amount not
to exceed $50,000 for the sealing of Well 1 and Well 2; and,
WHEREAS, the Minnesota Department of Health requires a contractual agreement with the City
of Rosemount in order to use the funding for this work; and,
WHEREAS, the City of Rosemount has included the sealing of Well 1 and Well 2 in the 2018
Capital Improvement Plan with funding from the Water Utility Fund in an amount of $150,000.
NOW THEREFORE BE IT RESOLVED, by the City Council of the City of Rosemount,
Minnesota:
1. The City of Rosemount accepts the Minnesota Department of Health Public Well Sealing Grant
in an amount not to exceed $50,000.
2. The City of Rosemount agrees to enter into the agreement provided by the Minnesota
Department of Health.
3. The Mayor and Clerk are hereby authorized and directed to enter into said agreement for the
sealing of Well 1 and Well 2 for and on behalf of the City of Rosemount.
