RECOMMENDED ACTION: Motion to adopt a resolution approving the Lot Split.
SUMMARY
U.S. Home Corporation is requesting a lot split and combination to accommodate a home plan selected by
a buyer of Parcel B. Parcel B is a corner lot along a collector road, the future Autumn Path. A 35’ side
yard setback from Autumn Path is required by the Bella Vista Planned Unit Development Agreement.
The constraints of the site do not rise to the level of a variance request, so the applicant is requesting a lot
split and recombination to accommodate their buyers’ desired home plan. The City Council is also
holding a public hearing to review a request to vacate the existing drainage and utility easements on either
side of the existing parcel boundary. The drainage and utility easement between the two parcels must be
vacated to accommodate the new parcel boundary, and a new 5’ drainage and utility easement will be
dedicated along each side of the new parcel boundary. Staff is recommending approval of this request,
subject to the approval of the easement vacation.
BACKGROUND

Comp. Guide Plan Designation: Low Density Residential
Current Zoning: Low Density Residential Planned Unit Development
Nature of Request: Separate 7 feet along the eastern boundary of one parcel and
combine it with the adjacent parcel to accommodate a larger home
plan.
The Bella Vista Planned Unit Development was approved in 2013. The subdivision is located north of
Bonaire Path and east of Bacardi Avenue. The subject parcels are located in the 5th Addition of Bella
Vista, at the intersection of Aulden Avenue and the future Autumn Path. The applicant has been working
with a potential buyer of Parcel B who desires a home plan that contains a 4-stall garage and an interior
sport court. As the lots are currently drawn, the footprint of the proposed home would encroach into the
35’ setback from the future Autumn Path.
The redrawn parcels will allow the home to fit on the lot without encroaching onto the required setback by
expanding the building pad for the corner parcel. The parcels created by the redrawn lot lines conform to
the lot standards of the Bella Vista PUD. The lot width of Parcel A will be reduced to 79 feet, above the
minimum lot width in Bella Vista of 75 feet. The applicant has indicated that a home will be able to fit on

Parcel A without the need of variance. Staff has made it clear to the applicant that there is no interest in
providing a variance for the reduced lot. The applicant is also requesting a vacation of the 5’ wide drainage
and utility easements along each side of the parcel boundary that is being shifted west. Staff is
recommending that the lot split be approved subject to the approval of the easement vacation and
dedication of the new 5’ drainage and utility easements. New easements along that boundary shall be
dedicated with the recording of the lot split and combination as shown on the exhibit included in the
attachments.
CONCLUSION AND RECOMMENDATION
Staff is recommending approval of the lot split, subject to conditions contained in the attached resolution.
This recommendation is based on the understanding that the lot being reduced in size (Parcel A) is likely
unable to accommodate the widest possible home plans offered by the applicant and that a variance for
such home plans will not be considered in the future.

REQUESTED BY U.S. HOME CORPORATION
WHEREAS, the City of Rosemount received a request for the Lot Split approval from U.S. Home
Corporation, concerning property legally described as:
Lot 9, Block 1, BELLA VISTA 5TH ADDITION, Dakota County, Minnesota
And
Lot 10, Block 1, BELLA VISTA 5TH ADDITION, Dakota County, Minnesota
WHEREAS, the Lot Split approval will create two parcels legally described as:
PARCEL A:
Lot 9, Block 1, BELLA VISTA 5TH ADDITION, Dakota County, Minnesota, except the
east 7.00 feet thereof.
And
PARCEL B:
Lot 10 and the east 7.00 feet of Lot 9, Block 1, BELLA VISTA 5TH ADDITION,
Dakota County, Minnesota
WHEREAS, on March 5, 2019, the City Council of the City of Rosemount reviewed the request.
NOW, THEREFORE, BE IT RESOLVED, the Council of the City of Rosemount hereby
approves the Lot Split for U.S. Home Corporation, subject to the following conditions:
1. Combination of Lot 10, Block 1, BELLA VISTA 5TH ADDITION, Dakota County,
Minnesota, with the east 7.00 feet of Lot 9, Block 1, BELLA VISTA 5TH ADDITION,
Dakota County, Minnesota.
2. Approval of a vacation of the drainage and utility easement along the boundary between
Parcel A and Parcel B.
ADOPTED this 5th day of March, 2019, by the City Council of the City of Rosemount.
