HomeMy WebLinkAbout20191119 Regular Meeting ProceedingsROSEMOUNT CITY COUNCIL REGULAR MEETING PROCEEDINGS November 19, 2019 CALL TO ORDER Pursuant to due call and notice thereof a regular meeting of the Rosemount City Council was held on Tuesday, November 19, 2019, at 7:00 p.m. in the Council Chambers at City Hall, 2875 145th Street West, Rosemount. Mayor Droste called the meeting to order with Council Members Freske, Essler and Block attending. Staff present included the following; - City Administrator Martin - Public Works Director/City Engineer Erickson The Pledge of Allegiance was recited. APPROVAL OF AGENDA City Administrator Martin stated item 3.b., REST Annual Update, will be put on a future agenda as the presenter is unavailable this evening. Motion by Essler Second by Freske Motion to Adopt the Agenda as presented except item 3.b. to be removed. Ayes: 4. Nays: None. Motion carried. PRESENTATIONS, PROCLAMATIONS AND ACKNOWLEDGMENTS 3.a. Commendation of State Championship for Rosemount High School Marching Band Council members recognized the Rosemount High School Marching Band for their accomplishments at the State Championship. PUBLIC COMMENT Kevin Sieben, attorney for Green Leaf Tobacco Inc. Mr. Sieben spoke on behalf of Mr. Mirib of Green Leaf Tobacco which was recently cited for a violation of city ordinance for a third tobacco violation within a twenty-four-month period. Mr. Sieben is requesting for council to reconsider the proposed 7-day suspension. Mr. Sieben briefly discussed each violation and provided an explanation of why each violation occurred. RESPONSE TO PUBLIC COMMENT City Attorney Tietjen discussed the formality of the violation process and informed council of the potential action council could take this evening. Council requested staff put this tobacco violation item on a future council agenda to further discuss the violation and the process going forward. The future council item will request whether a hearing is necessary to determine the potential penalty for the violation. ROSEMOUNT CITY COUNCIL REGULAR MEETING PROCEEDINGS November 19, 2019 Brian Rohrenbach of 12485 Blanca Ave Mr. Rohrenbach questioned if there are any future plans for streetlight or paved roads within the Oakwood Estates neighborhood where Mr. Rohrenbach resides. RESPONSE TO PUBLIC COMMENT Director of Public Works/City Engineering Erickson took Mr. Rohrenbach’s contact details and will follow up with Mr. Rohrenbach regarding his questions once Mr. Erickson has had an opportunity to further investigate the questions brought forth this evening. Mike Anderson of Chili Avenue Mr. Anderson resides in a townhome off Chili Avenue and questioned if council has considered an odd/even street parking ordinance during the winter months versus the current ordinance which states no parking from 2 a.m. to 6 a.m. from November 1 to April 1. The current parking provisions make parking a challenge during the winter months as there is limited space available especially when Mr. Anderson has guests visit. RESPONSE TO PUBLIC COMMENT Director of Public Works/City Engineering Erickson explained the reasoning for the current ordinance. Mr. Erickson intends to review Mr. Anderson’s concern further to see if there is anything additional that can be done to help with the parking issue. CONSENT AGENDA Motion by Essler Second by Block Motion to Approve the Consent Agenda with item 6.d. Designation of Polling Places for 2020 Elections removed. a. Bills Listing b. Minutes of the November 4, 2019 Regular Meeting Proceedings c. Minutes of the November 4, 2019 Work Session Proceedings d. Designation of Polling Places for 2020 Elections e. Family Resource Center Project - Change Order #3 f. Lighthouse Christian Church Encroachment Agreement g. Flint Hills Athletic Complex - Change Order #5 h. Donation Acceptance – Police Equipment Fund Ayes: Block, Droste, Essler, Freske Nays: None. Motion carried. ROSEMOUNT CITY COUNCIL REGULAR MEETING PROCEEDINGS November 19, 2019 6.d. Designation of Polling Places for 2020 Elections Council member Block pulled this item for further information regarding the 2020 polling places. Council member Block questioned if there will be any changes to the polling locations as Rosemount continues to grow. City Clerk Fasbender explained that the city will have an opportunity to review the polling locations once the 2020 census takes place in April. Once this is completed the city will further investigate to see if changes need to be made to precincts and polling locations. Given the timing of the census, no changes will take place in 2020. Motion by Block Second Essler Motion to approve the attached resolution designating the seven polling places for the 2020 elections. Ayes: 4 Nays: None. Motion carried. UNFINISHED BUSINESS 8.a. Consider Adoption of Streetlight Ordinance Director of Public Works/City Engineer Erickson provided, and overview of the steps taken to adopt the street light utility ordinance and how the item before council tonight is the final step in the adoption process. If established, a Street Light Utility fee would be charged to each property owner, allowing the City to recover its costs for electricity and maintenance on the street light system. Staff intends to inform residents of the update via the city newsletter, website and social media. Council did request to review the information before the information is viewed by the public. Motion by Freske Second by Essler Motion to Adopt the Street Light Utility Ordinance Ayes: Droste, Essler, Freske, Block Nays: None. Motion carried. ANNOUNCEMENTS 10.a. Staff Updates City Administrator Martin highlighted future events; “Council Out and About” will be taking place at the tree lighting at the Steeple Center on November 23rd and the Rec Center Open House at the Rosemount Community Center on December 9th at 6:30 p.m. 10.b. Upcoming Community Calendar Mayor Droste reviewed the calendar of events and upcoming meetings for November. The next City Council work session and regular meeting will be held on Tuesday, December 3, 2019 starting at 5:00 p.m. ROSEMOUNT CITY COUNCIL REGULAR MEETING PROCEEDINGS November 19, 2019 ADJOURNMENT There being no further business to come before the City Council at the regular council meeting and upon a motion by Essler and second by Freske the regular meeting was adjourned at 7:45 p.m. Respectfully submitted, Erin Fasbender City Clerk
