ATTACHMENTS: Resolution; Map; Affidavit of Mailing APPROVED BY: LJM RECOMMENDED ACTION: Motion to Adopt a Resolution Ordering the Improvement and the Preparation of Plan and Specifications for the Deepwoods Court Improvement Project, City Project 2020-03 BACKGROUND In the Spring of 2019, staff received a request from residents living on Deepwoods Court that the condition of their road be addressed. Deepwoods Court is listed in the 2019 - 2028 Capital Improvement Plan for rehabilitation in 2022. As the pavement condition rapidly deteriorated during the 2018/2019 winter, staff discussed possible repair and maintenance options with the City Council and was directed to move the project forward to construction in 2020. On April 25, 2019, city staff hosted a preliminary open house to discuss the residents’ concerns and possible options for improving the road condition of Deepwoods Court. On November 4, 2019, City Council ordered a Feasibility Report to examine the existing conditions, proposed improvements, costs and proposed assessments for the project. On December 5, 2019, city staff hosted an open house for the residents of Deepwoods Court. The residents expressed concerns about the road condition, drainage and a desire for curb and gutter installation. On December 17, 2019, the Rosemount City Council received the Feasibility Report and called for the Public Improvement Hearing, which is a necessary step under the Minnesota Statute Chapter 429. DISCUSSION Deepwoods Court is a rural cul-de-sac off McAndrews Road (CSAH 38) in the north western part of Rosemount. It was constructed in 1991 as a rural section 24-foot wide road with 2-foot gravel shoulders and ditches to convey stormwater. Short sections of curb and gutter have been installed in some areas. The pavement is experiencing numerous distresses including acute cracking and raveling that indicate pavement failure. In recent years, the City has performed significant potholing and patching on this roadway. This high-level of maintenance is anticipated to increase in frequency and scope as the pavement is nearing the end of its life. 2 The proposed project will reclaim the existing pavement and repave with four inches of asphalt to provide a new pavement surface. The shoulder would be reestablished with 2 feet of new gravel and spot repair will be done on damaged existing curb as needed. This project does not propose to install new curb and gutter as it would be outside the scope of a typical pavement rehabilitation project. For example, on a related project (121st Street/124th Court) the existing rural section will remain, the pavement will be reclaimed and the shoulder improved. Minor stormwater improvements will include culvert replacement and ditch re-grading of areas that have filled in over time. Along with a new crown surface on the road, this is anticipated to shed water off the roadway, preventing water damage to the pavement. Some additional stormwater improvements are being reviewed for inclusion in this project or as future standalone work. Based on comments at the December open house, city staff is aware that the residents may request curb and gutter installation for the full length of Deepwoods. If curb and gutter are added to the project, staff would recommend use of ribbon curb (a flat curb that would allow water to drain into the ditches). The added cost is estimated at $113,900. This would be a new improvement, which, per Rosemount Assessment Policy, would be assessed at 100% of the improvement cost. The proposed assessment per home would increase $14,237.50 for the installation of new curb. Staff would recommend Council require all properties within the project area enter a petition and waiver of the 429 process and agree to full assessment of the curb and gutter. The design of this could be included as an Additive Alternate for bidding and a final decision could be made on this at a future meeting. This street is outside the Metropolitan Urban Service Area (MUSA), so water and sanitary sewer improvements are not included in the scope of work. COSTS & FUNDING The estimated cost for the project is $296,300. This amount includes a 10% contingency and 25% incidentals such as engineering, legal, financing and administrative costs. The street improvements will be funded by the Street Improvement Fund and assessment of abutting properties. The storm utility work would be funded by the Storm Utility Fund. 3 PROJECT FUNDING ESTIMATE Street Capital Improvement Fund $169,300 Special Assessment $91,200 Storm Utility Fund $35,800 TOTAL $296,300 Per the Rosemount Special Assessment Policy, the assessment total is 35% of the estimated surface improvement cost: $260,500 * 35% = $91,175 rounded to $91,200 The assessments are proposed to be divided among the 8 properties that have driveway access to Deepwoods Court. The assessment is estimated at: $91,200 / 8 properties = $11,400 per property Please note, this is an estimate. The final assessment amount will be determined at a future assessment hearing and will be based on the actual bids received for the project. CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2020 - 06 A RESOLUTION ORDERING THE IMPROVEMENTS AND PREPARATION OF PLANS FOR DEEPWOODS COURT IMPROVEMENT PROJECT, CITY PROJECT 2020-03 WHEREAS, a resolution of the City Council adopted the 17th day of December, 2019, fixed a date for a Council hearing on City Project 2020-01 for the improvement of Deepwoods Court and; WHEREAS, ten days’ mailed notice and two weeks published notice of the hearing was given, and the hearing was held thereon on the 21st day of January, 2020, at which all persons desiring to be heard were given an opportunity to be heard thereon. NOW THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROSEMOUNT MINNESOTA: 1. Such improvement is necessary, cost-effective, and feasible as detailed in the feasibility report. 2. Such improvement is hereby ordered as proposed in the council resolution adopted 21st day of January, 2020. 3. Such improvement has no relationship to the comprehensive municipal plan. 4. WSB is hereby designated as the engineer for this improvement. The engineer shall prepare plans and specifications for the making of such improvement. 5. The city council declares its official intent to reimburse itself for the costs of the improvement from the proceeds of tax exempt bonds. ADOPTED this 21st day of January, 2020. William H.
