RECOMMENDED ACTION: Motion to adopt the draft Resolution approving the Charitable
Gambling Premise Permit for Irish Football Boosters at The Clover located at 14845 South
Robert Trail.
BACKGROUND
Irish Football Boosters is requesting consideration for a Gambling Premise Permit at The Clover located
at 14845 South Robert Trail in Rosemount. Irish Football Boosters currently holds a Gambling Premise
Permit at Celt’s and TOPS Tavern in Rosemount.
The previous premise permit application from the Metro Baseball League (MBL) was considered at the
January 5, 2020 regular meeting, and upon a motion made to approve the premise permit, the motion
failed 2-3.
Councilmembers requested staff review the trade area language in the City's current ordinance (expend eighty
percent annually of its lawful purpose expenditures on lawful purposes conducted or located within the city's trade area, which
shall include only the city of Rosemount and any city with a boundary contiguous to Rosemount). One idea that was
discussed was to potentially update the trade area to be confined to the Rosemount School District to
ensure proceeds have a local impact.
Upon meeting with the city attorney, there are limited options in State law for designating a trade area.
State statute requires the city’s ordinance must define the city’s trade area and the area must include at least
each city and township contiguous to the defining city. Nearby cities of Apple Valley and Lakeville have
no trade area requirements (and thus no local expenditure requirements), whereas Eagan defines the trade
area to include all contiguous cities and requires sixty percent of lawful purpose expenditures must be
within the trade area.
Based upon this information, an ordinance change confining the trade area to the Rosemount School
District or the City of Rosemount proper is not feasible based upon the statutory trade area requirement.
If the Council wishes to make a change, the only remaining option would be to establish no trade area,
which would seem to be contrary to the direction from the Council to ensure gambling expenditures are
spent locally.
The Clover provided proof that they had notified qualified organizations that have expressed written
interest in operating lawful gambling at The Clover. Irish Football Boosters and Metro Baseball League
were the two organizations to express interest. Upon denial of Metro Baseball League’s application at the
January 5, 2020 meeting; The Clover reached out to Irish Football Boosters to apply for a premise permit
at The Clover and The Clover has notified staff of their interest in moving forward with Irish Football
Boosters.
Irish Football Boosters must submit their application with the State of Minnesota which requires approval
from the City Council to proceed. Stacy Ratzlaff will serve as the gambling manager.
Upon review of the application and recent background checks conducted by our Police Department, there
are no issues that would disqualify the applicant from obtaining a gambling license.
RECOMMENDATION
Staff recommends approval of the above-stated motion.

A RESOLUTION APPROVING A CHARITABLE GAMBLING PREMISE PERMIT FOR
IRISH FOOTBALL BOOSTERS AT THE CLOVER 14845 SOUTH ROBERT TRAIL,
ROSEMOUNT
WHEREAS, the Irish Football Boosters has requested a Charitable Gambling Premise Permit at
The Clover, 14845 South Robert Trail in Rosemount; and
WHEREAS, such permits are issued by the Minnesota Gambling Control Board pursuant to
Minnesota Statutes 349.16; and
WHEREAS, Irish Football Boosters will be responsible for operating and managing the lawful
gambling activity on the premise and will comply with all applicable requirements of city code and
state statute; and
WHEREAS, Minnesota Statues 349.213, Subd. 2, provides local government approval or
disapproval of such applications prior to issuance of the permits; and
WHEREAS, Irish Football Boosters is a qualified organization;
THEREFORE, BE IT RESOLVED by the City Council of the City of Rosemount, hereby
approves the Charitable Gambling Premise Permit application submitted by the Irish Football
Boosters to conduct charitable gambling at The Clover, 14845 South Robert Trail, in Rosemount.
