RECOMMENDED ACTION:
Motion to Approve the Site Plan submitted by Novel Energy Solutions, subject to the
following conditions:
1. Applicant shall provide a landscaping surety in the amount of $15,180.
2. The execution of an encroachment agreement for the electrical wiring that will cross
the drainage and utility easement.
3. The applicant shall register the location of the electrical wires within the drainage
and utility easement with Gopher State One Call.
4. The applicant shall receive a grading permit prior to any excavation on the site.
5. Compliance with all the conditions contained within the Engineer’s Memo dated July,
23, 2019
SUMMARY
The Planning Commission is being asked to review a request for site plan review for a ground-mounted
solar installation on property owned by St. Joseph’s Catholic Church. The site is located within the R1-
Low Density Residential zoning district, and solar energy systems are a permitted accessory use in that
zoning district. The solar system is considered an accessory use because less than half of the site is
dedicated to the solar array with the remaining lands, approximately 17 acres being dedicated to church
use. However, the total area of the proposed solar installation is greater than 50% of the area of the
principal structure, in this case the church building. The ordinance exempts site plan review if the
accessory use is less than 50% of the principal structure, which in this case, a site plan is required. The
proposed installation meets or exceeds the standards contained within the City’s Alternative Energy
Systems ordinance, as well as the standards for accessory structures in the R1-Low Density Residential
zoning district. Staff is recommending approval of the site plan review.

The subject site is located on the eastern portion of a parcel located in the southeast quadrant of the
intersection of Biscayne Avenue and Connemara Trail. The principal structure on the site, the church, was
constructed in 2002 when the Church of St. Joseph’s congregation moved from its former location along
South Robert Trail in downtown Rosemount. In 2014, The City Council amended the City zoning
ordinance to allow for alternative energy systems, which in this case the alternative energy system is a
ground mounted solar array. The proposed solar installation is “behind the meter” meaning any power
produced by the system will be used by the church. This differs from Community Solar Gardens (CSGs)
where the power generated is immediately purchased by a utility.
While the proposed solar array is not a CSG, due to its size and site plan requirement, staff recommended
the applicant submit a landscape plan that provides screening similar to that which is required in an interim
use permit for the CSG on the east end of Rosemount. Typically, Solar Energy Systems are approved by
staff administratively through the normal building permit process. Because the size of the array being
proposed is greater in area than 50% of the principal structure on the site, a site plan review is required by
City Code. The proposed array meets all the other standards required by the City Code for Alternative
Energy Systems, therefore staff is recommending the planning commission approve the site plan to allow
Novel Energy Solutions to install a solar array on property owned by the Church of St. Joseph.
SITE PLAN REVIEW
Site plan applications are approved by the Planning Commission and considered a Quasi-Judicial action.
As such, the City has a set of standards and requirements for review. Generally, if a site plan application
meets the ordinance requirements it must be approved. These standards are outlined in Section 11-2-12
(Alternative Energy Systems) and 11-10-3 (Site and Building Plan Review).
Land Use & Zoning .
The site is located within the R1-Low Density Residential zoning district. The church is a conditional use
in the R1-zoning district, and ground-mounted solar energy systems are an accessory use within that
zoning district. In addition to specific standards relating to Alternative Energy Systems found in 11-2-12
of the City Code, the proposed project must adhere to the setback requirements for accessory structures of
the zoning district in which the site is located. The proposed array meets all the lot standards of the R1-
Low Density Residential zoning district.

Alternative Energy Systems
In addition to the lot standards for the R1-Low Density Residential zoning district, the proposed solar
system must meet the standards set forth in Section 11-2-12: Alternative Energy Systems.
Height. The maximum height permitted for ground mounted solar systems is fifteen feet (15’). The plans
submitted by the applicant indicate the highest point from grade the proposed solar panels will reach is
8’9” as indicated in the attached details.
Landscaping and Screening. The Alternative Energy Systems ordinance requires that ground mounted solar

