Regular Meeting Call to Order: Pursuant to due call and notice thereof, the Regular Meeting of the Planning Commission was held on Tuesday, November 26, 2019. Chair Kenninger called the meeting to order at 6:30 p.m. with Commissioners Rivera, Freeman, Reed, Schmisek, Lundquist, and VanderWiel. Also, in attendance were Senior Planner Klatt, Planner Nemcek and Recording Secretary Bodsberg. The Pledge of Allegiance was said. Additions to Agenda: None. Audience Input: None. Consent Agenda: a. Approval of the October 22, 2019, Regular Meeting Minutes. MOTION by Schmisek. Second by Rivera. Ayes: 7. Nays: 0. Public Hearing: 5.a. Request by Danner, Inc. for a Renewal of their Small Scale Mineral Extraction Permit for 2020. (19-45-ME) Senior Planner Klatt gave a brief summary of the staff report for the Planning Commission. Commissioner Reed questioned who would hire the contractor to test the haul back brought to the mine. Klatt stated that the applicant would hire a firm to test the soil. Reed inquired if the City would get copied on the results of the tested soil. Klatt stated that the City does in fact get copied on the results. Public Hearing opened at 6:45 pm. Public Comments: Marlon Danner, Vice-President of Danner Inc., 843 Hardman Avenue South, South St. Paul, stated that Danner has been using this property for removing material for what they need to use on their construction projects. Mr. Danner stated that they had worked on some contaminated sites last year, but pointed out that they hauled the contaminated material to the SKB landfill under the guidance of Braun Intertec. There was no haul-back material brought to the Danner mine in 2019, only the removal of sand and gravel form the active mining area. Commissioner Reed questioned how Danner would know when a specific site is contaminated. Mr. Danner stated that the entire site was contaminated, and Braun Intertec always has an employee on site to help with monitoring sand destined for the landfill. MOTION by Freeman to close the public hearing. Second by VanderWiel. Ayes: 7. Nays: 0. Motion Passes The public hearing was closed at 6:50 pm. Additional Comments: None. MOTION by Reed to recommend the City Council renew the Danner, Inc. Small Scale Mineral Extraction Permit for 2020, subject to the terms and conditions in the attached Draft 2020 Conditions for Mineral Extraction. Second by Freeman. Ayes: 7. Nays: 0. Request by Flint Hills Resources for an Interim Use Permit for Sixty-Five (65) Blast Resistant Modules, Twelve (12) Blast Resistant Enclosures, and Two (2) Warehouse Tents. (19-46-IUP) Planner Nemcek gave a brief summary of the staff report for the Planning Commission. Chair Kenninger inquired if the warehouse tent that was approved earlier in 2019 has the same Interim Use Permit expiration date. Nemcek stated that it does indeed have the same date of December 31, 2029. Kenninger stated that that specific warehouse tent was excluded from taxes because that was not a condition of the permit. Nemcek stated that it actually was a condition of that approval as well. The public hearing opened at 6:58 pm. Public Comments: Don Kern, Flint Hills Resources Pine Bend, stated that he is available for any questions. MOTION by Freeman to close the public hearing. Second by Lundquist. Ayes: 7. Nays: 0. Motion Passes. The public hearing was closed at 6:59 pm. Additional Comments: Commissioner Reed stated that he appreciated the opportunity to visit Flint Hills and he was able to get a better understanding of their operation. MOTION by Freeman to recommend the City Council approve the Interim Use Permit for Sixty -Five (65) Blast Resistant Modules, Twelve (12) Blast Resistant Enclosures, and Two (2) Warehouse Tents, subject to the following conditions: 1. The interim use permit expires December 31, 2029. 2. The placement of the Blast Resistant Modules (BRMs), Blast Resistant Tents (BRTs) and temporary warehouses is limited to the areas shown on the Blanket Agreement Area map. No BRMs, BRTs or temporary warehouses are allowed within 300 feet of the Rich Valley Boulevard right -of-way. 3. The Heavy Industrial Site and Building Standards are wa ived to allow metal and fabric buildings within the areas shown on the Blanket Agreement Area map. No temporary metal or fabric buildings are allowed within 300 feet of the Rich Valley Boulevard right-of-way. 4. The applicant shall pay property taxes on the structures based upon their value. Second by VanderWiel. Ayes: 7. Nays: 0. Motion Passes. New Business 6.a. 2019 – 2029 City of Rosemount Capital Improvement Plan. (19-48-CIP) Senior Planner Klatt gave a brief summary of the staff report for the Planning Commission. MOTION by Reed to recommend the City Council renew the Danner, Inc. Small Scale Mineral Extraction Permit for 2020, subject to the terms and conditions in the attached Draft 2020 Conditions for Mineral Extraction. Second by Freeman. Ayes: 7. Nays: 0.
