ATTACHMENTS: Resolution; Final Assessment Roll APPROVED BY: LJM RECOMMENDED ACTIONS: Motion to Adopt a Resolution Adopting the Assessment Roll for Biscayne Ave Improvement Project, CP 2020-01. BACKGROUND City Project 2020-01 is currently under construction and will convert Biscayne Avenue from the existing rural gravel section to a paved section. Sanitary sewer will be installed from Boulder Trail to 157th Street (Biscayne Business Park) to provide City service to this area. Watermain stubs to undeveloped properties will be installed per the 2040 Comprehensive Water Plan. In order to treat runoff stormwater from the new impervious surface created by the project, a new infiltration basin is proposed along the west side of the roadway. It is proposed to be funded in partnership with the University of Minnesota. Dakota County has agreed to cost participation on construction of the 160th Street (CSAH 46) right-turn lane. Staff is working with the University and County to finalize the level of funding anticipated. 2 The City funding will include a combination of MN State-Aid funds, utility core funds, development fees and special assessments of benefitting properties. See the attached assessment roll for the assessment amounts for individual properties. SCHEDULE Construction Ongoing CC Assessment Hearing June 2, 2020 Substantial Completion Fall 2020 Last lift of Paving/Restoration Summer 2021 RECOMMENDATION Staff will present an overview of the project and requests the Council open a public hearing to hear and pass upon all objections to the assessment roll. Staff recommends that Council adopt the attached resolution adopting the assessment roll for the Biscayne Avenue Improvement Project, City Project 2020-01. CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2020 - 73 A RESOLUTION ADOPTING THE ASSESSMENT ROLL FOR THE BISCAYNE AVENUE IMPROVEMENT PROJECT, CITY PROJECT 2020-01 WHEREAS, pursuant to proper notice duly given as required by law, the council has met and heard and passed upon all objections to the proposed assessment for Biscayne Avenue Improvement Project, City Project 2020-01, the improvement of Biscayne Avenue from 160th Street (CSAH 46) to Boulder Trail, NOW THEREFORE BE IT RESOLVED by the City Council of the City of Rosemount, Minnesota: 1. Such proposed assessment, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein included is hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it. 2. Such assessment shall be payable in equal annual installments extending over a period of 10 years, the first of the installments to be payable on or before the first Monday in January 2021, and shall bear interest at the rate of 3.45 percent per annum from the date of the adoption of this assessment resolution. To the first installment shall be added interest on the entire assessment from the date of this resolution until December 31, 2020. To each subsequent installment, when due, shall be added interest for one year on all unpaid installments. 3. The owner of any property so assessed may, at any time prior to certification of the assessment to the county auditor, pay the whole of the assessment on such property, with interest accrued to the date of payment, to the city treasurer, except that no interest shall be charged if the entire assessment is paid by October 31, 2020; and he/she may, at any time thereafter, pay to the city treasurer the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is made. Such payment must be made before November 15 or interest will be charged through December 31 of the next succeeding year. 4. On October 31, 2020, the City Clerk shall transmit a certified duplicate of this assessment to the county auditor to be extended on the property tax lists of the county. Such assessments shall be collected and paid over in the same manner as other municipal taxes. ADOPTED this 2nd day of June, 2020 William H.
