RECOMMENDED ACTION: Motion to Adopt a Resolution Approving the Vacation of the
Easement along the Rear, Westside, of the Rosemount Plaza Shopping Center.
SUMMARY
Ron Clark Construction has requested the vacation of a 20’ easement along the rear, or west side, of the
Rosemount Plaza Shopping Center in order to facilitate redevelopment of the site with the construction of
The Morrison, a 124-unit apartment building. At one time the easement ran the entire length of the
redevelopment site, but the segment along the Shenanigan’s property had previously been vacated. With
the project approval there is no reason to retain the easement. The Assistant City Engineer has reviewed
the proposed vacation as well as the final plat in which new perimeter easements will be dedicated.
Required easement dedication is listed in engineer’s memorandum dated January 14, 2020 in the planning
approval.
RECOMMENDATION
Staff is recommending the Council adopt a resolution approving the easement vacation based on the
information provided by the applicant and reviewed in this report. The vacation request has been
published and proper notification conducted.

A RESOLUTION APPROVING THE VACATION OF A TWENTY FOOT EASEMENT ALONG
THE REAR OF THE ROSEMOUNT PLAZA SHOPPING CENTER
WHEREAS, the City of Rosemount received an application from Ron Clark Construction, 7500 West 78th
Street, Edina, MN (Applicant) for the Final Plat of The Morrison;
WHEREAS, on February 4, 2020, the City of Rosemount City Council reviewed and approved the Final
Plat for The Morrison; and
WHEREAS, the vacation of the existing twenty (20) foot easement along the rear of the Rosemount Plaza
shopping center legally described below is required before the Final Plat can be recorded for The Morrison;
and
WHEREAS, the City Council reviewed this request and conducted a public hearing on February, 4, 2020.
NOW, THEREFORE, BE IT RESOLVED, the Council of the City of Rosemount hereby approves the
Vacation of the Easement, legally described as:
The West 20.00 feet of Lots 47 and 48, and the West 20.00 feet of the Northerly 70.00 feet of Lot
61, all in Auditor's Subdivision No. 1, Rosemount, Dakota County, Minnesota.
Subject to the following conditions:
1. Recording of the Final Plat of The Morrison.
2. Compliance with all conditions detailed in the Engineer’s Memorandum dated January 14, 2020.
ADOPTED this 4th day of February 2020, by the City Council of the City of Rosemount.
