ATTACHMENTS: Proposed Amendment Number 2 to the Amended and Restated Ballfield Use Agreement - DCTC APPROVED BY: LJM RECOMMENDED ACTION: Motion to approve the Amendment Number 2 to the Amended and Restated Ballfield Use Agreement with Dakota County Technical College (DCTC). ISSUE City staff recently met with representatives from Dakota County Technical College (DCTC) and Minnesota State College and Universities (MNSCU) to discuss the dugout project at the UMore Ballfield site. In 2017, DCTC requested that concrete block dugouts and a large concrete bleacher pad be added to the north field they use at the complex. DCTC offered to pay for all design and improvement costs. To initially move the project forward, the City and DCTC agreed to amend the most recent amendment to our original Ballfield Use Agreement. DCTC and MNSCU have recently asked for an additional amendment to the most recent agreement. The main reason for the request is that the amendment from December 2017 stated that DCTC would pay for all costs of the project prior to any work being done. MNSCU has stated that this does not follow MNSCU purchasing protocol and that they need to reimburse the City for the project rather than pay up front. City staff discussed the requested amendment with the City Attorney and she does not see any issues with the amendment. BACKGROUND The City of Rosemount owns two softball/baseball fields that were constructed just south of the Ames Soccer Complex. The land was pre-dedicated to the City of Rosemount by the University of Minnesota. The two fields were built to accommodate youth/high school and collegiate fast pitch softball and youth baseball. In 2012, the City agreed to allow DCTC to use one of the fields for their women’s fast pitch softball program. In 2014, the City and DCTC amended the agreement to allow for the college to make some improvements to the field they use that included chain link fenced dugout improvements, baseline fencing, bullpens, a storage shed and signage. In 2017, DCTC requested that additional improvements be made to one of the fields at the complex. The college requested that concrete block dugouts and a large concrete bleacher pad be added to the north field they use at the complex. The City Attorney’s office created a new amendment to the 2014 Amended and Restated Ballfield Use Agreement that would allow for the City and our consultants to design the 2 requested improvements and for DCTC to pay the City for the cost of the design and the cost of the construction of the improvements if they are made. The agreement would be in place for 10 years and the improvements would be available to all park users. RECOMMENDATION Staff is recommending the City Council approve the attached 2018 Amendment to the Amended and Restated Ballfield Use Agreement with Dakota County Technical College.
