SUMMARY The City Council is being asked to approve a minor modification to the recently approved simple plat for Canada Circle. Because the plat has yet to be recorded and the change is very minor in scale, staff is seeking formal approval by the City without scheduling another public hearing. The plat continues to be in substantial compliance with the previous review. The proposed modification does not change the exterior boundaries of the plat, and would shift approximately ¼ acre between Lot 1 and Lot 2. The City is currently processing an application for development of Lot 1 by Custom Apparel, Inc. (CA Gear), and will retain Lot 2 as a buffer between the private development site and the City storage and staging area to the west. The City is currently working with the MPCA to address environmental issues associated with the former use of the property adjacent to the CA Gear site. As part of this review, staff has determined that it would be beneficial to make a small modification to the recently approved plat for the site to keep all buildable portions of the subdivision off of the former gas station site (which was demolished prior to an earlier realignment of TH3 by MnDOT). The proposed revision would shift a small portion of the northern boundary between Lot 1 (CA Gear Parcel) and Lot 2 (retained by the City) a little further to the south to line up with the previous MnDOT right-of-way line. This action would reduce the size of the CA Gear parcel by roughly ¼ acre, and would not create any zoning compliance issues for this project. Because the proposed revision does not substantially alter the approved plat or the buildable portion of the site in any manner, staff is recommending that the change be approved by the City Council via the attached resolution. A depiction of the proposed plat amendment is attached to this report. CONCLUSION & RECOMMENDATION Staff recommends that the City Council approve the minor modification to the approved, but not yet recorded, plat for Canada Circle to shift the northern property boundary between Lot 1 (CA Gear) and Lot 2 (City) slightly further to the southeast. A resolution approving the amended simple plat is provided. CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2018- A RESOLUTION AMENDING THE APPROVAL OF A SIMPLE PLAT FOR CANADA CIRCLE WHEREAS, the Planning Department received an application for approval of a Simple Plat for Canada Circle to combine several lots into two parcels for property legally described as follows: Parcels 2, 3, 4, 5A, 7A, and 11, as depicted in DAKOTA COUNTY RIGHT OF WAY MAP NO. 258, being located in the North ½ of the Southwest ¼ of Section 32, Township 115, Range 19, Dakota County, Minnesota. WHEREAS, on April 24, 2018, the Planning Commission of the City of Rosemount conducted a public hearing as required by ordinance for the purpose of receiving public comment regarding the proposed Canada Circle Simple Plat; and, WHEREAS, on April 24, 2018, the Planning Commission reviewed and recommended approval of the application and found it consistent with the criteria for simple plat review outlined in the Subdivision Ordinance; and, WHEREAS, on May 15, 2018, the City Council of the City of Rosemount reviewed the application and agreed with the staff recommendation; WHEREAS, on July 17, 2018, the City Council of the City of Rosemount amended the prior approved Simple Plat for Canada Circle by shifting one lot line; NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of Rosemount does hereby approve the Canada Circle Simple Plat without conditions.
