ATTACHMENTS: None APPROVED BY: LJM RECOMMENDED ACTION: Motion Authorizing the Amending of a Joint Powers Agreement between Dakota County and the City of Rosemount to Improve Intersections at CSAH 42/TH 55, City Project 2017-04 BACKGROUND On September 5, 2017 the City Council approved a Joint Powers Agreement (JPA) for Engineering, Right- of-Way Acquisition and Construction between the County of Dakota and the City of Rosemount for improvements to the intersection of CSAH 42 and TH 55, including widening the road to add a left turn lane for CSAH 42 and Fahey Ave, and painted median west of the CSAH42/TH 55 intersection, all in an effort to improve traffic safety in this area. SUMMARY Since the execution of the JPA, Dakota County has retained an engineer, completed a design and solicited bids for the completion of this project. During this process several items in the project resulted in additional costs. Those items are explained below: 1. Design a. Additional design work was required due to stormwater and private utility needs. b. Additional traffic management and traffic control plans were required based on the concerns that resulted during county maintenance projects earlier this year. 2. Right of Way Acquisition a. Costs were less than anticipated. 3. Construction a. Addition of a temporary traffic signal as part of this project due to the earlier concerns. b. Addition of a guard rail along a portion of the project. This was added as a result of the significant cost to relocate Xcel transmission lines. c. Addition of infiltration basins along the road right of way to address stormwater ponding requirements. As a result of the above items the City of Rosemount share will increase. The following table details the updated total project costs. It should be noted that Dakota County will also institute their new cost share policy with the forthcoming amendment. This will limit the city share to a maximum of 15% of the total project cost. It should also be noted that Dakota County has obtained $593,000 in other funding which is applied to the costs prior to calculating the cost share. 2 The City of Rosemount Capital Improvement Plan (CIP) funding for this project is in the amount of $112,000. As a result, an additional $105,798 is required to complete this project. All funding for this will come from the Municipal State Aid allocation. This additional funding will not have an impact on future planned projects. Prior to obtaining any City signatures on the amendment, staff will coordinate review with and approval by the City Attorney. SUMMARY Staff recommends City Council approval of the JPA amendment and authorization its execution.
