As a conditional use, daycare facilities are subject to the general CUP standards outlined in Section
11-10-7 as well as the standards specific to daycare uses in Section 11-4-11.D. These standards
evaluate the City's land use and zoning performance standards, the potential impact of this use on
the surrounding neighborhood, and the applicable daycare licensing requirements. After reviewing
the applicant's plans in comparison with each of these standards, staff finds the proposed use meets
the conditional use permit requirements for daycare facilities in the C-2 district, subject to
conditions. These standards and staff findings for each are provided below.
1. Will not be detrimental to or endanger the public health, safety, or general welfare of
the neighborhood or the city.
Finding: The daycare facility will not be detrimental to the public health, safety, or general
welfare of the neighborhood or the City of Rosemount.
2. Will be harmonious with the objectives of the comprehensive plan and city code
provisions.
Finding: The comprehensive plan guides the subject property for commercial use and the
property is zoned C-2, Downtown Commercial. Daycare facilities are allowed as a
conditional use in the C-2 Downtown Commercial district, subject to conditions.
3. Will be designed, constructed, operated and maintained so as to be compatible or
similar in an architectural and landscape appearance with the existing or intended
character of the general vicinity and will not change the essential character of that
area, nor substantially diminish or impair property values within the neighborhood.
Finding: The proposed daycare facility will be located in an existing building and does not
prompt changes to the exterior appearance of the building.
4. Will be served adequately by existing (or those proposed in the project) essential
public facilities and services, including streets,police and fire protection, drainage,
structures, refuse disposal,water and sewer systems and schools.
Finding: The existing building is served adequately by existing essential public facilities and
services,with the exception of the required trash enclosure. The existing trash enclosure is
not functioning and the associated dumpster is stored outside. Staff recommends that a
condition of approval require the applicant to bring the existing trash enclosure into
compliance prior to issuance of a building permit.
5. Will not involve uses, activities,processes, material equipment and conditions of
operation that will be hazardous or detrimental to any persons,property, or the
general welfare because of excessive production of traffic, noise, smoke, fumes, glare
or odors.
Finding: Without the on-site outdoor play area, the daycare use will operate completely
within the existing building. As such,it will not involve activities that will be harmful to the
surrounding area.

6. Will have vehicular ingress and egress to the property which does not create traffic
congestion or interfere with traffic on surrounding public streets.
Finding: The site has adequate existing ingress and egress from both 145th Street West and
South Robert Trail. However,it should be noted that the subject property has shared
parking and access easements with the neighboring property (the First State Bank of
Rosemount). Any change in the use of or access to the shared parking area must be agreed
to by both property owners and reflected in the easement agreements.
The daycare CUP standards require daycare facilities to have a designated drop-off/pick-up
area. The applicants have elected to place the drop-off and pick-up area at the southern end
of the middle row of parking. Should traffic generation at the site increase, this location may
not be suitable for the short-term use intended.
7. Will not result in the destruction, loss or damage of a natural, scenic, or historic
feature of major importance and will comply with all local, state, and federal
environmental quality standards.
Finding: The proposed daycare facility will not result in the destruction,loss or damage of a
natural, scenic, or historic feature of major importance and will comply with all local, state,
and federal environmental quality standards.
8. These standards apply in addition to specific conditions as may be applied
throughout this code.
Finding: Daycare uses are also subject to the specific conditional use permit standards in
Section 11-4-11.D as outlined below.
In addition to the general conditional use permit standards reviewed above, the proposed use must
comply with the specific performance standards for daycare facilities. These standards along with
staff findings are detailed below.
1. Pick up and drop off areas shall be located on the site, and shall be designed to avoid
interference with traffic and pedestrian movements.
Finding: Staff recommends that a condition of approval require the applicant's plans
designate four drop-off/pick-up parking stalls as illustrated on the attached site map. These
four drop-off/pick-up stalls shall have signage designating them as "Drop-off/Pick-up
Only" stalls for the hours of 6 a.m. to 10:00 a.m. and 4:00 p.m. to 7:00 p.m.
2. Outdoor recreational areas shall be located and designed in a manner that mitigates
visual and noise impacts on any abutting residential parcels.
Finding: The applicant has revised their application to remove the on-site outdoor play area.
While there are no specific City standards for the size or location of an outdoor play area,
there are State requirements. These standards are detailed in Minnesota Rule Three, Child
Care Center Licensing. They require a minimum of 1,500 square feet and at least 75 square
feet per child. The outdoor play area must also be within 2,000 feet of the center and

