RECOMMENDED ACTION: Motion to approve the attached donation agreement with Flint
Hills Resources to accept a donation of 140 tons of oil to be used in the mixing of the
asphalt for the trails, parking lot and access driveway at the Flint Hills Resources Athletic
Complex.
ISSUE
The second phase of improvements is currently under construction at the Flint Hills Athletic Complex. As
you may recall, the improvements are to include four new green fields, sun shelter, trails, parking lot,
access driveway, and landscaping.
City staff has been working to get donations to help reduce the cost of the project.
As with the first phase of the project, Flint Hills Resources has offered to again donate the necessary oil
needed to make the asphalt for the trails, parking lot and access driveway. The amount of oil needed for
the project is 140 tons. The estimated value of the oil is approximately $63,000. That number does not
include the mark up that we would typically see from a contractor. The City greatly appreciates this
generous donation from Flint Hills Resources.
RECOMMENDATION
Staff is recommending that the City Council approve the attached donation agreement with Flint Hills
Resources to accept a donation of 140 tons of oil to be used in the mixing of the asphalt for the trails,
parking lot and access driveway at the Flint Hills Resources Athletic Complex.

DONATION AGREEMENT
This Agreement is made as of the ___ day of ______________, 2018, by and between
the City of Rosemount, Minnesota, a Minnesota municipal corporation (the “City”), and Flint
Hills Resources, Pine Bend, LLC, a Minnesota limited liability company (the “Supplier”).
WHEREAS, Supplier has offered to donate and the City has agreed to accept oil to be
used for bituminous mix for parking lot, access driveway and trails at the Flint Hills Athletic
Complex, on the terms and conditions hereinafter set forth.
NOW, THEREFORE, the Owner and Supplier agree as follows:
1. Supplier will provide oil for use in bituminous mix for the parking lot, trails and access road at the
Flint Hills athletic complex at no cost to the City.
2. The quantity of oil to be supplied will be approximately 140 tons.
3. The type of oil will be either a PG 58-28 or PG 64-22 as specified by the City Engineer.
4. The City will arrange for pickup of oil from the Pine Bend Refinery at a location specified by
Supplier. The delivered oil shall be at no cost to the City.
5. The Supplier will provide the oil no later than October 1, 2018.
6. The Supplier designates that the person to be contacted to coordinate pickup and delivery of the oil
