Motion to adopt a Resolution Approving a Minor Amendment to the Caramore Crossing Planned Unit Development Agreement allow Horton Single Family Home designs in place of the approved “Express” home designs. 2. Motion to Approve the Amended Caramore Crossing Planned Unit Development Agreement and Authorize the Mayor and City Clerk to enter into the Agreement. SUMMARY The City Council is being asked to consider a request from D.R. Horton, Inc., for a minor amendment to the approved PUD Agreement for Caramore Crossing to allow a change in the design for the planned “Express” home lots to a new style of housing called “Horton Single-Family Homes”. The proposed revision would allow for traditional one and two-story homes to be constructed on 130 lots within the subdivision in addition to the previously approved 47 association-maintained “Freedom” lots. The proposed single-family designs are attached to this report and would replace the designs previously included in the PUD agreement. By ordinance, City staff can approve minor amendments, however, because the PUD agreement is a contract between the developer and the City, Council approval is required. In this case, staff has modified the original PUD agreement to reflect the requested minor revision (all edits are marked in the document) which can then be executed and filed with the approved subdivision. This item has been reviewed by staff and recommended for approval, but has not been reviewed by the Planning Commission, consistent with the process outlined in the ordinance. ISSUE ANALYSIS Legal Authority A Minor Amendment to the Planned Unit Master Development Plan is a quasi-judicial decision because no City Code deviations are requested. Quasi-judicial decisions mean that the City Council is acting as a judge to determine if the regulations within the Comprehensive Plan, Zoning Ordinance and Subdivision Ordinance are being followed. 2 Plat Revisions The proposed home design amendment does not require any changes to the approved lots, roads, easements or infrastructure approved with the Caramore Crossing subdivision, nor does is impact any of the approved development standards including building setbacks, lot coverage, or other dimensional standards. The proposed home designs are very similar to other single-family developments in Rosemount and will provide a good range of housing choices along with the Freedom Homes within the subdivision RECOMMENDATION Staff is recommending approval of a minor amendment to the Caramore Crossing PUD agreement to allow the replacement of the “Express Homes” with the “Horton Single Family Homes” within the subdivision. CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2020- A RESOLUTION APPROVING A MINOR AMENDMENT TO THE CARAMORE CROSSING PLANNED UNIT DEVELOPMENT (PUD) AGREEMENT TO ALLOW REVISED SINGLE-FAMILY HOME DESIGNS WHEREAS, the Community Development Department of the City of Rosemount received a request from D.R. Horton, Inc., to amend the Caramore Crossing Planned Unit Development (PUD) Agreement to revise the housing designs for the single-family detached lots within the subdivision; and WHEREAS, staff has prepared and recommends approval of a Minor PUD Amendment to substitute the “D.R. Horton Single Family Home” designs for the previously approved “Express Home” designs; and WHEREAS, on March 17, 2020, the City Council of the City of Rosemount reviewed the application and staff recommendation. NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of Rosemount hereby approves the Minor Amendment to the Caramore Crossing Planned Unit Development Agreement to allow a revision to the housing designs allowed within the PUD. Horton, Inc. (hereinafter referred to as the “Declarant”); WHEREAS, Declarant is the owner of the real property as described on Attachment One, attached hereto and hereby made a part hereof (hereinafter collectively referred to as the “Subject Property”); and WHEREAS, the Subject Property is subject to certain zoning and land use restrictions imposed by the City of Rosemount (hereinafter referred to as the “City”) in connection with the approval of an application for a master development plan planned unit development for a residential development on the Subject Property; and WHEREAS, the City has approved such development on the basis of the determination by the City Council of the City that such development is acceptable only by reason of the details of the development proposed and the unique land use characteristics of the proposed use of the Subject Property; and that but for the details of the development proposed and the unique land use characteristics of such proposed use, the master development plan planned unit development would not have been approved; and 2 WHEREAS, as a condition of approval of the master development plan planned unit development, the City has required the execution and filing of this Declaration of Covenants, Conditions and Restrictions (hereinafter the “Declaration”); and WHEREAS, to secure the benefits and advantages of approval of such planned unit development, Declarant desires to subject the Subject Property to the terms hereof. NOW, THEREFORE, the Declarant declares that the Subject Property is, and shall be, held, transferred, sold, conveyed and occupied subject to the covenants, conditions, and restrictions, hereinafter set forth. 