RECOMMENDED ACTION: Motion to Approve Resolution amending the 2030
Rosemount Comprehensive Plan to change the future land use designation of the Canada
Circle properties from RC-Regional Commercial to BP-Business Park.
SUMMARY
The City Council is being asked to approve a Comprehensive Guide Plan Amendment to facilitate future
development of the subject parcel. Generally, staff does not encourage processing Comprehensive Plan
Amendments separate from a specific project coming before the City. In other words, the City typically
provides the appropriate land use designation and rezoning at the time of project site plan approval.
However, due to the required Comprehensive Plan Updates required by the end of 2018 to the
Metropolitan Council, the Met Council has indicated they would not accept any Comprehensive Plan
Amendments after July 1, 2018. This timeline could mean that projects would not get approval for 6 to 9
months, which is not desirable from the City’s standpoint. Several properties are being brought before the
Council for reguiding now, with the intention that the project and necessary rezoning would be brought to
the City for further review and approval when necessary. The proposed action will allow the City to move
projects forward when they are ready without an arbitrary delay in processing.
Several communities have contacted the Metropolitan Council about the July 1, 2018 deadline, indicating
this could have a detrimental effect on city development. They are taking testimony about the issue and
there is some indication that the policy might be modified. However, staff would prefer moving forward
on the reguiding now, in the event that no policy change is made. As the Council may be aware, after the
City approves the amendment, surrounding governmental agencies have 60 days to comment and then the
application is forwarded to the Metropolitan Council for approval. A comprehensive plan amendment
cannot be put into effect until the Metropolitan Council grants approval.
PLANNING COMMISSION
The Planning Commission reviewed this item at their public hearing held on April 10, 2018. No public
spoke during the meeting. Staff explained the process that the Port Authority has gone through regarding
disposition of some of the property for private development, and explained what the future owner is
proposing on the site. It was acknowledged that additional approvals will be brought before the
Commission to permit development of the site. The Commission unanimously recommended approval of
the Comprehensive Plan Amendment.

BACKGROUND

Existing Zoning: Institutional and Business Park

The project area is a combination of land owned by the City and the City’s Port Authority. The most
western portion of the site is known as the old Rosemount dump site and is currently used as a Public
Works storage yard. The remainder of the property was obtained by the City in anticipation of future
development. The intention was to permit businesses displaced through Downtown redevelopment to
relocate to the property. The site is comprised of differing parcels, many of which are excess right-of-way
created when Hwy 3 was relocated. The Port Authority has been negotiating a purchase agreement for a
future user for approximately 4 acres of the site; the action is scheduled for the April 17, 2018, meeting.
After that time, the builder will come through the planning review and approval process for a light
industrial type building. A plat will also be processed at that time. The remainder of the property, not sold
for development, will be retained by the City.
The Council is being asked to reguide the entire site to Business Park. This land use designation is most
consistent with the intended use of the future purchaser. Any rezoning, site plan and platting will come
before the Council prior to project approval. As stated previously, the reguiding is being processed
separately to meet the deadline imposed by the Metropolitan Council. Waiting on the Amendment will
negatively impact the future purchaser’s timeline and would be detrimental to the property sale.
COMPREHENSIVE PLAN AMENDMENT
The City of Rosemount is processing a reguiding of the site to Business Park consistent with the intended
use of the future buyer. Business Park is consistent with a portion of the existing zoning, excepting the
portion that will remain in city ownership. The current land use designation is commercial and the Port
Authority had also discussed commercial development on the site. The future use, a combination of
assembly, retail and potentially indoor recreation, is more consistent with Business Park uses. However,
the uses would certainly complement any future commercial development in the area.
CONCLUSION AND RECOMMENDATION
Additional approvals including platting will be brought before the Commission and Council later this
summer to facilitate development of the site. As such, staff recommends the City Council approve the
resolution as presented.

A RESOLUTION APPROVING THE COMPREHENSIVE
PLAN AMENDMENT TO CHANGE THE FUTURE LAND USE OF THE SITE FROM
RC- REGIONAL COMMERCIAL TO BP-BUSINESS PARK.
WHEREAS, the City of Rosemount is requesting a Comprehensive Plan Amendment concerning
properties located at follows:
North of Canada Circle and West of South Robert Trail
WHEREAS, on April 10, 2018, the Planning Commission of the City of Rosemount held a public
hearing and reviewed the Comprehensive Plan amendment changing the land use of the site from RC-
Regional Commercial to BP-Business Park; and
WHEREAS, on April 10, 2018, the Planning Commission recommended that the City Council adopt
an Amendment to the Comprehensive Plan; and
WHEREAS, on April 16, 2018, the City Council of the City of Rosemount reviewed the Planning
Commission’s recommendations; and.
NOW, THEREFORE, BE IT RESOLVED, the Council of the City of Rosemount hereby
approves an Amendment to the Comprehensive Plan to change the land use of the site from RC-
Regional Commercial to BP-Business Park, subject to the approval of the Comprehensive Plan
Amendment by the Metropolitan Council.
ADOPTED this 16th day of April, 2018, by the City Council of the City of Rosemount.
