SUMMARY Property Owner and Applicant: Mark Elliot Homes Site Area in Acres: .38 Acres Current Zoning: R2 PUD-Moderate Density Residential Planned Unit Development Land Use Designation: MDR-Medium Density Residential The applicant is requesting a lot split to facilitate the recording of the common interest community at Dakota County prior to the sale of the row-style townhomes that have been built on the site. The original plat had anticipated a single building encompassing the six units. More recently, the applicant amended the PUD resulting in the units being constructed as two separate buildings. The County is requiring the lot split before they will recognize the separate buildings and individual units. The ordinance allows approval of a simple lot split by the City Council without benefit of Planning Commission or a public hearing. Staff is recommending approval of the request. BACKGROUND The subject property was platted in 2005 by Dean Johnson Homes as a common interest community. Each building was contained within individual parcels while the streets, yards, and other common areas in common ownership parcels. In 2010, Dean Johnson Homes lost the development to the finance company that was securing the development. The current applicant, Mark Elliot Homes, took over development of the remainder of the project, and Council granted approval of a new preliminary plat and major amendment to the Planned Unit Development in 2015. One of the changes that the City Council approved in 2015 was a reduction in the number of units in each building. In this case, the subject property was originally approved for 6 units within a single building, but the PUD was amended to allow 2 buildings containing three units each. In order for the units to be recorded as part of a new common interest community, the County is requiring each building to be located within its own parcel. RECOMMENDATION Staff recommends approval of the resolution based on the information provided by the applicant and detailed in this report.