1. The use and development of the Subject Property shall conform to the following documents, plans and drawings: a. City Resolution No. 2019-XX, Attachment Two b. Overall PUD Master Development Plan and Preliminary Plat (Revised 1/3/19), Attachment Three c. PUD Master Plan and Preliminary Plat (Revised 1/13/19), Attachment Four d. Development and maintenance of structures and uses on the Subject Property shall conform to the following standards and requirements: a. Maintenance of the stormwater basin, infiltration basin and associated stormwater infrastructure necessary for the long term operation and function will be performed by the City. All other maintenance including but not limited to garbage collection, or landscape replacement or the like shall be the responsibility of the of the private property owners. All maintenance of the stormwater basin and infiltration basin shall be the responsibility of the City after the basins have been established. b. Maintenance and replacement of trees and landscaping other than that associated with the stormwater basin and infiltration basin described in standard a. shall be the responsibility of the adjoining homeowners’ association. c. The home design front elevation shall include a minimum of three and a half (3.5) feet of brick or stone wainscoting, excluding doors, windows or the wall behind the front porch; a front porch with railing that extends at least 30% of the width of the front elevation, including the garage; a side entry garage; or no more than 70% lap siding, excluding doors and windows. 4 e. Fences are not allowed in wetland buffers. f. All areas within the wetland buffers that do not have natural vegetation shall be seeded and established with a wetland buffer seed mix. 3. The Subject Property may only be developed and used in accordance with Paragraphs 1 and 2 of this Declaration unless the owner first secures approval by the City Council of an amendment to the planned unit development plan or a rezoning to a zoning classification that permits such other development and use. 4. In connection with the approval of development of the Subject Property, the following deviations from City Zoning or Subdivision Code provisions were approved: a. Section 11-4-5 F. 1. R-1 Minimum Lot Area: The minimum lot area of interior lots shall be 7,500 square feet. The minimum lot area of corner lots shall be 9,500 square feet. b. Section 11-4-5 F. 2 . R-1 Minimum Lot Width: The minimum lot width of interior lots shall be 55 feet. The minimum lot width of corner lots shall be 70 feet. c. Section 11-4-5 F. 4. R-1 Minimum Front Yard Setback: The minimum front yard setback shall be 25 feet. d. Section 11-4-5 F. 5. R-1 Minimum Side Yard Setback: The minimum side yard setback shall be 7.5 feet except in areas where existence of larger drainage and utility easements require additional setbacks. e. Section 11-4-5 F.9. R-1 Minimum Lot Coverage: The maximum lot coverage shall be fifty percent (50%) for lots less than 8,250 square feet in area, forty percent (40%) for lots between 8,250 square feet and 9,750 square feet in area, and thirty-five percent (35%) for lots over 9,750 square feet in area. 5 f. Section 11-2-15 F. Single-Family Detached Dwelling Requirements: The lots specified as “Freedom Lots” shall not be required to include certificates of survey providing for the location of an attached third garage stall, whether or not construction is intended. In all other respects the use and development of the Subject Property shall conform to the requirements of the Paragraphs 1 and 2 of this Declaration and the City Code of Ordinances. 5. This Declaration of Covenants and Restrictions provides only the Subject Property only master development plan planned unit development approval. Prior to the improvement or development of the Subject Property, beyond the rough grading, a final development plan planned unit development approval pursuant to Zoning Code Section 11-10-6 C. 5. of the Subject Property is required and an addendum filed with County Recorder to this Declaration of Covenants and Restrictions. 6. The obligations and restrictions of this Declaration run with the land of the Subject Property and shall be enforceable against the Declarant, its successors and assigns, by the City of Rosemount acting through its City Council. This Declaration may be amended from time to time by a written amendment executed by the City and the owner or owners of the lot or lots to be affected by said amendment.
