Regular Meeting Call to Order: Pursuant to due call and notice thereof, the Regular Meeting of the Planning Commission was held on Tuesday, October 22, 2019. Chair Kenninger called the meeting to order at 6:30 p.m. with Commissioners Schmisek, Lundquist, and VanderWiel. Absent was Rivera, Freeman and Reed. Also, in attendance were Community Development Director Lindquist, Planner Nemcek and Recording Secretary Bodsberg. The Pledge of Allegiance was said. Additions to Agenda: None. Audience Input: None. Consent Agenda: a. Approval of the September 24, 2019, Regular Meeting Minutes. b. Request by U.S. Home Corporation for Approval of a Final Plat for Prestwick Place 21 st Addition (19-42-FP). c. Request by U.S. Home Corporation for Approval of a Final Plat for Prestwick Place 22nd Addition (19-41-FP). d. Request by U.S. Home Corporation for Approval of a Final Plat for Meadow Ridge 3 rd Addition (19-44-FP). MOTION by VanderWiel. Second by Schmisek. Ayes: 4. Nays: 0. Public Hearing: 5.a. Request by Rosemount Lions Club for a Renewal of an Interim Use Permit Allowing a Seasonal Christmas Tree Sales Lot in the Parking Lot of the Rosemount Village Shopping Center . (19-43-IUP) Community Development Director Lindquist gave a brief summary of the staff report for the Planning Commission. Public Hearing opened at 6:34 pm. Public Comments: None. MOTION by VanderWiel to close the public hearing. Second by Schmisek. Ayes: 4. Nays: 0. Motion Passes The public hearing was closed at 6:35 pm. Additional Comments: None. MOTION by VanderWiel to recommend the City Council renew the Interim Use Permit (IUP) allowing a seasonal (Christmas tree) sales lot in the northwestern portion of the Rosemount Village Shopping Center Parking Lot (Cub Foods), subject to the following: 1. Conformance with all conditions outlined in the attached Interim Use Permit for 2019 through 2023. Second by Lundquist. Ayes: 4. Nays: 0. Request by Tracy Scott Liggett for a Variance from the Side Yard Setback Requirement for Driveways in the R1A-Low Density Residential Zoning. (19-40-V) Planner Nemcek gave a brief summary of the staff report for the Planning Commission. Chair Kenninger inquired about her concern about the president that they may be setting for future applicants. Nemcek stated there are already many homes that have rear garages and doesn’t see an issue with future applicants. Kenninger inquired that the neighbor’s is in support of the project. Nemcek stated that he spoke with both neighbors and they are both okay with approving the variance. The public hearing opened at 6:44 pm. Public Comments: None. MOTION by Schmisek to close the public hearing. Second by VanderWiel. Ayes: 4. Nays: 0. Motion Passes. The public hearing was closed at 6:45 pm. Additional Comments: Commissioner Lundquist inquired if other surrounding neighbors were notified and had concerns. Nemcek stated that because this is public hearing the surrounding neighbors were notified with a letter mailed to their home. MOTION by VanderWiel the Board of Appeals and Adjustments to adopt a Resolution Approving a Variance from the R1A-Low Density Residential Side Yard Setback for Driveways from five feet to zero feet at 3686 149th Street West. Second by Schmisek. Ayes: 4. Nays: 0. Motion Passes. MOTION by Lundquist to close the public hearing. Second by VanderWiel. Ayes: 4. Nays: 0. Motion Passes.
