This completes the process for approval of the installation of a transmission line from Dodd Blvd. And County Road 38 (McAndrews Road) to Eagan in the STH 3 right of way. Please be advised, permits are required for driveways and work in public rights -of -way. Contact Doug Litterer at 322 -2062 if you have questions concerning this issue. The proposed essential service ordinance would require us to apply for a conditional use permit. As a result, our project maybe subject to changes and delays. While we did not have a formal municipal process to follow, we did notify municipal officials, adjacent landowners, and governmental agencies that can regulate the project. We notified landowners by mail and held a public information meeting on May 21, 1997. City Council members were invited to attend. We were glad that the Mayor participated in the public information meeting Due to the lead times necessary for final design, acquisition of private right of -way, and delivery of materials; we are not scheduled to begin physical construction until September. I have enclosed some material that shows how we notified the applicable local, state and federal agencies. We ask that you consider the time, efforts, and care that Cooperative Power and Dakota Electric have made to keep everyone informed of the project and hope you will consider the following request. We request that the staff recommend to the City Council that they take action to exempt the project should they move to approve the proposed ordinance. Or the ordinance could take effect after our project is completed. If this is not an option and our project is to be bound by a conditional use permit, I can assure you we will respect that process should it be necessary. Here we are asking for a 25 foot easement just north of the existing 50 feet road right -of -way. The location of the line is 55 feet from the centerline of the highway and there are no guys or anchors. The balance of the transmission line is to be built within road right -of -way.
