Agreement and Authorizing the Mayor and City Clerk to enter into this Agreement.
BACKGROUND
The Biscayne Business Park (Project 2019-11), located on the east side of Biscayne Avenue just north of
160th St (CSAH 46), is in the early stage of construction. However, until the construction of Biscayne Ave
(Project 2020-01), there is no city owned sanitary sewer service to this parcel. Water main was extended
down Biscayne Ave in 1999 in order to provide a ‘loop’ for the water main along CSAH 46. It was
assumed that a future sanitary sewer main would be extended down Biscayne to provide service as the area
developed. There is, however, an interceptor for the Metropolitan Council Environmental Service’s
(MCES) Empire treatment plant along Biscayne. A man hole for this interceptor is very near the location
of the Biscayne Business Park driveway access.
In order to facilitate the development of this parcel, a sanitary sewer connection is required. As a result
the attached agreement with MCES is being brought to City Council for approval in order to receive a
permit for that connection. Upon installation of the sanitary sewer main in Biscayne this temporary
connection will be removed and this subdivision will be connected to the city owned main.
The City Attorney has reviewed this agreement and had no comments regarding the verbiage.
RECOMMENDATION
The attached agreement has been reviewed with no additional comments by the City Attorney. Staff
recommends City Council approve the attached agreement and authorize the Mayor and City Clerk to
enter into this agreement.

METROPOLITAN COUNCIL ENVIRONMENTAL SERVICES
SEWER CONNECTION AND MAINTENANCE AGREEMENT
Connection Permit No. 1979, MCES Interceptor No. 9208
THIS AGREEMENT made and entered into this 20th day of August, 2019, by and between the
City of Rosemount, a Minnesota Municipal Corporation, its successors and assigns and the
Metropolitan Council, a public corporation and political subdivision of the state,
WHEREAS, Rosemount shall be connecting its sanitary sewer collection system to the
Metropolitan Council Environmental Services Interceptor No. 9208; and
WHEREAS, the only feasible connection to the interceptor will involve an inside drop section on
Metropolitan Council Environmental Services Maintenance Structure No. 147; and
WHEREAS, Rosemount must obtain a connection permit from the Metropolitan Council
Environmental Services; and
WHEREAS, the Metropolitan Council Environmental Services requires the following as a
condition of the permit:
1. Rosemount assumes the responsibility of possible added costs involved in
maintaining the interceptor due to the inside drop connection and reimbursing the
Metropolitan Council Environmental Services for same.
2. That the connection in the Maintenance Access Structure No. 147 shall be installed
pursuant to applicable codes and comply with Metropolitan Council Environmental
Services sewer connection permit requirements.
NOW THEREFORE, IT IS MUTUALLY AGREED AS FOLLOWS:
1. Rosemount here receives from the Metropolitan Council Environmental Services the
right to connect at the City's sole cost and expense, via Maintenance Access Structure
No. 147, to the Metropolitan Council Environmental Services' sewer system.
2. That the sewer hook-up from the building to the connection or from the existing local
sewer system to the connection shall be installed to comply with municipal
subdivision sewer specifications and other applicable code.

20th day of August, 2019.