energy systems shall be screened from view of the public right of way to the extent possible without
reducing their efficiency by setback, berming, landscaping, walls or a combination thereof. No specific
requirements for screening from neighboring properties are listed in the City Code. Because of the size of
the project, staff recommended that the applicant enhance the existing landscaping by planting trees in
between the existing trees to better screen the installation from adjacent properties.
The landscaping plan provided by the applicant indicates that a total of 46 coniferous trees will be added
to the existing landscaping along the eastern and southern boundaries of the site which will provide
screening to 90% opacity. Because the northern site boundary features stormwater management
infrastructure, staff feels the screening requirement for a portion of that side of the solar array is met by
the existing landscaping along Connemara Trail as well as the increased setback created by the stormwater
ponding.
A low growing native grass mix will be seeded beneath the array while a pollinator mix is shown along the
perimeter of the array. A condition of approval is the provision of a landscaping surety in the amount of
$15,180 (46 trees @ $300 per tree, plus 10%) in conformance with the City’s landscaping ordinance.
While not required by the City Code, the plans submitted by the applicant show a security fence to be
installed around the array, between the buffer trees and the array and also along the drainage and utility
easement that bisects the project area. The final design of the fence will be reviewed for compliance with
the City Code during the permit review process.
Engineering
The Assistant City Engineer has reviewed the proposed solar array and provided comments in the
Engineer’s Memo dated July 23, 2019. The project site is bisected by a drainage and utility easement. The
project itself will be located outside all easements on the property, with a small exception being electrical
wiring connecting the two sections of the solar array. Staff is recommending as a condition of approval
entering into an encroachment agreement for the wiring. Additionally, the location of the wiring should be
registered with Gopher State One Call to ensure the lines can easily be located if work needs to take place
within the easement. A grading permit is required due to the volume of earth being excavated for this
project. The applicant shall apply for a grading permit and submit the necessary financial guarantee as
required by the City Code.
RECOMMENDATION
Based on the information provided by the applicant and reviewed in this memorandum, staff finds that the
proposed solar installation meets or exceeds the requirements for accessory structures in the R1-Low
Density Residential zoning district as well those contained in section 11-2-12: Alternative Energy Systems.
Staff is recommending approval of the site plan to allow Novel Energy Systems to construct a solar energy
system on the property owned by the Church of St. Joseph.

SERVICE TO TRIM THE TREES PRIOR TO THE BEGINNING OF OPERATION. SHOULD CONTRACTOR'S OPERATIONS RESULT IN THE
BREAKING OF ANY LIMBS, THE BROKEN LIMBS SHOULD BE REMOVED IMMEDIATELY AND CUTS SHALL BE PROPERLY PROTECTED TO

EMBANKMENT AREAS, OUTSIDE OF BUILDING PADS, ROADWAYS AND PARKING AREAS. CONTRACTOR SHALL SUBCUT CUT AREAS,
WHERE TURF IS TO BE ESTABLISHED, TO A DEPTH OF 6 INCHES. RESPREAD TOPSOIL IN AREAS WHERE TURF IS TO BE ESTABLISHED TO
A MINIMUM DEPTH OF 6 INCHES.
13.FINISHED GRADING SHALL BE COMPLETED, CONTRACTOR SHALL UNIFORMLY GRADE AREAS WITHIN LIMITS OF GRADING, INCLUDING
ADJACENT TRANSITION AREAS. PROVIDE A SMOOTH FINISHED SURFACE WITHIN SPECIFIED TOLERANCES, WITH UNIFORM LEVELS OR
SLOPES BETWEEN POINTS WHERE ELEVATIONS ARE SHOWN, OR BETWEEN SUCH POINTS AND EXISTING GRADES. AREAS THAT HAVE
BEEN FINISHED GRADED SHALL BE PROTECTED FROM SUBSEQUENT CONSTRUCTION OPERATIONS, TRAFFIC AND EROSION. REPAIR
ALL AREAS THAT HAVE BECOME RUTTED, ERODED OR HAS SETTLED BELOW THE CORRECT GRADE. ALL AREAS DISTURBED BY THE
CONTRACTOR'S OPERATIONS SHALL BE RESTORED TO EQUAL OR BETTER THAN ORIGINAL CONDITION OR TO THE REQUIREMENTS OF
THE NEW WORK.
14.TOLERANCES
14.a.THE STREET OR PARKING AREA SUBGRADE FINISHED SURFACE ELEVATION SHALL NOT VARY BY MORE THAN 0.05 FOOT
ABOVE, OR 0.10 FOOT BELOW, THE PRESCRIBED ELEVATION OF ANY POINT WHERE MEASUREMENT IS MADE.
14.b.AREAS WHICH ARE TO RECEIVE TOPSOIL SHALL BE GRADED TO WITHIN 0.30 FOOT ABOVE OR BELOW THE REQUIRED
ELEVATION, UNLESS DIRECTED OTHERWISE BY THE ENGINEER.
14.c.TOPSOIL SHALL BE GRADED TO PLUS OR MINUS 1/2 INCH OF THE SPECIFIED THICKNESS.
15.AFTER THE SITE GRADING IS COMPLETED, IF EXCESS OR SHORTAGE OF SOIL MATERIAL EXISTS, CONTRACTOR SHALL TRANSPORT ALL
EXCESS SOIL MATERIAL OFF THE SITE TO AN AREA SELECTED BY THE CONTRACTOR, OR IMPORT SUITABLE MATERIAL TO THE SITE.

