Adopt a Resolution Receiving Plans and Specifications and Authorizing the Advertisement for Bids for Biscayne Avenue Improvement Project, City Project 2020- 01. 2. Approve Resolution Authorizing Approval of Appraised Values, Offers of Compensation and Acquisition by Eminent Domain for Biscayne Avenue Improvement Project, City Project 2020-01. BACKGROUND With the current demand for trucking from the mining and construction in south-central Rosemount, development in the Business Park, along with anticipated future development of the University of Minnesota (UMORE) property, City Project 2020-01 is proposed to convert Biscayne Avenue from the existing rural gravel section to a paved section. The Biscayne Avenue road section will be three-lanes with a center turn lane. A right-turn lane will be constructed on westbound 160th Street (CSAH 46). The originally proposed 8-foot wide asphalt trail has been removed from this project to reduce right-of-way and construction costs. The trail will be constructed later, as right-of-way is dedicated with subdivision of the adjacent properties. Sanitary sewer will be installed from Boulder Trail to 157th Street (Biscayne Business Park) to provide City service to this area. Watermain stubs to undeveloped properties will be installed per the 2040 Comprehensive Water Plan. In order to treat runoff stormwater from the new impervious surface created by the project, a new infiltration basin is proposed along the west side of the roadway. On September 17, 2019, the Rosemount City Council received the Feasibility Report. Detailed project information is included in the Feasibility Report, which is available on file in the Engineering Department. The report found this project, as proposed, to be feasible, cost effective, and necessary. 2 On October 15, 2019, the Rosemount City Council held a Public Improvement Hearing on the project which is a necessary step under the Minnesota Statute Chapter 429. At that meeting, Council ordered the improvements and preparation of plans. RIGHT-OF-WAY & EASEMENTS The right-of-way (ROW) for Biscayne Avenue is largely prescriptive, with a portion of the west side platted with the Biscayne Business Park development. With this improvement project, additional ROW and temporary construction easements will be acquired to accommodate the wider road section and stormwater facilities. As of this time, it is staff’s understanding that all properties are open to negotiation and voluntary acquisition. The next step in the ROW process is for Council to direct staff and the City’s consultant, Henning Professional Services, to acquire the property. Council’s authorization will enable the City’s consultant to make offers consistent with independent appraisals and attempt to negotiate the acquisition for the ROW and easements. The resolution will also authorize the City’s Attorney to move forward with eminent domain proceedings for required ROW not acquired by voluntary negotiation. It is proposed to be funded in partnership with the University of Minnesota. Dakota County has agreed to cost participation on construction of the 160th Street (CSAH 46) right-turn lane. Staff is working with the County to finalize the level of funding anticipated. The City funding will include a combination of MN State-Aid funds, utility core funds, and special assessments of benefitting properties. The estimated assessments are based on special benefit appraisals. Further discussion will be held on this prior to the assessment hearing to be scheduled in the spring of 2020. 3 Funding Amount Water Core Fund $ 116,200 Sanitary Sewer Core Fund $ 307,800 Special Assessments / Other* $ 1,335,000 Minnesota State Aid Funding $ 2,039,300 Dakota County Cost Share TBD TOTAL PROJECT FUNDING $ 3,798,300 * Preliminary estimate, this amount may change based on special benefit appraisals due later February 5, 2019, City Council passed a resolution supporting submission of a Local Road Improvement Program (LRIP) Grant from the Minnesota Department of Transportation (MnDOT) in the amount $1,000,000. The grant was submitted on March 1, 2019. Unfortunately, for that grant cycle, no funding was available, but MnDOT was seeking applications in order to demonstrate the need for continued funding and support by the legislature. SCHEDULE Should the Council approve this resolution, the proposed project schedule is shown below. Items marked “CC” will require City Council approval in order to move forward with the project. Bid Opening March 10, 2020 CC Award Contract & Set Assessment Hearing March 17, 2020 Public Open House March 26, 2020 CC Assessment Hearing April 7, 2020 Construction Start May 2020 Substantial Completion Fall 2020 RECOMMENDATION Staff recommends Council adopt the attached resolutions accepting plans, authorizing