ATTACHMENTS: Ordinance with Hunting Map APPROVED BY: LJM RECOMMENDED ACTION: Continue Public Hearing and after taking testimony; Motion to Adopt an Ordinance Amending City Code 7-5-7 the Hunting Map BACKGROUND The City has an adopted hunting map which lays out what areas of the City allow hunting by bow, shotgun or neither. The last time the map was modified was in June 2017. Since that time there has been urbanized development approved on several of the parcels where hunting is permitted. The primary changes are in the Dunmore neighborhood and some parcels in the Akron Avenue area that are undergoing development or were approved for subdivision. At the public hearing in December, several people associated with the McMenomy property requested additional hunting rights on their property. The McMenomy property was designated on the map for restricted bow. Since the Council meeting staff has reviewed the hunting ordinance amendments and discovered that sometime between June 2017 and November 2018, the hunting map was modified in this area, apparently in error. The map removed many of the restricted bow and restricted shotgun designations, including properties owned by the McMenomy family. The map (attached) has been corrected to include the restricted bow and restricted shotgun areas generally consistent with the 2017 amendment. Additionally, the map does remove any parcels associated with urban development or approved development except for the school district owned property, which is removed but hasn’t received an approved site plan. The eastern 80 acres of the McMenomy property between their future development and the Bella Vista property has been designated for restricted bow. Chief Dahlstrom has discussed these changes with a McMenomy representative who is aware of the changes. The notice regarding modifications to the hunting ordinance has been published. The City Council is scheduled to continue the opened public hearing from December 3, 2019. With the modifications to the map, staff is requesting the Council approve the ordinance. RECOMMENDATION Staff recommends the Council continue the public hearing and approve the ordinance amendment if there are no substantive requests for modification. CITY OF ROSEMOUNT COUNTY OF DAKOTA STATE OF MINNESOTA ORDINANCE NO. ORDINANCE RELATING TO THE HUNTING MAP; AMENDING SECTION 7-5-7: HUNTING MAP OF THE ROSEMOUNT CITY CODE. THE CITY COUNCIL OF THE CITY OF ROSEMOUNT, MINNESOTA ORDAIN as follows: Section 1. Section 7-5-2. of the Rosemount City Code is amended as follows: 7-5-2: DESIGNATED AREAS: For purposes of regulating the use of bows and firearms within the city, all area within the corporate city limits is divided into certain restricted R and non-restricted NR areas. The area designated restricted bow and restricted shotgun, restricted bow, non-restricted, and no hunting are depicted in the approved Hunting Restrictions Map. Section 2. 7-5-7: HUNTING MAP The ordinance map will be replaced with the new Hunting Map dated January 3, 2020. Section 3. This ordinance shall be effective immediately upon its passage and publication according to law. [Underlined material is new.
