RECOMMENDED ACTION: Motion to adopt a Resolution approving the Vacation of the
Drainage and Utility Easement.
SUMMARY
At its meeting on February 26, 2020, the Planning Commission approved a site plan review to allow Mark
Davis to construct a 12,650 square foot medical office building at 15265 Carrousel Way. There is an existing
drainage and utility easement along the eastern boundary of the site that allowed stormwater to flow along
the property line while the site, and the site adjacent, remained undeveloped.
Stormwater runoff will now be collected and directed to the City’s stormwater management system and the
oversized easement is no longer necessary. A perimeter easement that is consistent with City requirements
will remain, and it is shown on the attached vacation exhibit. The vacation request has been published and
notice sent to adjoining property owners.
RECOMMENDATION
Staff recommends approval of the drainage and utility easement vacation.

RESOLUTION 2020-XX
A RESOLUTION APPROVING THE VACATION OF A DRAINAGE AND UTILITY
EASEMENT
WHEREAS, the City of Rosemount received an application from Mark Davis for a site plan review to
construct a medical office building;
WHEREAS, on February 26, 2020, the City of Rosemount Planning Commission reviewed and approved
the site plan for the proposed medical office building; and
WHEREAS, the vacation of all but the eastern ten feet of the existing drainage and utility easement along
the eastern boundary of the development area legally described below is required before development can
occur; and
WHEREAS, the City Council reviewed this request and conducted a public hearing on March 17, 2020.
NOW, THEREFORE, BE IT RESOLVED, the Council of the City of Rosemount hereby approves the
Vacation of the Easement, legally described as:
That part of the drainage and utility easement over, under and across Lot 1, Block 1, SOUTH ROSE
PARK 3RD ADDITION, lying south of the north 140 feet, EXCEPT the west and south 10 feet
thereof, and also the east 5 feet thereof
Subject to the following conditions:
1. Compliance with all conditions detailed in the Engineer’s Memorandum dated February 26, 2020.
ADOPTED this 17th day of March 2020, by the City Council of the City of Rosemount.
