ATTACHMENTS: Resolution; Site Location Map; Easement Vacation Sketch APPROVED BY: LJM RECOMMENDED ACTION: Motion to Adopt a Resolution Approving the Vacation of the Drainage and Utility Easement of Outlots A and B, Prestwick Place 16th Addition. SUMMARY With the approval of the Final Plat for Prestwick Place 16th Addition, drainage and utility easements were recorded on several outlots encompassing the future phases of development within the Prestwick Place 13th Addition Planned Unit Development. To accommodate the development of Prestwick Place 19th Addition, a vacation of the drainage and utility easements over Outlots A and B, Prestwick Place 16th Addition is necessary. This action is typical when there are multi-phased developments in a larger preliminary plat. Appropriate new drainage and utility easements will be recorded with the Prestwick Place 19th Addition final plat which, is also scheduled on the May 21 meeting. RECOMMENDATION Staff is recommending approval of the vacation of drainage and utility easements over Outlots A and B, Prestwick Place 16th Addition, subject to the recording of the final plat of Prestwick Place 19th Addition. CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2019-43 A RESOLUTION APPROVING THE VACATION OF THE DRAINAGE AND UTILITY EASEMENTS OVER OUTLOT A and B, PRESTWICK PLACE 16TH ADDITION WHEREAS, the City of Rosemount received an application from Prestwick, LLC, 350 Highway 7, Suite 125, Excelsior, MN (Applicant) for the Final Plat of Prestwick Place 19th Addition; WHEREAS, on May 21, 2019, the City of Rosemount City Council reviewed and approved the Final Plat for Prestwick Place 19th Addition; and WHEREAS, the vacation of the existing drainage and utility easements legally described below is required before the Final Plat can be recorded for Prestwick Place 19th Addition; and WHEREAS, the City Council reviewed this request and conducted a public hearing on May 21, 2019. NOW, THEREFORE, BE IT RESOLVED, the Council of the City of Rosemount hereby approves the Vacation of the Drainage and Utility Easements, legally described as: All drainage and utility easements lying over, under, and across OUTLOT A AND OUTLOT B, PRESTWICK PLACE 16TH ADDITION, according to the recorded plat thereof, Dakota County, Minnesota. subject to the recording of the Final Plat of Prestwick Place 19th Addition.
