Charitable Gambling Premise Permit Metro Baseball League E X E C U T I V E S U M M A R Y City Council Regular Meeting: January 5, 2021 AGENDA ITEM: Charitable Gambling Premise Permit Metro Baseball League AGENDA SECTION: Consent PREPARED BY: Erin Fasbender, City Clerk AGENDA NO. 6.l. ATTACHMENTS: Draft Resolution, 2019 MBL Recap APPROVED BY: LJM RECOMMENDED ACTION: Motion to adopt the draft Resolution approving the Charitable Gambling Premise Permit for Metro Baseball League at The Clover located at 14845 South Robert Trail. BACKGROUND Metro Baseball League (MBL) is requesting consideration for a Charitable Gambling Premise Permit at The Clover (previously Rudy’s Redeye Grill), 14845 South Robert Trail in Rosemount. Metro Baseball League is in the process of submitting their application with the State of Minnesota which requires approval from the City Council to proceed. The City's approval in the premises permit application process is to essentially sign-off on the fact that the applicant meets the requirements in City Code and consent to allow the organization to operate within Rosemount. Metro Baseball League has been in existence for 28 years in Minnesota and western Wisconsin. Metro Baseball League currently holds Gambling Premise Permit s in Burnsville, Eagan and Apple Valley. Metro Baseball League owns Minnesota Baseball Tournaments and run s approximately 380 tournaments annually. Metro Baseball League donates money to the league to keep costs down for players, uniforms, balls, umpires and scholarships for kids that cannot afford to pay for baseball . In the attachment, “2019 MBL Recap”; MBL notes the number of Rosemount MBL teams and tournaments in 2019. Due to COVID-19, there is very little 2020 data to provide. In total, 26 teams from Rosemount participated in the MBL, and 13 different tournamen ts were hosted here in 2019. Staff has reviewed their previous financial reports, and because they haven’t previously operated a charitable gambling premise in the City of Rosemount they have not expended the level of funds that will be required once a premise begins operation here. They are not required to achieve the 80% threshold until after they have begun operation in the City. Nancy Huber will serve as the gambling manager at The Clover. The Police Department has conducted the appropriate background check and determined that there are no issues that would disqualify the applicant from obtaining a gambling license. City code, section 3-7-4 requires that an organization conducting lawful gambling within the City expend eighty percent (80%) of gross profits derived from the site within the City on lawful purposes conducted or located within the City’s trade area. The State’s definition of “lawful purpose” is attached and includes a variety of expenditures that can be made to ensure the 80% threshold is achieved. The City’s trade area includes the City of Rosemount and all cities and townships that are contiguous to Rosemount. 2 To ensure compliance with the 80% trade area requirement, Metro Baseball League will submit a report annually to the City Clerk certifying that this requirement has been met. Should Metro Baseball League not meet the 80% requirement, then the City can report the violation to the Board. RECOMMENDATION Staff recommends approval of the above-stated motion.