advertisement for bids and acquisition of right-of-way and easements for the Biscayne Avenue Improvement Project, City Project 2020-01. CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2020 - 12 A RESOLUTION RECEIVING THE PLANS AND SPECIFICATIONS AND AUTHORIZING THE ADVERTISEMENT FOR BIDS FOR BISCAYNE AVENUE IMPROVEMENT PROJECT, CITY PROJECT 2020-01 WHEREAS, the City Council of the City of Rosemount has ordered the preparation of plans and specifications for Biscayne Avenue Improvement Project, City Project 2020-01, and such plans and specifications have been presented to this Council for approval: NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Rosemount, Minnesota: 1. Such plans and specifications are hereby approved and ordered placed on file in the office of the City Clerk. 2. The City Clerk shall prepare and cause to be inserted in the official City newspaper and the Finance and Commerce an advertisement for bids upon the making of such improvements under such approved plans and specifications for City Project 2020-01. 3. The advertisement shall be published in each of said publications at least once not less than three (3) weeks before the date set for opening bids, specifying the work to be done, stating the bids will be publicly opened on March 10, 2020 at 10:00 o’clock a.m. at the Rosemount City Hall in said City, and that no bids will be considered unless sealed and filed with the City Clerk and accompanied by a cash deposit, cashier’s check, bid bond or certified check payable to the City Clerk for five (5%) percent of the amount of such bid. 4. Droste, Mayor ATTEST: Erin Fasbender, City Clerk CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2020 - 13 A RESOLUTION AUTHORIZING APPROVAL OF APPRAISED VALUES, OFFERS OF COMPENSATION, AND ACQUISITION BY EMINENT DOMAIN FOR BISCAYNE AVENUE IMPROVEMENT PROJECT, CITY PROJECT 2020-01 WHEREAS, the City Council deemed it necessary and expedient that the City of Rosemount, Minnesota (the “City”) construct certain improvements of the Biscayne Avenue Improvement Project, City Project 2020- 01, (the “Project”) and by resolution, the City Council accepted the feasibility report, ordered improvements and has authorized preparation of plans and specifications for the Project; and WHEREAS, the Project includes upgrading and expanding the right-of-way associated with Biscayne Avenue in order to provide for better infrastructure as related to all methods of transportation; and WHEREAS, it is necessary to acquire certain real property interests, as described and depicted in Exhibit A attached hereto, in order to install and maintain the Project (collectively, the “Real Property Interests”); and WHEREAS, the City Council finds that it is reasonably necessary, proper, and convenient, and in the interest of the general welfare that the City acquire title to and possession of the Real Property Interests in furtherance of the Project; and WHEREAS, the City Council finds that the construction schedule for the Project makes it necessary to acquire title to and possession of the Real Property Interests prior to the filing of the final report of the condemnation commissioners to be appointed by the district court; and WHEREAS, the City has engaged independent real estate appraisers to provide the City with the appraisers’ opinions of damages caused by the City’s acquisition of the Real Property Interests needed for the Project. NOW THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROSEMOUNT MINNESOTA: 1. That the acquisition of the Real Property Interests is necessary and for a public purpose in furtherance of the Project; 2. That the proper City officers and agents are authorized and directed to acquire the Real Property Interests needed for the Project by voluntary negotiation and, if necessary, through the exercise of the power of eminent domain; 3. That the proper City officers and agents are authorized and directed to make offers of compensation to the respective landowners for the Real Property Interests needed for the Project consistent with Resolution 2020 - 13 2 the independent appraisals, and to attempt to negotiate the voluntary acquisition of the Real Property Interests; 4. That the law firm of Kennedy & Graven, Chartered, is authorized and directed to take all steps necessary on behalf of the City to acquire through eminent domain the Real Property Interests that are not acquired by voluntary negotiation, including filing an action in eminent domain and using the quick take procedure under Minn. Stat. § 117.042; 5. That the City Engineer is authorized to approve the appraised values for the Real Property Interests if the City Engineer determines that the independent appraisals adequately reflect the fair market values thereof for the purposes of Minn.
