ATTACHMENTS: Resolution APPROVED BY: LJM RECOMMENDED ACTION: Motion to Adopt a Resolution to Accept Adalyn Avenue, CP 2019-13 for Perpetual Maintenance. BACKGROUND Adalyn Avenue, City Project 2019-10, extended water and sanitary sewer south from Addison Avenue to the Connemara Trail – East Extension. Adalyn Avenue borders the County Development Authority (CDA) property and the Lennar property that has been platted as Prestwick Place 18th and 22nd Additions. COSTS & FUNDING Northern Lines was awarded the contract for construction on August 5, 2019 in the amount of $531,016.00 and completed the final bituminous wear course this summer. The final cost of the project based on actual quantities and contract modifications is $506,434.00 This project is funded via developers as directed in the Prestwick Place Cost Share Agreement. The project is now complete, and the contractor is in the process of obtaining all the necessary close out paper work. Upon submittal and acceptance of the administrative requirements final payment can be issued to the contractor. Those necessary items include, at a minimum, maintenance bonds, IC 134 Withholding Affidavit for Contractors and lien waivers. RECOMMENDATION Upon City acceptance of the work, the public improvements constructed as part of Adalyn Avenue, CP 2019-10, shall become City property. Staff recommends that City Council approve the resolution accepting the improvements for perpetual maintenance. CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2020 – 130 A RESOLUTION ACCEPTING PUBLIC IMPROVEMENT FOR ADALYN AVENUE, CITY PROJECT 2019-10 WHEREAS, the contractor has completed the required construction as per the scope of the contract, and; WHEREAS, the City received a concurrence from the engineer of record that the work has been completed in accordance with the approved plans and specifications and finds the improvements acceptable; WHEREAS, the contractor is completing all necessary administrative requirements to close out the contract. NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ROSEMOUNT, MINNESOTA: 1. The improvements completed under said agreement are hereby accepted for perpetual maintenance and ownership. 2. Final payment to the contractor is authorized once all required administrative requirements are completed and accepted by the City Engineer. ADOPTED this 15th day of December, 2020. William H.