enclosed if adjacent to traffic or other hazards, free of litter, and contain the required
outdoor "large muscle equipment." Both Central Park and Charlie Park are within the
required 2,000 foot distance requirement (see attached map). City staff is agreeable to the
applicant using one of these parks as their outdoor play area, subject to state approval.
Should the applicant wish to add an on-site outdoor play area sometime in the future, they
will be required to amend their existing conditional use permit. That amendment review
would re-examine the location, design, access, and safety issues raised with the outdoor play
area during the Planning Commission meeting on July 24, 2007.
3. Such facilities shall provide proof of all applicable state, county, and city licenses.
Finding: Originally, staff recommends that a condition of approval require the applicant to
submit copies all applicable state, county, and city licenses to the Planning Department for
inclusion in the application file prior to issuance of a building permit. The applicant explained that
this was problematic for them due to the fact that the state won't issue their license until
they have inspected their finished space. Therefore, staff amended this condition to be "prior
to issuance of a certificate of occupancy."
CONCLUSION
Staff recommends approval of a conditional use permit request from Jayme Macchitelli&Dr. Kurt
Walter-Hansen to allow a daycare facility without an on-site outdoor play area at the property
located at 2975 145th Street West, subject to the conditions outlined in the attached resolution. This
recommendation is based on the plan submitted by the applicant and the findings made in this
report.
RECOMMENDATION
• Motion to approve a resolution granting a conditional use permit for a daycare facility in the
existing building located at 2975 145th Street West without an on-site outdoor play area, subject
to conditions.

This Agreement made this day of
1988 by and between The First State Bank of Rosemount, a
Minnesota Corporation, hereinafter referred to as "Grantor" ;
and John James Loch and Ann E. Loch, husband and wife and
Leslie A. Blake and Patricia E. Blake, husband and wife , here-
inafter collectively referred to as "Grantees" .
WHEREAS , Grantor owns the following described property:

Forty-Four ( 144) feet of Lot Nineteen ( 19) and the East:
Twenty-Eight (28) feet of the West One Hundred Forty-Four
( 144) feet of the South Fifty-Five ( 55 ) feet of Lot 20 ,
Auditors Subdivision No. 1 , Rosemount, Minnesota , accord--
ing to the plat thereof now on file and of record in the
Office of the Register of Deeds in and for said County
and State.

County, Minnesota, according to the duly recorded plat
thereof.

other good and valuable consideration to it in hand paid by
the Grantees , the receipt and sufficiency of which is hereby
acknowledged, Grantor does hereby grant and convey to Grantees ,
their successors and assigns, forever, a permanent non-exclusive
easement for ingress and egress to Outlot A, South Robert:
Square, Dakota County, Minnesota , according to the duly recorded
plat thereof, over, across , on and through Premises A.
Grantor and Grantees do hereby agree to mutually maintain
and keep in good repair the easement premises , with each party
paying an equal share of the repair and maintenance costs .
Grantor and Grantees shall maintain at all times insurance
against claims for personal injury or property damage in an
amount not less than Five Hundred Thousand and No/100 Dollars
($500, 000. 00) with respect to any one injury and One Million
and No/100 Dollars ($1 , 000. 000 . 00) with respect to injuries
in any one accident , or in such larger amounts as may be
customary and reasonable . Grantor and Grantees shall provide
each other, respectively, with a Certificate of Insurance ,
evidencing insurance protection coverage in the amounts set
forth above, which Certificates of Insurance shall provide
for a thirty (30) day cancellation notice to the other party.
