ATTACHMENTS: Resolution, Site Location Map, Easement Vacation Sketch APPROVED BY: LJM RECOMMENDED ACTION: Motion to adopt a Resolution approving the Vacation of the Drainage and Utility Easement. SUMMARY At its meeting on February 26, the Planning Commission recommended approval of a conditional use permit, a planned unit development master development plan, and simple plat for Equitably Acquired Properties, Inc., to construct a self-storage facility. The proposed plat will split the development site from a larger outlot, over which a blanket drainage and utility easement was dedicated at the time the site was originally subdivided. Perimeter drainage and utility easements will be dedicated in the development area when the plat is recorded, and a new blanket drainage and utility easement will be dedicated over the remaining outlot as shown on the final plat. The vacation notice was published and note sent per legal requirements. RECOMMENDATION Staff recommends approval of the drainage and utility easement vacation. CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2020-XX A RESOLUTION APPROVING THE VACATION OF A DRAINAGE AND UTILITY EASEMENT WHEREAS, the City of Rosemount received an application from Equitably Acquired Properties, Inc., for a conditional use permit, a planned unit development master development plan, and simple plat to construct a self-storage facility; WHEREAS, on March 17th, 2020, the City of Rosemount reviewed and approved the request; and WHEREAS, the vacation of the existing drainage and utility easement legally described below is required before the ROSEMOUNT CAR CLUB Final Plat can be recorded; and WHEREAS, the City Council reviewed this request and conducted a public hearing on March 17, 2020. NOW, THEREFORE, BE IT RESOLVED, the Council of the City of Rosemount hereby approves the Vacation of the Easement, legally described as: The drainage and utility easement dedicated over all of Outlot A, JJT BUSINESS PARK FIRST ADDITION Subject to the following conditions: 1. The recording of the ROSEMOUNT CAR CLUB final plat. 2. Compliance with all conditions detailed in the Engineer’s Memorandum dated February 26, 2020.
