ATTACHMENTS: Change Order 1 APPROVED BY: LJM RECOMMENDED ACTION: Motion to approve Change Orders 1 for adjusted pricing on 132nd Street Improvements, City Project 465. BACKGROUND On September 5, 2017, City Council awarded the construction contract for 132nd Street Improvements, City Project 465 to Friedges Contracting. The project was anticipated to start in fall of 2017, however, MnDOT permitting delays prevented starting this project during the 2017 construction season. The permit was obtained on October 19, 2017. Construction was not completed in 2018 due to issues with small utilities that were obstructing the installation of a sanitary sewer stub to the north. This 30-foot deep sanitary pipe required relocation of three utility lines: an Xcel gas line, a Dakota County fiber and an Independent School District 196 fiber line. City staff held several onsite meetings with the small utilities and the contractor, including negotiations and working with both the MN Office of Pipeline Safety and Friedges Contracting’s performance bonding company to ensure the project would move forward. Work on site is anticipated to start in August 2019 and be substantially complete by October 31, 2019. As nearly two years have passed since the initial bid, the contractor is requesting unit price increases to accommodate labor, equipment, trucking and material unit price increases. Based on the estimated quantities, this equates to an increase of $34,432.90. These delays have been outside of the contractor’s control, therefore, staff is recommending this request to Council for approval to begin the project. COSTS & FUNDING The original bid price of the project was $288,075.20. With the change order of $34,432.90, the contract price will increase to $322,508.10. There are two assessments associated with the project. The first is the Dunmore development to the south of 132nd Street and was included in the 1st and 2nd phases’ subdivision agreements based on the Feasibility Study’s estimated 132nd Street costs. The 3rd phase of Dunmore’s subdivision agreement development fee will reflect increases or decreases in surface and watermain project costs. The second assessment is to the Hanson’s at 2925 132nd Street West, on the north side of the street. An assessment agreement was approved at the October 6, 2015 City Council Meeting so that a portion, $10,000, will be assessed with the project. This assessment is fixed and would not change based on construction cost.
