I. Regular Meeting
Call to Order:
Pursuant to due call and notice thereof, the Regular Meeting of the Planning Commission was held on Tuesday,
September 24, 2019. Chair Kenninger called the meeting to order at 6:30 p.m. with Commissioners Schmisek, Reed,
Rivera, Lundquist, VanderWiel and Freeman. Also, in attendance were Community Development Director Lindquist,
Planner Nemcek and Recording Secretary Bodsberg.
The Pledge of Allegiance was said.
Additions to Agenda: None.
Audience Input: None.
Consent Agenda:
a. Approval of the August 27, 2019, Regular Meeting Minutes.
MOTION by Schmisek.
Second by Lundquist.
Ayes: 5. Nays: 0. Freeman and VanderWiel abstained because they were absent from the August 27th meeting.
Public Hearing:
5.a. Request by Flint Hills Resources for an Interim Use Permit to Construct a Temporary Structure. (19-39-IUP)
Planner Nemcek gave a brief summary of the staff report for the Planning Commission.
Commissioner Reed inquired why the facility will be blast resistant. Nemcek clarified that the proposed facility will not
be blast resistant.
Public Hearing opened at 6:38 pm.
Public Comments:
Don Kern, Flint Hills Resources, explained that the tent will be used basically for storage to keep the products out of the
elements.
MOTION by Reed to close the public hearing.
Second by VanderWiel.
Ayes: 7. Nays: 0. Motion Passes
The public hearing was closed at 6:39 pm.
Additional Comments: None.
MOTION by Freeman to recommend approval of an interim use permit allowing flint hills resources to
construct a temporary building, subject to the following conditions:
1. The applicant shall ensure water draining off the tent does not create erosion of
the gravel surface. If erosion is observed, applicant shall take measures to
contain sediment, repair and prevent future occurrences.
2. The Interim Use Permit expires on December 31, 2029.
3. The applicant shall obtain required building and grading permits and shall
conform to all applicable building and fire codes.
4. The applicant shall pay property taxes on the structure based upon the value of
the proposed structure.
Second by Schmisek.

New Business
6.a. Fair Housing Policy
Planner Nemcek gave a brief summary of the staff report for the Planning Commission.
Commissioner Rivera inquired what the community engagements will include. Nemcek stated that this policy is just the
first step but that the information will be online.
Commissioner Reed inquired if some of the wording could be a little more active. Comm unity Development Director
Lindquist stated that the wording isn’t active because the City may not be the only one fulfilling various aspects of the
policy, some of our partners such as the Dakota County CDA will also.
Commissioner VanderWiel stated that by making the words more directive, it could be potentially harming or call into
question the City’s ultimate process.
MOTION by Lundquist to recommend that the City Council adopt the draft Fair Housing Policy.
Second by Freeman.
Ayes: 7. Nays: 0.
Adjournment: There being no further business to come before this Commission, Chair Kenninger adjourned the
meeting at 6:53 pm.
