Guide Plan Land Use Desig.: General Industrial Current Zoning: General Industrial SUMMARY Spectro Alloys is located on Doyle Path, north of Th 55 in the General Industrial (IG) District. The City has received a request for building permits needed for small structures that will be located on the site. The structures are in required setback areas resulting in a variance request. The three structures that require building permits include a 14' x 17' control shed, a 23' x 10' bag house and a 30' x 37' concrete "pit The combined areas of the structures are less than ten percent of the overall building and would be exempt from the public site plan review process in accordance with the "fast -track ordinance However, all three proposed structures encroach within the fifty foot side yard setback required in the IG District as well as a portion of the forty foot bluff line setback required in the Mississippi River Critical Corridor overlay district (MRCC). The proposed structures support material handling equipment that sorts and places scrap aluminum in six outdoor bins. The plant has been in operation for some 25 years and as much as 40 feet of the eastern side of the main plant is encroaching within the side yard setback. This side yard is adjacent to a rail spur which has previously been used for shipping of material. The project drawings include a design for bringing an additional rail spur directly onto the property to a loading dock for direct use. This relationship provides the basis for a Staff recommendation in favor of granting the variances. DNR COMMENTS Mr. Pat Lynch of the Department of Natural Resources has reviewed the Spectro Allows site and has indicated that DNR is not opposed to the request. Mr. Lynch acknowledges that the site is generally a pre- existing situation with the building permit request creating some opportunity to require that the site be cleaned up. The questions resulting from the review are: 1.What is the height of the proposed buildings or structures? The highest platform indicated on the elevation provided by Spectro Alloys is 68 feet. The maximum height in the general industrial District is 75 feet with allowances for an additional 25 feet for `mechanical appurtenances': 2.Is the onsite septic system up to current standards? The new Individual Sewage Treatment Systems ordinance (ISTS) requires inspections and periodic improvements for conformance with current requirements. 3.Is there a storm water management or erosion control plan? The variances can be conditioned on approval of an erosion control plan by the Public Works Department. 4.Is landscaping proposed in the bluff line setback between the bluff and the buildings structures? No Landscaping is proposed other than along the Th 55 right -of -way. The cross sections prepared by RLK associates indicates that Spectro Alloys Corp. Is not visible from the Mississippi River Corridor. RECOMMENDED ACTION: THE BOARD OF APPEALS AND ADJUSTMENTS Motion to grant the variances to yard and bluff line setbacks as requested by Spectro Alloys Corporation in accordance with the attached findings as required in Section 15.2 of the Zoning Ordinance; and, THE PLANNING COMMISSION Motion to approve the site plan for Spectro Alloys Corp. Subject to: 1) granting of yard and bluff line setback variances as required; 2) provision of landscaping as specified in the RLK drawing in section 6 of the project update II booklet with the plantings and berming occurring outside of the Th 55 right -of -way; 3) approval of the Minnesota Department of Natural Resources as required; 4) approval of an erosion control plan by the Department of Public Works; 5) approval of the Minnesota Department of Transportation as required; and, 6) conformance with all applicable building and fire codes. PLANNING COMMISSION ACTION: FINDINGS FOR SPECTRO ALLOYS CORP. The Board of Appeals and Adjustments and the City Council, upon appeal, must find as follows in the granting of a variance from this ordinance: 1.Granting a variance will not adversely affect the public health, welfare and safety and will not be detrimental or injurious to property or improvements in the neighborhood. No information has been provided or received the would suggest that the variance would adversely affect the public health, welfare and safety. The railroad right -of -way separates the variance area from adjacent properties by an additional 100 feet. The material handling equipment is purposely being located to allow passage of emergency vehicles through the site in this specific location. 2.Strict interpretation or enforcement would result in a practical difficulty or unnecessary hardship inconsistent with the intent of this Ordinance and the Comprehensive Guide Plan. The proposed improvements enhance efficiency and safety and will aid the applicant in cleaning up the site, thereby reducing potential enforcement issues. 3.There are exceptional or extraordinary circumstances or conditions applicable to the property, use or facilities that do not apply generally to other properties in the same district. There is a definite mutual relationship between the industrial use and the adjacent rail spur. The proximity of rail and rail access potential with shipping opportunities enhances the industrial use while providing additional separation from neighboring properties by the addition of the rail road right -of -way width of 100 feet. 4.Strict or literal interpretation would deprive the applicant of the use and enjoyment of his property in a manner similar to other owners in the same district. C.F. Industries, Continental Nitrogen, Dixie Petrol Chemical and Koch Refining Company all have direct rail access to their properties. 5.Granting of the variance will not allow a use which is otherwise not a permitted use in the zoning district in question. Spectro Alloys Corp. recycles and processes aluminum ingots from scrap materials and as such is a permitted use in the General Industrial District.