ALL MEASURES STATED ON THIS EROSION AND SEDIMENT CONTROL PLAN, AND IN THE STORM WATER POLLUTION PREVENTION PLAN SHALL BE MAINTAINED IN FULLY FUNCTIONAL CONDITION UNTIL NO
LONGER REQUIRED FOR A COMPLETED PHASE OF WORK OR FINAL STABILIZATION OF THE SITE. THE DESIGNATED CONTACT PERSON NOTED ON THIS PLAN MUST ROUTINELY INSPECT THE CONSTRUCTION
ON SITE ONCE EVERY SEVEN DAYS DURING ACTIVE CONSTRUCTION AND WITHIN 24 HOURS AFTER A RAINFALL EVENT GREATER THAN 0.5 INCHES IN 24 HOURS. ALL EROSION AND SEDIMENTATION
CONTROL MEASURES SHALL BE CLEANED AND REPAIRED IN ACCORDANCE WITH THE FOLLOWING:
1.ALL SILT FENCES MUST BE REPAIRED, REPLACED, OR SUPPLEMENTED WHEN THEY BECOME NONFUNCTIONAL OR THE SEDIMENT REACHES 1/3 OF THE HEIGHT OF THE FENCE. THESE REPAIRS MUST BE

2.TEMPORARY AND PERMANENT SEDIMENTATION BASINS MUST BE DRAINED AND THE SEDIMENT REMOVED WHEN THE DEPTH OF SEDIMENT COLLECTED IN THE BASIN REACHES 1/2 THE STORAGE
VOLUME. DRAINAGE AND REMOVAL MUST BE COMPLETED WITHIN 72 HOURS OF DISCOVERY, OR AS SOON AS FIELD CONDITIONS ALLOW ACCESS (SEE PART IV.D. OF THE GENERAL PERMIT).
3.SURFACE WATERS, INCLUDING DRAINAGE DITCHES AND CONVEYANCE SYSTEMS, MUST BE INSPECTED FOR EVIDENCE OF SEDIMENT BEING DEPOSITED BY EROSION. CONTRACTOR MUST REMOVE ALL
DELTAS AND SEDIMENT DEPOSITED IN SURFACE WATERS, INCLUDING DRAINAGE WAYS, CATCH BASINS, AND OTHER DRAINAGE SYSTEMS, AND RESTABILIZE THE AREAS WHERE SEDIMENT REMOVAL
RESULTS IN EXPOSED SOIL. THE REMOVAL AND STABILIZATION MUST TAKE PLACE WITHIN SEVEN (7) DAYS OF DISCOVERY UNLESS PRECLUDED BY LEGAL, REGULATORY, OR PHYSICAL ACCESS
CONSTRAINTS. CONTRACTOR SHALL USE ALL REASONABLE EFFORTS TO OBTAIN ACCESS. IF PRECLUDED, REMOVAL AND STABILIZATION MUST TAKE PLACE WITHIN SEVEN (7) CALENDAR DAYS OF
OBTAINING ACCESS. CONTRACTOR IS RESPONSIBLE FOR CONTACTING ALL LOCAL, REGIONAL, STATE AND FEDERAL AUTHORITIES AND RECEIVING ANY APPLICABLE PERMITS, PRIOR TO CONDUCTING
ANY WORK.
4.CONSTRUCTION SITE VEHICLE EXIT LOCATIONS MUST BE INSPECTED FOR EVIDENCE OF OFF-SITE SEDIMENT TRACKING ONTO PAVED SURFACES. TRACKED SEDIMENT MUST BE REMOVED FROM ALL
OFF-SITE PAVED SURFACES, WITHIN 24 HOURS OF DISCOVERY, OR IF APPLICABLE, WITHIN A SHORTER TIME TO COMPLY WITH PART IV.C.6 OF THE GENERAL PERMIT.
5.CONTRACTOR IS RESPONSIBLE FOR THE OPERATION AND MAINTENANCE OF TEMPORARY AND PERMANENT WATER QUALITY MANAGEMENT BMPS, AS WELL AS ALL EROSION PREVENTION AND
SEDIMENT CONTROL BMPS, FOR THE DURATION OF THE CONSTRUCTION WORK AT THE SITE. THE PERMITTEE(S) ARE RESPONSIBLE UNTIL ANOTHER PERMITTEE HAS ASSUMED CONTROL (ACCORDING
TO PART II.B.5 OF THE MPCA GENERAL PERMIT) OVER ALL AREAS OF THE SITE THAT HAVE NOT BEEN FINALLY STABILIZED OR THE SITE HAS UNDERGONE FINAL STABILIZATION, AND A (N.O.T.) HAS
BEEN SUBMITTED TO THE MPCA.
6.IF SEDIMENT ESCAPES THE CONSTRUCTION SITE, OFF-SITE ACCUMULATIONS OF SEDIMENT MUST BE REMOVED IN A MANNER AND AT A FREQUENCY SUFFICIENT TO MINIMIZE OFF-SITE IMPACTS
(E.G., FUGITIVE SEDIMENT IN STREETS COULD BE WASHED INTO STORM SEWERS BY THE NEXT RAIN AND/OR POSE A SAFETY HAZARD TO USERS OF PUBLIC STREETS).
7.ALL INFILTRATION AREAS MUST BE INSPECTED TO ENSURE THAT NO SEDIMENT FROM ONGOING CONSTRUCTION ACTIVITIES IS REACHING THE INFILTRATION AREA AND THESE AREAS ARE PROTECTED

