ATTACHMENTS: Resolution; Final Assessment Roll; Affidavit of Mailing APPROVED BY: LJM RECOMMENDED ACTION: Motion to adopt a Resolution Adopting the Assessment Roll for Deepwoods Court Improvement Project, City Project 2020-03 BACKGROUND In the Spring of 2019, staff received a request from residents living on Deepwoods Court that the condition of their road be addressed. At that time, Deepwoods Court was listed in the Capital Improvement Plan for rehabilitation in 2022. As the pavement condition rapidly deteriorated during the 2018/2019 winter, staff discussed possible repair and maintenance options with the City Council and was directed to move the project forward to construction in 2020. The Deepwoods Court Improvement Project, CP 2020-03, will consist of pavement reclamation, asphalt overlay and minor drainage improvements. Ribbon curb was added to the project at the resident’s request and shall be paid for by assessment. COSTS & FUNDING The following table shows the Total Project Cost and Total Project Funding for completing the work on Deepwoods Court. In accordance with the Rosemount Assessment Policy, surface improvements are assessed at 35% of the total cost. A portion of this assessment amount is for the resident-requested installation of ribbon curb on the project. The ribbon curb assessment was agreed to by all residents, through petition and waiver agreements. The City proposes unit assessment calculations, the same for all properties abutting the roadway. The assessment rate calculation is shown below: Surface Improvement Assessment: 35% * 235,429.35 = $82,400.27 $82,400.27 / 8 properties = $10,300.03 per property Ribbon Curb Assessment: $41,809.30 / 8 properties = $5,226.16 per property Total Proposed Assessment: $10,300.03 + $5,226.16 = $15,526.19 per property* SCHEDULE Should the Council approve this resolution, the proposed project schedule is shown below. Items marked “CC” will require City Council approval in order to move forward with the project. Construction Start Ongoing Public Hearing on Proposed Assessments July 21, 2020 CC Approve the Assessment Roll Substantial Completion Mid-August 2020 RECOMMENDATION Staff will present an overview of the project and requests the Council open a public hearing to hear and pass upon all objections to the assessment roll. Staff recommends that Council adopt the attached resolution adopting the assessment roll for the Deepwoods Court Improvement Project, City Project 2020-03. CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2020 - 82 A RESOLUTION ADOPTING THE ASSESSMENT ROLL FOR THE DEEPWOODS COURT IMPROVEMENT PROJECT, CITY PROJECT 2020-03 WHEREAS, pursuant to proper notice duly given as required by law, the council has met and heard and passed upon all objections to the proposed assessment for Deepwoods Court Improvement Project, City Project 2020-03, the improvement of Deepwoods Court, NOW THEREFORE BE IT RESOLVED by the City Council of the City of Rosemount, Minnesota: 1. Such proposed assessment, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein included is hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it. 2. Such assessment shall be payable in equal annual installments extending over a period of 10 years, the first of the installments to be payable on or before the first Monday in January 2021, and shall bear interest at the rate of 3.45 percent per annum from the date of the adoption of this assessment resolution. To the first installment shall be added interest on the entire assessment from the date of this resolution until December 31, 2020. To each subsequent installment, when due, shall be added interest for one year on all unpaid installments. 3. The owner of any property so assessed may, at any time prior to certification of the assessment to the county auditor, pay the whole of the assessment on such property, with interest accrued to the date of payment, to the city treasurer, except that no interest shall be charged if the entire assessment is paid by October 31, 2020; and he/she may, at any time thereafter, pay to the city treasurer the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is made. Such payment must be made before November 15 or interest will be charged through December 31 of the next succeeding year. 4. On October 31, 2020, the City Clerk shall transmit a certified duplicate of this assessment to the county auditor to be extended on the property tax lists of the county. Such assessments shall be collected and paid over in the same manner as other municipal taxes. ADOPTED this 21st day of July, 2020 William H.
