Applicant shall provide a landscaping surety in the amount of $15,180. 2. The execution of an encroachment agreement for the electrical wiring that will cross the drainage and utility easement. 3. The applicant shall register the location of the electrical wires within the drainage and utility easement with Gopher State One Call. 4. The applicant shall receive a grading permit prior to any excavation on the site. 5. Compliance with all the conditions contained within the Engineer’s Memo dated July, 23, 2019 SUMMARY The Planning Commission is being asked to review a request for site plan review for a ground-mounted solar installation on property owned by St. Joseph’s Catholic Church. The site is located within the R1- Low Density Residential zoning district, and solar energy systems are a permitted accessory use in that zoning district. The solar system is considered an accessory use because less than half of the site is dedicated to the solar array with the remaining lands, approximately 17 acres being dedicated to church use. However, the total area of the proposed solar installation is greater than 50% of the area of the principal structure, in this case the church building. The ordinance exempts site plan review if the accessory use is less than 50% of the principal structure, which in this case, a site plan is required. The proposed installation meets or exceeds the standards contained within the City’s Alternative Energy Systems ordinance, as well as the standards for accessory structures in the R1-Low Density Residential zoning district. Staff is recommending approval of the site plan review. BACKGROUND Applicant: Paula Fitzgerald, Novel Energy Solutions Property Owner: Church of St. Joseph of Rosemount Location: 13900 Biscayne Avenue West Area in Acres: 29.59 Acres total, 9.5 Acres project area Comp. Guide Plan Designation: LDR – Low Density Residential Current Zoning: R1-Low Density Residential 2 The subject site is located on the eastern portion of a parcel located in the southeast quadrant of the intersection of Biscayne Avenue and Connemara Trail. The principal structure on the site, the church, was constructed in 2002 when the Church of St. Joseph’s congregation moved from its former location along South Robert Trail in downtown Rosemount. In 2014, The City Council amended the City zoning ordinance to allow for alternative energy systems, which in this case the alternative energy system is a ground mounted solar array. The proposed solar installation is “behind the meter” meaning any power produced by the system will be used by the church. This differs from Community Solar Gardens (CSGs) where the power generated is immediately purchased by a utility. While the proposed solar array is not a CSG, due to its size and site plan requirement, staff recommended the applicant submit a landscape plan that provides screening similar to that which is required in an interim use permit for the CSG on the east end of Rosemount. Typically, Solar Energy Systems are approved by staff administratively through the normal building permit process. Because the size of the array being proposed is greater in area than 50% of the principal structure on the site, a site plan review is required by City Code. The proposed array meets all the other standards required by the City Code for Alternative Energy Systems, therefore staff is recommending the planning commission approve the site plan to allow Novel Energy Solutions to install a solar array on property owned by the Church of St. Joseph. SITE PLAN REVIEW Site plan applications are approved by the Planning Commission and considered a Quasi-Judicial action. As such, the City has a set of standards and requirements for review. Generally, if a site plan application meets the ordinance requirements it must be approved. These standards are outlined in Section 11-2-12 (Alternative Energy Systems) and 11-10-3 (Site and Building Plan Review). Land Use & Zoning . The site is located within the R1-Low Density Residential zoning district. The church is a conditional use in the R1-zoning district, and ground-mounted solar energy systems are an accessory use within that zoning district. In addition to specific standards relating to Alternative Energy Systems found in 11-2-12 of the City Code, the proposed project must adhere to the setback requirements for accessory structures of the zoning district in which the site is located. The proposed array meets all the lot standards of the R1- Low Density Residential zoning district. Standards for Accessory Structures in the R1-Low Density Residential Zoning District Standard Required Proposed Front (North) 30 ft. 153.5 ft. Side (East) 10 ft. 100 ft. Rear (South) 10 ft. 69 ft. Maximum Lot Coverage 30% of entire parcel 23.25% of entire parcel Alternative Energy Systems In addition to the lot standards for the R1-Low Density Residential zoning district, the proposed solar system must meet the standards set forth in Section 11-2-12: Alternative