LINER IS NOT ACCEPTABLE. THE LIQUID AND SOLID WASTES MUST NOT CONTACT THE GROUND, AND THERE MUST NOT BE RUNOFF FROM THE CONCRETE WASHOUT OPERATIONS OR AREAS. LIQUID
AND SOLID WASTES MUST BE DISPOSED OF PROPERLY AND IN COMPLIANCE WITH MPCA REGULATIONS. A SIGN MUST BE INSTALLED ADJACENT TO EACH WASHOUT FACILITY TO INFORM CONCRETE

GENERAL NOTES:
1.THE CONTRACTOR SHALL INSPECT THE SITE AND BECOME FAMILIAR WITH THE EXISTING
CONDITIONS RELATING TO THE NATURE AND SCOPE OF THE WORK.
2.THE CONTRACTOR SHALL VERIFY PLAN LAYOUT AND BRING TO THE ATTENTION OF THE LANDSCAPE
ARCHITECT DISCREPANCIES WHICH MAY COMPROMISE THE DESIGN OR INTENT OF THE LAYOUT.
3.THE CONTRACTOR SHALL BE RESPONSIBLE FOR COMPLYING WITH ALL APPLICABLE CODES,
REGULATIONS, AND PERMITS GOVERNING THE WORK.
4.THE CONTRACTOR SHALL PROTECT EXISTING ROADS, CURBS/GUTTERS, TRAILS, TREES, LAWNS AND

6.THE LANDSCAPE CONTRACTOR SHALL COORDINATE THE PHASES OF CONSTRUCTION AND
PLANTING INSTALLATION WITH OTHER CONTRACTORS WORKING ON SITE.
7.THE CONTRACTOR SHALL REVIEW THE SITE FOR DEFICIENCIES IN SITE CONDITIONS WHICH MIGHT
NEGATIVELY AFFECT PLANT ESTABLISHMENT, SURVIVAL OR WARRANTY. UNDESIRABLE SITE

COMPLETE THE WORK SHOWN ON THE PLAN.
13.USE ANTI-DESICCANT (WILTPRUF OR APPROVED EQUAL) ON DECIDUOUS PLANTS MOVED IN LEAF
AND FOR EVERGREENS MOVED ANYTIME. APPLY AS PER MANUFACTURER'S INSTRUCTION. ALL
EVERGREENS SHALL BE SPRAYED IN THE LATE FALL FOR WINTER PROTECTION DURING WARRANTY

