ATTACHMENTS: Agreement APPROVED BY: LJM RECOMMENDED ACTION: Motion to approve an Encroachment Agreement with Lighthouse Christian Church located at 3285 144th St W BACKGROUND Lighthouse Christian Church, located at 3285 144th St W, installed a raingarden on their property in fall of 2019 with technical and financial assistance from the Dakota County Soil and Water Conservation District (DCSWCD). Lighthouse Christian Church and the surrounding neighborhoods were built in the late 1950’s and early 1960’s, prior to modern day stormwater requirements. The raingarden helps solve drainage issues on the property while also providing a water quality improvement. This voluntary project provides water quality treatment and volume control in an area that lacks space for installation of typical stormwater practices used by the City. The raingarden has three 6-inch overflow outlets that daylight into the Cantata Ave right-of-way. The outlets are required to allow the basin to drain within 48 hours and are designed to overflow without causing erosion. Installation of the raingarden was voluntary and not required under city regulations. Since this project provides stormwater improvements that benefit the City as a whole, granting minor encroachment into the City right-of-way is appropriate, and the grading permit fee for the project was waived. RECOMMENDATION Engineering staff recommends approval of the attached Encroachment Agreement with Lighthouse Christian Church.
