Construction, Inc. for Deepwoods Court Improvements, City Project 2020-03 and Accepting
the Improvements for Perpetual Maintenance
BACKGROUND
In the Spring of 2019, staff received a request from residents living on Deepwoods Court that the
condition of their road be addressed. At that time, Deepwoods Court was listed in the Capital
Improvement Plan for rehabilitation in 2022. As the pavement condition rapidly deteriorated during the
2018/2019 winter, staff discussed possible repair and maintenance options with the City Council and was
directed to move the project forward to construction in 2020.
The Deepwoods Court Improvement Project, CP 2020-03, which was awarded April 21, 2020, consisted
of pavement reclamation, asphalt overlay and minor drainage improvements. Ribbon curb was added to
the project at the resident’s request and shall be paid for by assessment.
At this time, McNamara Construction, Inc. has completed all the improvements as detailed in the contract
and WSB and Associates has recommended acceptance and issuing the final payment for this work. Based
on final quantities, the cost of the work is $242,354.72 or 2.5% below the awarded amount of
$248, 666.67. The final payment is $77,530.94.
RECOMMENDATION
Staff recommends that the City Council adopt the attached resolution accepting the improvements and
authorizing final payment to McNamara Construction, Inc. for Deepwoods Court Improvements, City
Project 2020-03.

RESOLUTION 2021 – 05
A RESOLUTION ACCEPTING PUBLIC IMPROVEMENT
FOR DEEPWOODS COURT IMPROVEMENTS
CITY PROJECT 2020-03
WHEREAS, McNamara Construction, Inc. has completed the required construction as per the scope
of the contract, and;
WHEREAS, the City received a concurrence from WSB and Associates that the work has been
completed in accordance with the approved plans and specifications and finds the improvements
acceptable;
WHEREAS, the contractor has completed all necessary administrative requirements to close out the
contract.
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ROSEMOUNT, MINNESOTA:
1. The improvements completed under said agreement are hereby accepted for perpetual
maintenance and ownership.
2. Final payment to the contractor is authorized.

The City of Rosemount is in the process of closing out and accepting the street and
improvements for the Deepwoods Court Improvement Project.
The improvements, consisting of storm sewer improvements and street reconstruction by
reclamation and paving were designed and inspected by WSB in accordance with the City’s
Standard Specifications and Engineering Guidelines. The public improvements were constructed
by McNamara Contracting, Inc. Improvements were constructed in the summer of 2020.
McNamara Contracting has submitted the paperwork necessary for final payment including IC
134 contractor affidavit, Mechanic’s Lien Waivers, Maintenance Warranty and the signed final pay
voucher for final payment.
The final project cost is $242,354.72. Final Payment amount is $77,530.94.
WSB recommends approval and acceptance of the public improvements and final payment to
McNamara Contracting Inc. as indicated.