14. WRAP ALL SMOOTH-BARKED DECIDUOUS TREES PLANTED IN THE FALL PRIOR TO DECEMBER 1 AND

16.PLANTING SOIL FOR TREES, SHRUBS AND GROUND COVERS: FERTILE FRIABLE LOAM
CONTAINING A LIBERAL AMOUNT (4% MIN.) OF HUMUS AND CAPABLE OF SUSTAINING
VIGOROUS PLANT GROWTH. IT SHALL COMPLY WITH MNDOT SPECIFICATION 3877 TYPE B
SELECT TOPSOIL. MIXTURE SHALL BE FREE FROM HARDPACK SUBSOIL, STONES,
CHEMICALS, NOXIOUS WEEDS, ETC. SOIL MIXTURE SHALL HAVE A PH BETWEEN 6.1 AND 7.5
AND 10-0-10 FERTILIZER AT THE RATE OF 3 POUNDS PER CUBIC YARD. IN PLANTING BEDS
INCORPORATE THIS MIXTURE THROUGHOUT THE ENTIRE BED IN A 6" LAYER AND
ROTO-TILLING IT INTO THE TOP 12" OF SOIL AT A 1:1 RATIO.ANY PLANT STOCK NOT PLANTED
ON DAY OF DELIVERY SHALL BE HEELED IN AND WATERED UNTIL INSTALLATION. PLANTS NOT
MAINTAINED IN THIS MANNER WILL BE REJECTED.
17.CONTRACTOR SHALL BE RESPONSIBLE TO VERIFY THAT EACH EXCAVATED TREE AND SHRUB PIT
WILL PERCOLATE PRIOR TO INSTALLING PLANTING MEDIUM AND PLANTS. THE CONTRACTOR
SHALL FILL THE BOTTOM OF SELECTED HOLES WITH SIX INCHES OF WATER AND CONFIRM THAT
THIS WATER WILL PERCOLATE WITHIN A 24-HOUR PERIOD. IF THE SOIL AT A GIVEN AREA DOES
NOT DRAIN PROPERLY, A PVC DRAIN OR GRAVEL SUMP SHALL BE INSTALLED OR THE PLANTING
SHALL BE RELOCATED IF DIRECTED BY THE LANDSCAPE ARCHITECT.
18.ALL PLANTS SHALL BE GUARANTEED FOR TWO COMPLETE GROWING SEASONS (APRIL 1 -
NOVEMBER 1), UNLESS OTHERWISE SPECIFIED. THE GUARANTEE SHALL COVER THE FULL COST OF
REPLACEMENT INCLUDING LABOR AND PLANTS.
19.CONTRACTOR SHALL NOTIFY THE LANDSCAPE ARCHITECT AT LEAST 3 DAYS PRIOR TO PLANNED
DELIVERY. THE CONTRACTOR SHALL NOTIFY THE LANDSCAPE ARCHITECT AT LEAST 24 HOURS IN

REMOVAL OF DEAD MATERIALS, RE-SETTING PLANTS TO PROPER GRADE AND KEEPING PLANTS IN
A PLUMB POSITION. AFTER ACCEPTANCE, THE OWNER SHALL ASSUME MAINTENANCE
RESPONSIBILITIES. HOWEVER, THE CONTRACTOR SHALL CONTINUE TO BE RESPONSIBLE FOR
KEEPING THE TREES PLUMB THROUGHOUT THE GUARANTEE PERIOD.

ORGANIZATION THAT IS REVIEWING THE HABIT FRIENDLY SOLAR STANDARDS.
2.ALL SEED THAT IS SUPPLIED FOR PROJECTS MUST BE LABELED ACCORDING TO THE REQUIREMENTS OF THE MINNESOTA SEED
LAW, SECTION 21.82, INCLUDING LIMITS ON NOXIOUS WEED SEED.
3.THE ORIGIN OF SEED IS REQUIRED TO BE LISTED ON THE SEED TAG FOR ALL SPECIES IN A MIX TO PROVIDE VERIFICATION OF
ORIGINAL (GENERATION 0) SEED SOURCE. THE SMALLEST KNOWN GEOGRAPHIC AREA (TOWNSHIP, COUNTY, ECOTYPE REGION,
ETC.) SHALL BE LISTED.
O INFORMATION PERTAINING TO PURE SEED, GERMINATION, AND HARD (DORMANT) SEED OF INDIVIDUAL COMPONENTS IN
A MIX IS REQUIRED ON SEED TAGS.

