ATTACHMENTS: Resolution APPROVED BY: LJM RECOMMENDED ACTION: Motion to Adopt a Resolution to Accept Trunk Highway 3 Drainage Improvement Project, CP 2019-13 for Perpetual Maintenance. BACKGROUND The Minnesota Trunk Highway 3 (TH 3) Drainage Improvement Project, CP 2019-13 connected the Harmony development on the east side of TH 3 to the regional pond constructed within the Dunmore development west of TH 3. The City intends to use the existing MnDOT culvert under TH 3 to make this connection. Due to the culvert’s structural condition, MnDOT has required the City to line the culvert and make a piped connection to Rosemount’s stormwater system prior to crossing the MnDOT right-of-way. COSTS & FUNDING MnDOT has acknowledged this project will include improvement of TH 3’s drainage infrastructure. Therefore, MnDOT has agreed to provide some of the materials for the stormwater pipe and manhole structures at no cost to the City. Alcon Excavating, Inc. was awarded the contract in the amount of $159,580.35 for this work. The final cost for this work with final quantities is $164,971.02. The primary reason for the cost increase was the need for additional seeding and stabilization at the end of the construction. The project is now complete, and the contractor is in the process of obtaining all the necessary close out paper work. Upon submittal and acceptance of the administrative requirements final payment can be issued to the contractor. Those necessary items include, at a minimum, maintenance bonds, IC 134 Withholding Affidavit for Contractors and lien waivers. RECOMMENDATION Upon City acceptance of the work, the public improvements constructed in Trunk Highway 3 (TH 3) Drainage Improvement Project, CP 2019-13, shall become City property outside of the MnDOT right of way. Staff recommends that City Council approve the resolution accepting the improvements for perpetual maintenance. CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2020 – 131 A RESOLUTION ACCEPTING PUBLIC IMPROVEMENT FOR TRUNK HIGHWAY 3 DRAINAGE IMPROVEMENT CITY PROJECT 2019-13 WHEREAS, the contractor has completed the required construction as per the scope of the contract, and; WHEREAS, the City received a concurrence from the engineer of record that the work has been completed in accordance with the approved plans and specifications and finds the improvements acceptable; WHEREAS, the contractor is completing all necessary administrative requirements to close out the contract. NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ROSEMOUNT, MINNESOTA: 1. The improvements completed under said agreement are hereby accepted for perpetual maintenance and ownership. 2. Final payment to the contractor is authorized once all required administrative requirements are completed and accepted by the City Engineer. ADOPTED this 15th day of December, 2020. William H.
