RECOMMENDED ACTION:
1. Close the Public Hearing on Assessments for Autumn Path Extension, City Project
2019-07 and decline levying assessment for this project.
2. Approve the Assessment Agreement between the City of Rosemount and the
property owners.
BACKGROUND
The Autumn Path Improvement Project, City Project 2019-07, consists of construction of a 42-foot
wide asphalt collector roadway with curb and gutter. Pedestrian facilities will include a trail on the
east side and sidewalk on the west side of the road. Storm pipe will be constructed to ponds within
the Bella Vista development. Raw and potable watermain will be installed along the road along with
some sanitary sewer.
As part of the assessment process, staff has provided an agreement to the property owners which
would allow the deferment of assessments up to 10 years interest free or until the subdivision of the
property, whichever occurs first. Staff has received notarized signature pages from all parties with
an ownership interest in the property as shown in the attached agreement. Since the agreement on
assessments has been signed by all owners, the assessment hearing can be closed, and Council need
not take any action to levy assessments against the parcel.
Staff would recommend that the attached agreement be approved by City Council and forwarded
for signature by the Mayor. Upon signature, staff will have this agreement recorded and a fully
executed copy will be sent to all property owners. Highlights of the agreement include:
1. Property owners agree to the assessment of $644,661.88.
2. Interest will not accrue on this assessment until 10 years have passed or the property is
subdivided.
3. This agreement runs with the land and the City of Rosemount will record said agreement.
RECOMENDATION
Staff recommends Council close the public hearing on assessments and take no further action
related to levying assessments on the property. Staff also recommends that the Council approve the
attached agreement as presented.