TESTS. IF AMARANTH SPECIES ARE FOUND IN THE TEST RESULTS, THE MINNESOTA DEPARTMENT OF AGRICULTURE (MDA)
REQUIRES THAT THE VENDOR PAY FOR GENETIC TESTING TO DETERMINE IF THE AMARANTH SEEDS PRESENT ARE PALMER

6.ALL SEED DELIVERED TO SITES MUST HAVE A COMPLETE LABEL AND INCLUDE INFORMATION ABOUT INDIVIDUAL COMPONENT
SEED LOTS. INSTALLERS MUST ALLOW MDA STAFF TO TAKE SEED SAMPLES WHEN THEY ARRIVE FOR A RANDOM INSPECTION.
SITE PREPARATION SPECIFICATIONS
1.SEEDING CAN ONLY BE CONDUCTED AFTER ALL GRADING, CONSTRUCTION ACTIVITIES AND SITE PREPARATION ARE
COMPLETED.
2.TREAT ANY WEEDS LOCATED WITHIN THE AREA TO BE SEEDED WITH GLYPHOSATE HERBICIDE. CONDUCT A SECOND HERBICIDE
TREATMENT IF WEEDS CONTINUE GROWING AFTER TEN DAYS. AN HERBICIDE THAT KILLS LEGUMES MAY ALSO BE USED IF NEED
BUT SHOULD ONLY BE APPLIED WHERE NEEDED AS THESE CHEMICALS CAN OFTEN INHIBIT GERMINATION. WAIT AT LEAST 14
DAYS AFTER HERBICIDE APPLICATION TO CONDUCT TILLING.
3.PRIOR TO SEEDING, PREPARE THE SOIL SURFACE TO PROVIDE A SMOOTH, MOIST, AND EVENLY TEXTURED FOUNDATION. USE
CULTIVATING EQUIPMENT SUCH AS DISKS, HARROWS, FIELD DIGGERS, OR TILLERS CAPABLE OF LOOSENING THE SOIL TO A
DEPTH OF AT LEAST 4 IN. ON ALL AREAS. TILL THE SOIL SURFACE TO REMOVE TRACK IMPRINTS FROM WHEELED OR TRACKED
EQUIPMENT. OPERATE CULTIVATING EQUIPMENT ON SLOPES AT RIGHT ANGLES TO THE DIRECTION OF SURFACE DRAINAGE.
SOIL CLODS, LUMPS, AND TILLAGE RIDGES 3 IN. HIGH OR LESS MAY REMAIN IN PLACE FOR SEEDING OPERATIONS. MULTIPLE
PASSES OF THE EQUIPMENT MAY BE NEEDED TO MEET THESE REQUIREMENTS.
4.SEEDING SHOULD BE CONDUCTED AS SOON AFTER TILLING AS POSSIBLE. A SECOND TILLING MAY BE NEEDED IF THERE IS MORE
THAN TWO WEEKS BETWEEN TILLING AND SEEDING AND WEEDS ARE STARTING TO GROW.
SEEDING SPECIFICATIONS
5.SEEDING DATES INCLUDE MAY 15TH - JUNE 30TH IN THE SPRING, OR OCTOBER 15TH - FROZEN GROUND IN THE FALL. PROJECT
PLANNING AND DESIGN STAFF MUST PROVIDE WRITTEN APPROVAL TO CONDUCT SEEDING OUTSIDE OF THE RECOMMEND
TIME PERIODS.
6.SEEDING CONTRACTOR IS RESPONSIBLE FOR DISTRIBUTING SEED ACROSS THE ENTIRE PROJECT AREA AS SPECIFIED IN THE
PROJECT PLAN AND SPECIFICATIONS.
7.WHERE ACCESSIBLE WITHIN THE PROJECT SITE A NATIVE SEED DRILL WITH BOXES FOR DIFFERENT SIZE SEED (SUCH AS A TRUAX
OR TRILLION TYPE SEEDER) WILL BE USED FOR SEED INSTALLATION. WHERE A SEEDER CANNOT ACCESS THE SITE BROADCAST
SEEDING THAT IS CONDUCTED IN A WAY THAT ENSURES AN EVEN DISTRIBUTION OF SEED MUST BE CONDUCTED FOLLOWED BY
RAKING, ROLLING OR OTHER METHODS TO ENSURE THAT THERE IS SUFFICIENT SEED TO SOIL CONTACT.
8.IF HYDROSEEDING WILL BE CONDUCTED WHERE BROADCAST SEEDING IS REQUIRED CONDUCT SEEDING BY APPLYING SEED
WITH ONLY WATER FIRST BEFORE PLACING HYDRAULIC EROSION CONTROL PRODUCTS (HYDRO-MULCHING). THE SOLAR
ARRAYS MUST BE PROTECTED USING METHODS INCLUDING APPROPRIATE SHIELDS, COVERS AND AVOIDANCE MEASURES.
ACCIDENTAL OVERSPRAY MUST BE CLEANED UP AT THE TIME OF INSTALLATION.
9.APPLY CERTIFIED WEED FREE STRAW MULCH (TYPE 3) OVER THE SEEDED AREAS AND DISC ANCHOR WHERE POSSIBLE EXCEPT
WHERE EROSION CONTROL BLANKET OR OTHER EROSION CONTROL DEVICES ARE USED AS DEFINED IN THE EROSION CONTROL
SPECIFICATIONS.
10.USE TEMPORARY EROSION CONTROL DEVICES (SEDIMENT LOGS, SILT FENCE) AS NEEDED TO PREVENT EROSION PRIOR TO AND
DURING SEED ESTABLISHMENT.
11.IF A COVER CROP IS NOT INCLUDED WITH SPECIFIED SEED MIXES FOR THE PROJECT INCLUDE A COVER CROP OF OATS AT A

