Motion to Adopt a Resolution Approving the Land Surveyor’s Certificate of Plat
Correction for Bella Vista 5th Addition.
Motion to Authorize the Mayor and City Clerk to sign the Land Surveyor’s Certificate
of Plat Correction for Bella Vista 5th Addition.
SUMMARY
The City Council is being asked to consider a request to correct the final plat for Bella Vista 5th
Addition. Westwood Professional Services, Inc., the firm who provided the survey services for
Lennar Corporation for the Bella Vista 5th Addition plat, has discovered an error in the plat
previously approved by the City. State Statute allows surveyors to file a Surveyor’s Certificate of Plat
Correction to fix errors and the Dakota County rules governing plat recording requires that the City
approve any plat correction before it is recorded. Westwood requests that the City approve the plat
correction and that the Mayor and City Clerk sign the Surveyor’s Certificate of Plat Correction so
that it can be recorded at the County.
ISSUE
Westwood was hired as the surveyor for Bella Vista 5th Addition plat, which created 42 single-family
lots within the larger Bella Vista development area. The same surveyor has been preparing the plat for
Bella Vista 6th Addition, a portion of which will replat the larger outlot area within the 5th Addition.
During the preparation of the Bella Vista 6th plat, the surveyor noticed an error in the underlying plat
for the 5th Addition along one of the outlot boundaries. Specifically, a small curve dimension is
missing along the boundary of Outlot A adjacent to Autumn Path. The proposed plat correction will
add an additional 4.08-foot curve dimension to this line. The actual boundary as drawn on the plat
will not change.

To fix this error, Westwood has prepared a Surveyor’s Certificate of Plat Correction per the provisions
within State Statute. Dakota County’s rules regarding plat recording requires that the City approve the
plat correction and authorize the Mayor and City Clerk to sign the Surveyor’s Certificate of Plat
Correction. Due to minor nature of the error and that the error and correction do not alter the area of
any existing parcel or the width of the adjacent right-of-way, staff recommends that the City Council
approve the Surveyor’s Certificate of Plat Correction.
RECOMMENDATION
Staff recommends that the City Council adopt the resolution approving the plat correction and
authorize the Mayor and City Clerk to sign the Surveyor’s Certificate of Plat Correction.

A RESOLUTION APPROVING THE LAND SURVEYOR’S CERTIFICATE OF PLAT
CORRECTION FOR BELLA VISTA 5TH ADDITION
WHEREAS, the Community Development Department of the City of Rosemount received an
application from Westwood Professional Services, Inc. (Westwood) requesting a plat correction
concerning the boundary of the property legally described Outlot A, Bella Vista 5th Addition, Dakota
County, Minnesota; and
WHEREAS, Westwood prepared Bella Vista 5th Addition dated April 11, 2017, and filed on May 5,
2017; and
WHEREAS, Craig Morse, surveyor for Westwood, has discovered an error in the plat, and specifically
that there is a 4.08 foot curve dimension missing along the southeasterly line of Outlot A, adjacent to
Autumn Path and has prepared a Land Surveyor’s Certificate of Plat Correction to resolve the error;
and
WHEREAS, staff finds the proposed plat correction is minor in nature and does not affect any public
property nor the function or code compliance of the Bella Vista neighborhood, and
WHEREAS, on September 18, 2018, the City Council of the City of Rosemount reviewed the
application and staff’s recommendation.
NOW, THEREFORE, BE IT RESOLVED, the Council of the City of Rosemount hereby
approves the Land Surveyor’s Certificate of Plat Correction for Bella Vista 5th Addition.
ADOPTED this 18th day of September, 2018, by the City Council of the City of Rosemount.
