ATTACHMENTS: Easement Termination Agreement, Site Location APPROVED BY: LJM RECOMMENDED ACTION: Motion to approve the easement termination agreement and allow the Mayor and City Clerk to enter into the agreement. BACKGROUND In 1964, the Village of Rosemount acquired an access easement over the northern twenty feet of the property located at 14540 Cameo Avenue in order to gain access to land that was at that time owned by the City. At the time a municipal building was to be constructed. Eventually, ownership changed, and the site was developed as the Kenrose Mall/Rosemount Plaza Shopping Center. Because an easement is recorded on the land (Kenrose Mall) rather than the individual grantee (Village of Rosemount), the current owners of the benefitting property may execute and record a termination of the easement. The City Attorney is recommending that the City also sign the termination of the easement to ensure no issues arise when the titles to the properties are examined in the future. Because the easement is not public in nature like a right of way or utility easement, the City does not need to go through the vacation process to approve the termination. RECOMMENDATION Staff is recommending approval of the easement termination agreement. This recommendation is based on information provided by the City Attorney and the developer of The Morrison apartments.