GROWING SEASONS FLAIL MOW (OR BY USING HAND HELD EQUIPMENT AS NEEDED) NATIVE VEGETATION IN MAY EACH
SEASON.
5.AVOID THE USE OF HERBICIDE DURING TIMES WHEN TARGET SPECIES AND ADJACENT SPECIES ARE IN BLOOM.
6.ANY AREAS OVER 100 SQUARE FEET WITH SPARSE ESTABLISHMENT (LESS THAN ONE NATIVE PLANT EVERY 1.5 FEET ON
AVERAGE) AFTER THE FIRST FULL GROWING SEASON WILL REQUIRE RE-SEEDING. WITH THE ORIGINAL SEED MIXES SPECIFIED
FOR THE PROJECT.
7.THE SEEDING WILL BE SUCCESSFULLY ESTABLISHED WHEN THE AREA HAS A 90% AREAL COVERAGE OF NATIVE PLANT SPECIES.
8.IF FLOWER DIVERSITY DECREASES OVER TIME INTER-SEED FLOWERS INTO THE PLANTING IN LATE FALL WITH SPECIES SUCH AS
BERGAMOT, PRAIRIE CLOVERS, YELLOW CONEFLOWER, ASTERS, COREOPSIS AND WILD MINTS. PRESCRIBED BURNING
FOLLOWING A BURN PLAN CAN ALSO BE USED OUTSIDE OF THE ARRAY AREAS AS A WAY TO MAINTAIN FLOWER DIVERSITY.

SUBMITTAL:
The following review comments were generated from plans dated 6/24/2019 and prepared by
Sambatek:

GENERAL COMMENTS:
1. The applicant shall submit civil plans signed by a professional engineer, licensed with the
State of Minnesota.
2. The applicant shall include an existing conditions survey of the project area in their plan set.
UTILITIES:
An 80-foot, Drainage & Utility (D&U) Easement bisects the property. The City owns a 30” sanitary
sewer pipe and a 30” storm sewer pipe within the easement, both approximately 35 feet deep. The
proposed plan will place solar panels on both sides of the easement, connected by buried electrical
cables. An 8” watermain runs through the property to serve the existing building and hydrants
onsite.
3. The applicant shall enter into an encroachment agreement for the electrical cables buried
within the D&U easement, prior to construction.
4. The applicant shall register buried cables with Gopher State One Call for locating.
5. The existing conditions survey shall show the location of water utilities within the project
area.
6. The applicant shall not place solar panels above the 8” waterline.
GRADING & STORMWATER COMMENTS:
The applicant plans to seed the area underneath the solar panels with a native mix rather than paved
or gravel surface.
7. The applicant shall provide a drainage map and stormwater management information to
confirm that the runoff from this proposal can be accommodated in the existing pond
#1637 and adjacent infiltration basin #1671.
8. The applicant is required to obtain a NPDES Construction Stormwater Permit and provide a
copy of the approved SWPPP to the City prior to the start of any construction activity.
9. A grading permit is required prior to starting grading on site.
