BACKGROUND Ron Clark Construction has requested the vacation of two easements on the property. The first easement is the right of way easement over the former alignment of Chippendale Avenue. The second easement is a former drainage and utility easement that covered the location of the water main connection along the original alignment of Chippendale Avenue. The Assistant City Engineer has reviewed the vacation requests and has included conditions in the Engineer’s Memo dated July 11, 2018. The conditions are part of the approval of the Wexford project. Standard perimeter drainage and utility easements are shown on the final plat and will be recorded with the County. RECOMMENDATION Staff is recommending the Council adopt a resolution approving the easement vacation based on the information provided by the applicant and reviewed in this report. The vacation request has been published and proper notification conducted. CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2018- A RESOLUTION APPROVING THE VACATION OF A DRAINAGE AND UTILITY EASEMENT AND A ROAD EASEMENT WHEREAS, the City of Rosemount received an application from Ron Clark Construction, 7500 West 78th Street, Edina, MN (Applicant) for the Final Plat of Wexford Place; WHEREAS, on July 17, 2018, the City of Rosemount City Council reviewed and approved the Final Plat for Wexford Place; and WHEREAS, the vacation of the existing drainage and utility easements and road easement legally described below is required before the Final Plat can be recorded for Wexford Place; and WHEREAS, the City Council reviewed this request and conducted a public hearing on July 17, 2018. NOW, THEREFORE, BE IT RESOLVED, the Council of the City of Rosemount hereby approves the Vacation of the Drainage and Utility Easement, legally described as: That part of the Southeast Quarter of the Southeast Quarter of Section 31, Township 115, Range 19, Dakota County, Minnesota described as follows: The North 55.00 feet of the South 320.00 feet of the West 47.00 feet of the East 80.00 feet thereof. And, The Council of the City of Rosemount hereby approves the Vacation of the Road Easement, legally described as: All that part of Chippendale Avenue bounded on the south by easterly extension of the southerly line of Outlot D, GERONIME POND; bounded on the west by the east line of said Outlot D; bounded on the north by the easterly extension of the northerly line of said Outlot D; and bounded on the east by the east line of the Southeast Quarter of the Southeast Quarter of Section 31, Township 115, Range 19, Dakota County, Minnesota. Subject to the following conditions: 1. Recording of the Final Plat of Wexford Place. 2. Compliance with all conditions detailed in the Engineer’s Memorandum dated July 10, 2018.
