RECOMMENDED ACTION: Motion to Adopt a Resolution Approving the Vacation of the
Drainage and Utility Easements over Lot 1, Block 1 Schlukebier Addition.
SUMMARY
The City Council is being asked to consider vacation of the drainage and utility easements over Lot 1,
Block 1 of the Schlukebier Addition to facilitate the replatting of this lot into a new subdivision to be
known as Bacardi Ridge. The proposed Bacardi Ridge subdivision reconfigures the northern lot line of the
lot under consideration, and this lot line was platted with a 5-foot drainage and utility easement along it as
required for all new subdivisions. With no further action by the City, the easement would remain in place
while the property line shifts to a new location (leaving the easement in the middle of the newly created
lot). In order to simplify the process, the applicant is proposing to vacate all drainage and utility easements
over the impacted lot and to rededicate new easements with the Bacardi Ridge plat, consistent with the
City’s subdivision regulations.
The Council should only take action on this request after approval of the Bacardi Ridge subdivision. The
action requires a public hearing and public notification, which was completed.
RECOMMENDATION
Staff is recommending approval of the vacation of drainage and utility easements over Lot 1, Block 1
Schlukebier Addition, subject to the recording of the simple plat of Bacardi Ridge.

A RESOLUTION APPROVING THE VACATION OF THE DRAINAGE AND UTILITY
EASEMENTS OVER LOT 1, BLOCK 1 SCHLUKEBIER ADDITION
WHEREAS, the City of Rosemount received an application from Dean Trongard Options Real Estate,
Inc., P.O. Box 33, Maple Plain, MN (Applicant) for the Simple Plat of Bacardi Ridge;
WHEREAS, on April 16, 2019, the City of Rosemount City Council reviewed and approved the Simple
Plat for Bacardi Ridge; and
WHEREAS, the vacation of the existing drainage and utility easements legally described below is required
before the Simple Plat can be recorded for Bacardi Ridge; and
WHEREAS, the City Council reviewed this request and conducted a public hearing on said matter on April
16, 2019.
NOW, THEREFORE, BE IT RESOLVED, the Council of the City of Rosemount hereby approves the
Vacation of the Drainage and Utility Easements, legally described as:
All drainage and utility easements as delineated and dedicated on Lot 1, Block 1 Schlukebier
Addition, according to the recorded plat thereof, Dakota County, Minnesota.
subject to the recording of the Simple Plat of Bacardi Ridge.
ADOPTED this 16th day of April 2019, by the City Council of the City of Rosemount.
