RECOMMENDED ACTION: Motion to approve the attached advertising agreement with
the First State Bank of Rosemount to advertise on the two scoreboards at the Rosemount
Arena.
BACKGROUND
The 2020 CIP Budget includes funding for new scoreboards at the Rosemount Arena. The First State
Bank of Rosemount is interested in adverting on the scoreboards as they have since the building opened in
1994.
City staff have proposed that the bank would pay the City $30,000 to advertise on the scoreboards.
Payments will be $2,000.00 per year for years 1-15, $0 for years 16-20 for a 4’ x 4’ sponsor sign on the east
scoreboard and 4’ x 6’ sponsor sign on the west scoreboard. The City greatly appreciates First State
Bank’s willingness to advertise on the boards and assist with their replacement.
RECOMMENDATION
Staff is recommending the City Council approve the attached advertising agreement with the First State
Bank of Rosemount to advertise on the two scoreboards at the Rosemount Arena.

AGREEMENT FOR
ICE ARENA ADVERTISING SPACE
This Agreement made this 12th day of November, 2019 between

(hereinafter referred to as the "Advertiser")
The parties hereto agree as follows:
1. The City hereby leases to the Advertiser advertising space for the term of TWENTY years
commencing January 1, 2020 and ending December 31, 2039, for the rent of
$30,000. Payments will be $2,000.00 per year for years 1-15, $0 for years 16-20 for a 4’
x 4’ sponsor sign on the east scoreboard and 4’ x 6’ sponsor sign on the west scoreboard
at the Rosemount Arena, according to terms and conditions outlined herein.
2. The Advertiser agrees to pay rental as stated above, to the City of Rosemount at the
Rosemount Community Center/Arena located at 13885 South Robert Trail, Rosemount,
MN 55068, payable as follows $2,000 by December 31st of the each year as follows:
2019, 2020, 2021, 2022, 2023, 2024, 2025, 2026,
2027, 2028, 2029, 2030, 2031, 2032, 2033
3. The advertisement shall be professionally made and all costs associated with design,
painting, and creation will be the sole responsibility of the Advertiser. The Advertiser
will contract a 3 rd party to have the two (2) scoreboard signs created and installed. The
Advertiser agrees that it will permit the City to approve the advertisement and to reject
any advertisement that is or becomes, in the absolute discretion of the City, not suitable
for display in the Ice Arena. Advertiser is encouraged to seek City approval before
creating the advertisement. No advertisement is permitted that promotes tobacco or
alcoholic products, or is offensive in text or artwork, or that contains attac hments of a
personal, racial, sexual, religious or political nature, or is demeaning or discriminatory
toward any person or group on the basis of age, sex, race, ethnicity, religion, physical
appearance or disability.
4. The Advertiser agrees the maintenance and upkeep of the scoreboard signs shall be the
Advertiser ’s responsibility and in the event the signage shows signs of wear, or is
damaged destroyed or stolen, the Advertiser will immediately complete any necessary
repairs or replacements, at a time and to standards specified by the City.

5. The City reserves the right to cancel this Agreement at any time, without notice or penalty
or further liability to the Advertiser and agrees to refund to the Advertiser any monies
received from the Advertiser, pro-rated for the period of time affected by any said
cancellat ion. Advertiser agrees to waive all claims against the City for any cause that
may arise as a result of such cancellation.
6. The Advertiser acknowledges that this Agreement does not give it any right to enter the
Ice Arena for the purpose of viewing, altering or removing its advertisement at any time
except during regular Arena operating hours.
7. The Advertiser accepts total responsibility for the accuracy of any claims made in its
advertisement(s) and agrees to indemnify and save harmless the City and its elected
officials and employees from any claims, costs and liabilities against the City that may
arise as a result of any advertisement(s) displayed by the Advertiser.
8. The Agreement shall be governed by and interpreted under the laws of the State of
Minnesota and shall inure to the benefit of and be binding upon the parties hereto and
their respective successors and assigns.
