Dear Pat: The enclosed information is being sent to you for your review in connection with a pending application for site plan review requested by Spectro Alloys Corporation, 13220 Doyle Path in Rosemount, Mn. The site is located within the Urban Diversified District of the Mississippi River Critical Area. The zoning of the property is General Industrial. The Planning Department has yet to receive a formal application. However, I am sending the attached information in light of the thirty day review period specified by Sandra Fecht. I have added topography and plat information hoping that sufficient information will be available to initiate your review. It is my understanding that the project consists of primarily material handling equipment. A very small building of less than 200 sq. ft. and a recessed concrete "pit" for the equipment are the only structures that require a building permit from Rosemount. The material will be deposited in six existing bins which are located near the railroad right -of -way. A public hearing will be scheduled upon receipt of the application. The earliest possible hearing date would be April 8, 1997 at 7:00 pm. In the Council Chambers at City Hall in Rosemount. This date will be confirmed and any additional information will be forwarded as soon as it becomes available. Please contact me with your questions at 322 -2052. Receive Petition /Set Public Hearing Doyle Path Right -of -Way Vacation I have received a petition from property owners along Doyle Path to vacate a portion of Doyle Path as shown on the attached sketch. Basically, the vacated portion amounts to the right -of -way adjacent to the Spectro Alloy Corporation. The petition and legal description appear to be in order for Council to .set a Public Hearing date to consider this vacation request. The Public Notice must be published and posted for two weeks, which would mean that September 1, 1987 would be the earliest date for a Public Hearing. We do have four (4) assessment hearings scheduled that same evening, however, three (3) of the hearings are Developer related and should not take alot of time. Likewise, this Public Hearing should not take alot of time because all parties are in agreement with the vacation. The only possible issue would be if any utilities are located within the right -of -way that would require special easements. MEMO****** DATE: AUGUST 27, 1987 TO: MAYOR CITY COUNCIL c/o CITY ADMINISTRATOR JILK FROM: CITY ENGINEER HEFTI (a RE: ITEMS FOR THE SEPTEMBER 1, 1987 COUNCIL MEETING PUBLIC HEARING Doyle Path Street Vacation Council set the public hearing for 8:00 p. m. on September 1, 1987 after receiving the petition from the property owners at their August 4, 1987 Council meeting. Staff published the vacation notice in the official legal newspaper and mailed out notices to the effected parties and effected utilities. To date, I have received a response from Peoples Natural Gas that they have no problem with the street vacation. As part of the condition of street vacation I am requiring that the additional right -of -way that needs to be dedicated because of the new cul -de -sac be included in an easement and dedicated to the City prior to vacation of the right -of -way. I have not received this easement yet. Also the Staff is requiring that the petitioners pave the unpaved portion of Doyle Path and the newly created cul -de -sac to City Standards. Therefore, I am recommending that Council approve the vacation request for Doyle Path as indicated in the legal description stated in the public notice subject to the completion of the paving of the unpaved portion of Doyle Path and to the receipt of the fully executed easement for the right -of -way necessary resulting from the new cul -de -sac. 4 e 2875 145TH ST W osern ou n i ROSEMOUNT. First Addition, according to the recorded plat thereof, Dakota County, Minnesota, lying southeasterly of a circle having a radius of 83.00 feet, the center of said circle being the point of intersection of the centerline of Doyle Path and the northeasterly extension of a line parallel with and distant 83.66 feet (measured at a right angle) southeasterly of the northwesterly line of Lot 4, Block 2, said addition. Box 510 Rosemount, MN 55068 -0510 Dear Andrew Mack: SUBJECT: Spectro Alloys Addition Preliminary Plat Review P96 -030 North Side of TH 55 at Doyle Path Rosemount, Dakota County CS 1910 The Minnesota Department of Transportation (Mn/DOT) has reviewed the Spectro Alloys Addition preliminary plat in compliance with Minnesota Statute 505.03, subd. 2, Plats. We find the plat acceptable for further development with consideration of the following comments. The property boundaries shown on the submitted plat document are consistent with our records of Mn/DOT right of way and are acceptable as shown. Any questions may be directed to Keith Kallin of our Surveys Section at 779 -5009. We strongly recommend that the eastern Doyle Path access to Trunk Highway (TH) 55 be closed in conjunction with the vacation of this portion of Doyle Path. If this access remains open, it will be utilized as a private driveway for Spectro Alloys. Regional policy discourages direct access to arterials from private properties. Appropriate connectors to minor arterials such as TH 55 include collector streets, other arterial roadways, and some local streets. Private driveway access should essentially be prohibited, as it is more efficiently and safely accommodated via the local street network. We request that the city include closure of this access as a condition of the plat. If this access is not closed, we remind Spectro Alloys of certain conditions regarding its use. If Spectro Alloys expands its operations for example, by developing its property on the west side of vacated Doyle Path a new highway access permit will be required for the driveway. Expansion, or any other change in the type or intensity of the land use, requires a new access permit and may require construction of turn lanes on TH 55 at the driveway.
