SUMMARY The City Council is being asked to consider an application for a Conditional Use Permit to establish a commercial bakery within an existing industrial building located at 2500 158th Circle West. The owner of the building is looking to fill an existing vacant space within the newly constructed building with the proposed, commercial bakery, use. The commercial bakery would occupy 8,823 square feet within the larger 17,280 square foot structure. Staff is recommending approval of the request. Applicant & Property Owner(s): Valley Natural Foods Location: 2500 158th Circle West Area in Acres: 1.82 Acres Comp. Guide Plan Designation: BP – Business Park Current Zoning: BP – Business Park PLANNING COMMISSION ACTION The Planning Commission held a public hearing on February 23, 2021, to review the request and receive public comment. The Commission did not receive any public comments. The Commission inquired about sales to the public and the applicant confirmed this facility was for distribution but could occasionally have baked goods available for sale on special occasions. The site meets all the general CUP standards outlined in Section 11-10-7 of approval, and staff is recommending approval of the request to operate a commercial bakery. BACKGROUND The building located on the subject property was constructed in 2020 as a speculative multi-tenant industrial building. The site is located near the intersection of County Road 46 and Biscayne Avenue, and is the first building of a larger 8 building industrial project. It is situated in the midst of the larger Business Park area, with a mixture of vacant land, businesses, and agriculture uses adjacent to the site. 2 The site was re-zoned to Business Park Planned Unit Development, BP-PUD in 2019. The Planning Commission approved an application from Appro Development for a PUD to allow construction of an 18,000 square foot office, warehouse, and light manufacturing facility on an existing vacant parcel approximately 700 feet north of 160th Street and immediately east of Biscayne Avenue. In addition to the first building, the PUD included seven additional lots that would be developed in the future with a similar design and uses. The site will eventually be filled with multi-use industrial buildings provide warehouse, manufacturing, and office space opportunities to several differing users. Construction on the first building was completed in 2020. Valley Natural Foods is one of 3 tenants for this industrial building. ISSUE ANALYSIS Although the plans for the commercial bakery space will not expand the existing building in any manner, the proposed activity is considered a conditional use under the City’s current zoning requirements. The only external work includes the construction of a trash enclosure to house three 2-3-yard dumpsters. Trash enclosure material will match current on site. Interior improvements will include: new vestibule and waiting room; office, public restroom, commercial kitchen for bakery, warehouse, as well as support spaces for employees including break room and employee restroom. Zoning The site is guided for Business Park uses and zoned as a Business Park Planned Unit Development, BP-PUD. The purpose statement for this district reads as follows: Purpose and Intent: The purpose of the BP business park district is to provide for the establishment of corporate headquarters, businesses, healthcare offices and related professional and service uses that do not require outdoor storage in an environment that provides a high level of amenities including landscaping, preservation of natural features, and architectural standards. The proposed commercial bakery is specifically called out as a conditional use in the district. Overall, the expected impacts of the proposed use should be similar to the warehousing, wholesaling and distribution permitted uses. Conditional Use Permit Legal Authority. Conditional use permits (CUP) are considered quasi-judicial actions. In such cases, the City is acting as a judge to determine if the regulations within the Comprehensive Plan, Zoning Ordinance and Subdivision Ordinance are being followed. Generally, if the application meets these requirements it must be approved. Purpose. The purpose of conditional use permits is to allow for those uses which are not generally suitable by right within a given zoning district but may be suitable under some circumstances. The burden of demonstrating the proposed use meets the criteria for granting a conditional use permit and meeting all applicable standards lies with the applicant. As a conditional use, the commercial bakery is subject to the general CUP standards outlined in Section 11-10-7 as well as the standards specific to this use in Section 11-4-7 (C), of which there are none. These standards evaluate the City’s land use and zoning performance standards and the potential impact of the proposed use on the surrounding neighborhood; draft findings for each are provided below. 3 1. Will not be detrimental to or endanger the public health, safety, or general welfare of the neighborhood or the city. Finding: The proposed commercial bakery space will not be detrimental to the public health, safety, or general welfare of the neighborhood or the City of Rosemount. The use will function like other permitted Business Park uses. Other than the addition of a trash enclosure, no additional changes to the site are proposed, and all activity will be contained within the existing structure. 