Regular Meeting Call to Order: Pursuant to due call and notice thereof, the Regular Meeting of the Planning Commission was held on Tuesday, November 27, 2018. Chair Kenninger called the meeting to order at 6:31 p.m. with Commissioners VanderWiel, Freeman, Reed, and Mele. Also in attendance were Community Development Director Lindquist, Senior Planner Klatt, Planner Nemcek, and Recording Secretary Bodsberg. The Pledge of Allegiance was said. Additions to Agenda: None. Audience Input: None. Consent Agenda: a. Approval of the October 23, 2018, Regular Meeting Minutes. b. Approval of the October 30, 2018, Regular Meeting Minutes. MOTION by Freeman. Second by Mele. Ayes: 5. Nays: 0. RECESS REGULAR PLANNING COMMISSION MEETING AND OPEN BOARD OF APPEALS AND ADJUSTMENTS MEETING MOTION by VanderWiel to recess the regular meeting and open Board of Appeals and Adjustments meeting. Second by Mele. Ayes: 5. Nays: 0. Motion Passes. Public Hearing: 5.a. Request by Christopher Handley for a Variance from the Front and Side Yard Setback Requirements for Principal Structure at 12976 S Robert Trail in the RR-Rural Residential Zoning District. (18-54-V) – Board of Appeals Planner Nemcek gave a brief summary of the staff report for the Planning Commission. The public hearing opened at 6:39 pm. Public Comments: Michelle McDonald, 2800 130th Street, stated that they live down the street and are in support of the project and they think that the new house plans will improve the neighborhood. MOTION by VanderWiel to close the public hearing. Second by Reed. Ayes: 5. Nays: 0. Motion Passes. The public hearing was closed at 6:40 pm. PLANNING COMMISSION REGULAR MEETING MINUTES NOVEMBER 27, 2018 PAGE 2 Additional Comments: Chair Kenninger noted it was nice to have neighborhood support for the request and felt that the shift of the driveway off of Hwy 3 was a significant benefit of the project. MOTION by VanderWiel the Board of Appeals and Adjustments to adopt a resolution approving a variance to reduce the Rural Residential front yard setback from sixty (60) feet to seventeen (17) feet and the side yard setback from thirty (30) feet to ten (10) feet, subject to conditions. Second by Freeman. Ayes: 5. Nays: 0. Motion Passes. MOTION by VanderWiel to recess Board of Appeals and Adjustments meeting and reopen the Planning Commission meeting. Second by Mele. Ayes: 5. Nays: 0. Motion Passes. RECESS BOARD OF APPEALS AND ADJUSTMENTS MEETING AND RE-CONVENE REGULAR PLANNING COMMISSION MEETING. 5.b. Request by Vesterra, LLC and Stonex, LLC for the Renewal of the Small Scale Mineral Extraction Permit for 2019. (18-52-ME) Planner Nemcek gave a brief summary of the staff report for the Planning Commission. Commissioner Reed questioned if the new exit onto Blaine could be included in the conditions for the 2019 permit. Nemcek stated that the applicant is waiting until the mining has reached that specific location until the applicant moves the exit. The public hearing opened at 6:52 pm. Public Comments: None. MOTION by Freeman to close the public hearing. Second by Mele. Ayes: 5. Nays: 0. Motion Passes. The public hearing was closed at 6:53 pm. Additional Comments: None. MOTION by Reed to recommend the City Council renew the Vesterra, LLC. and Stonex, LLC. Small Scale Mineral Extraction Permit for 2019, subject to the terms and conditions in the attached Draft 2019 Conditions for Mineral Extraction. Second by Freeman. Ayes: 5. Nays: 0. Motion Passes. 5.c. Request by Carl Bolander for the Renewal of the Small Scale Mineral Extraction Permit for 2019. (18-55-ME) Senior Planner Klatt gave a brief summary of the staff report for the Planning Commission. The public hearing opened at 7:05 pm. Public Comments: None. MOTION by Reed to close the public hearing. Second by Freeman. Ayes: 5. Nays: 0. Motion Passes. MOTION by VanderWiel to recommend the City Council renew the Bolander and Sons Small Scale Mineral Extraction Permit for 2019, subject to the terms and conditions in the attached Draft 2019 Conditions for Mineral Extraction. Second by Mele. Ayes: 5. Nays: 0. Motion Passes. 5.d. Request by City of Rosemount for a Text Amendment to Zoning Ordinance to Remove Membership Organizations from the DT and C-4 Zoning Districts. (18-53-TA) Senior Planner Klatt gave a brief summary of the staff report for the Planning Commission. Community Development Director added that through recent work on the Comprehensive Plan this issue became more apparent. Commissioner VanderWiel inquired what the objection is to having Membership Organizations in the Zoning Districts. Community Development Director Lindquist explained that the regulation addresses the ownership structure rather than the land use impacts of the use, which is not appropriate for the zoning ordinance. Commissioner Reed inquired if there are current membership organizations within the affected zoning district. Klatt stated that there is not in the commercial district and in the Downtown district, the city would classify the use, the American Legion, more as a restaurant bar for zoning purposes. . The public hearing opened at 7:18 pm. Public Comments: None. MOTION by Freeman to close the public hearing. Second by Reed. Ayes: 5. Nays: 0. Motion Passes. The public hearing was closed at 7:19 pm. Additional Comments: None. MOTION by Freeman to recommend the City Council approve the Text Amendments amending the DT and C-4 Zoning Districts. Second by VanderWiel. Ayes: 5. Nays: 0. Motion Passes. Old Business: None. New Business: 7.a. Review 2019 Planning Commission Meeting Schedule. MOTION by VanderWiel to adopt the 2019 Planning Commission meeting schedule. Second by Mele. Ayes: 5. Nays: 0. Motion Passes. Reports: Next Planning Commission Meeting will be held on Monday, December 17, 2018. Adjournment: There being no further business to come before this Commission, Chair Kenninger adjourned the meeting at 7:24 pm.