Energy Systems. Height. The maximum height permitted for ground mounted solar systems is fifteen feet (15’). The plans submitted by the applicant indicate the highest point from grade the proposed solar panels will reach is 8’9” as indicated in the attached details. Landscaping and Screening. The Alternative Energy Systems ordinance requires that ground mounted solar 3 energy systems shall be screened from view of the public right of way to the extent possible without reducing their efficiency by setback, berming, landscaping, walls or a combination thereof. No specific requirements for screening from neighboring properties are listed in the City Code. Because of the size of the project, staff recommended that the applicant enhance the existing landscaping by planting trees in between the existing trees to better screen the installation from adjacent properties. The landscaping plan provided by the applicant indicates that a total of 46 coniferous trees will be added to the existing landscaping along the eastern and southern boundaries of the site which will provide screening to 90% opacity. Because the northern site boundary features stormwater management infrastructure, staff feels the screening requirement for a portion of that side of the solar array is met by the existing landscaping along Connemara Trail as well as the increased setback created by the stormwater ponding. A low growing native grass mix will be seeded beneath the array while a pollinator mix is shown along the perimeter of the array. A condition of approval is the provision of a landscaping surety in the amount of $15,180 (46 trees @ $300 per tree, plus 10%) in conformance with the City’s landscaping ordinance. While not required by the City Code, the plans submitted by the applicant show a security fence to be installed around the array, between the buffer trees and the array and also along the drainage and utility easement that bisects the project area. The final design of the fence will be reviewed for compliance with the City Code during the permit review process. Engineering The Assistant City Engineer has reviewed the proposed solar array and provided comments in the Engineer’s Memo dated July 23, 2019. The project site is bisected by a drainage and utility easement. The project itself will be located outside all easements on the property, with a small exception being electrical wiring connecting the two sections of the solar array. Staff is recommending as a condition of approval entering into an encroachment agreement for the wiring. Additionally, the location of the wiring should be registered with Gopher State One Call to ensure the lines can easily be located if work needs to take place within the easement. A grading permit is required due to the volume of earth being excavated for this project. The applicant shall apply for a grading permit and submit the necessary financial guarantee as required by the City Code. RECOMMENDATION Based on the information provided by the applicant and reviewed in this memorandum, staff finds that the proposed solar installation meets or exceeds the requirements for accessory structures in the R1-Low Density Residential zoning district as well those contained in section 11-2-12: Alternative Energy Systems. Staff is recommending approval of the site plan to allow Novel Energy Systems to construct a solar energy system on the property owned by the Church of St. Joseph. The applicant shall submit civil plans signed by a professional engineer, licensed with the State of Minnesota. 2. The applicant shall include an existing conditions survey of the project area in their plan set. UTILITIES: An 80-foot, Drainage & Utility (D&U) Easement bisects the property. The City owns a 30” sanitary sewer pipe and a 30” storm sewer pipe within the easement, both approximately 35 feet deep. The proposed plan will place solar panels on both sides of the easement, connected by buried electrical cables. An 8” watermain runs through the property to serve the existing building and hydrants onsite. 3. The applicant shall enter into an encroachment agreement for the electrical cables buried within the D&U easement, prior to construction. 4. The applicant shall register buried cables with Gopher State One Call for locating. 5. The existing conditions survey shall show the location of water utilities within the project area. 6. The applicant shall not place solar panels above the 8” waterline. GRADING & STORMWATER COMMENTS: The applicant plans to seed the area underneath the solar panels with a native mix rather than paved or gravel surface. 7. The applicant shall provide a drainage map and stormwater management information to confirm that the runoff from this proposal can be accommodated in the existing pond #1637 and adjacent infiltration basin #1671. 8. The applicant is required to obtain a NPDES Construction Stormwater Permit and provide a copy of the approved SWPPP to the City prior to the start of any construction activity. 9.