2. Will be harmonious with the objectives of the comprehensive plan and city code provisions. Finding: The subject property is guided Business Park Planned Unit Development, BP- PUD. City code dictates commercial bakery space is a conditional use in this zoning district. According to the comprehensive plan, the Business Park land use designation is intended to promote development of businesses with a large number of employees that offer wages to support an entire family and that are further constructed of high-quality buildings providing both beauty and tax base to the community. Establishments within the business park district are intended to have little or no outdoor storage, with the majority of the business activities occurring completely indoors. The proposed commercial bakery largely fits within the purpose of the land use designation. All business activities will take place in the enclosed space and the new facility will bring new employment with competitive wages to Rosemount. 3. Will be designed, constructed, operated, and maintained so as to be compatible or similar in an architectural and landscape appearance with the existing or intended character of the general vicinity and will not change the essential character of that area, nor substantially diminish or impair property values within the neighborhood. Finding: There are no changes planned to the exterior of the building that would alter the PUD approved in 2019. The applicant is proposing adding an additional trash enclosure that will match current enclosure on site. 4. Will be served adequately by existing (or those proposed in the project) essential public facilities and services, including streets, police and fire protection, drainage, structures, refuse disposal, water and sewer systems and schools. Finding: The existing industrial building is served adequately by existing essential public facilities and services. The adequately of existing essential public facilities and services does not differ from the 2019 PUD approval for the building. 5. Will not involve uses, activities, processes, material equipment and conditions of operation that will be hazardous or detrimental to any persons, property, or the general welfare because of excessive production of traffic, noise, smoke, fumes, glare or odors. Finding: The proposed use will not generate any additional external impacts that would be 4 expected from the Business Park and existing industrial building. The commercial bakery is compatible with the existing uses in the building and the adjacent property. The closest single-family residential structure is 500 feet from the proposed use and on the north side of the Business Park Planned Unit Development. All other surrounding uses are either agricultural or Business Park. 6. Will have vehicular ingress and egress to the property which does not create traffic congestion or interfere with traffic on surrounding public streets. Finding: All existing vehicular ingress and egress will remain as presently located on the site and comply with the City access spacing and design requirements. 7. Will not result in the destruction, loss or damage of a natural, scenic, or historic feature of major importance and will comply with all local, state, and federal environmental quality standards. These standards apply in addition to specific conditions as may be applied throughout this code. Finding: The zoning ordinance does not include specific standards for a commercial bakery. RECOMMENDATION Staff and the Planning Commission find that the request meets the conditions for approval and therefore recommend approval of a conditional use permit to operate a commercial bakery within an existing building at 2500 158th Circle West. This recommendation is based on the plans submitted by the applicant and the findings made in this report. CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2021- A RESOLUTION APPROVING A CONDITIONAL USE PERMIT (CUP) FOR A COMMERCIAL BAKERY AT 2500 158TH CIRCLE WEST WHEREAS, the City of Rosemount received an application for a Conditional Use Permit (CUP) from Valley Natural Foods; and WHEREAS, on February 23, 2021, the Planning Commission of the City of Rosemount held a public hearing to review the CUP application from Valley Natural Foods for a Commercial Bakery; and WHEREAS, the Planning Commission adopted a motion recommending that the City Council approve the CUP for Valley Natural Foods; and WHEREAS, on March 16, 2020, the City Council of the City of Rosemount reviewed the Planning Commission’s recommendation and the CUP application for a Commercial Bakery and found the application consistent with the conditions for approval of a permit. NOW, THEREFORE, BE IT RESOLVED, the Council of the City of Rosemount hereby approves the CUP for a Commercial Bakery. (21-02-CUP) Economic Development Coordinator Van Oss gave a summary of the staff report for the Planning Commission. Chair Kenninger inquired if the commercial bakery will have any sales for the residents. Van Oss stated that they have a retail establishment at their co-op in Burnsville. Commissioner Reed inquired about the disposal of food products in the business park area. Van Oss stated that the City did not have any concerns. The public hearing opened at 7:21 pm. Public Comments: Ralph Hale, 3410 125th Street, Burnsville, Manager at Valley Natural Foods. Kenninger inquired about the waste of foods. Mr. Hale stated that most of their trash is cardboard and wrappers. They have minimal food waste. The oils are barreled up and taken away by a company that they pay for . He did mention that on occasion there is some sales that occur at the premises for the public. MOTION by Kenninger to close the public hearing. Second by Marlow. Ayes: 6. Nays: 0. Motion Passes.
